St. James Parish Sales Tax: Rates, Exemptions, and Filing

The St. James Parish sales tax combines Louisiana’s 5% state rate with a local rate that depends on where the sale happens: 8.50% total in unincorporated areas, 9.00% in the Town of Gramercy, and 9.50% in the Town of Lutcher. The St. James Parish School Board’s Sales and Use Tax Department collects every local component, no matter which taxing body ultimately receives the money.1St. James Parish Schools. Rates by Location

Louisiana’s state general sales and use tax is 5%, effective January 1, 2025 and scheduled to hold through December 31, 2029.2Louisiana Department of Revenue. What Is the State Sales Tax Rate? The local piece changes with the point of sale:

  • Unincorporated parish: 3.50% local (2.50% to the School Board, 1.00% to the Parish Council), for 8.50% combined.
  • Town of Gramercy: 4.00% local (2.50% School Board, 1.50% town), for 9.00% combined.
  • Town of Lutcher: 4.50% local (2.50% School Board, 2.00% town), for 9.50% combined.

The Parish Council’s 1% still applies inside Gramercy and Lutcher, but the proceeds are directed to the towns rather than the council.3St. James Parish, LA. Sales Tax If you ring up sales at more than one location in the parish, you need to track which rate applies at each register.

What’s Taxable

The tax applies to sales, leases, and rentals of tangible personal property delivered to a consumer in the parish. Louisiana law also reaches certain services, including hotel and short-term lodging furnished to transient guests and repairs to tangible personal property.4Louisiana Department of Revenue. General Sales and Use Tax Specific digital products and services listed under R.S. 47:301 are also taxable.5Louisiana State Legislature. Louisiana Revised Statutes 47:301 – Definitions Assume a transaction is taxable unless you can point to a specific exemption.

Common Exemptions

Three categories cover most routine exemption claims, and each requires documentation on hand when the parish asks:

Farm equipment is a trap worth flagging. Louisiana’s state-level exemption for qualified farm equipment does not automatically extend to local sales taxes; a parish school board or governing authority must adopt its own resolution to exempt farm equipment from local levies.8Justia Law. Louisiana Revised Statutes 47-305.25 – Exclusions and Exemptions; Farm Equipment Confirm with the Sales and Use Tax Department before assuming the local portion is waived on an agricultural purchase.

Hotel Occupancy Tax

Lodging operators collect something extra. The River Parishes Tourist Commission levies a 2% occupancy tax on hotels, motels, bed-and-breakfasts, and campgrounds, and it stacks on top of the ordinary sales and use tax that already applies to short-term lodging.3St. James Parish, LA. Sales Tax A guest booking a room in Gramercy, for example, sees the 9.00% combined sales tax plus the 2% occupancy tax. Month-to-month apartment leases and single-family dwelling rentals are not subject to the occupancy tax.

Registering With the Parish

Before you collect, you need a Federal Employer Identification Number and your North American Industry Classification System code. The School Board Sales and Use Tax Department handles registration and issues the reporting forms. Contact information: P.O. The primary reporting document is the St. James Parish Sales and Use Tax Return, which asks for total gross sales, deductions for exempt transactions, and the net taxable amount.

Filing Returns and Making Payments

Returns are due on the first day of the month following the reporting period, with a grace window: the return becomes delinquent only if it is not postmarked by the 20th of that month.9St. James Parish School Board. Late Penalties and Interest

Missing the 20th triggers two separate charges that run alongside each other. The delinquent penalty is 5% of the unpaid tax for each 30-day period the return remains delinquent, capped at 25%.10Louisiana State Legislature. Louisiana Revised Statutes 47:1602 – Specific Penalties Interest accrues at 1% of the unpaid tax per month from the original due date until the balance is paid in full.9St. James Parish School Board. Use Tax on Untaxed Purchases

If you buy taxable goods from an out-of-state retailer, an internet seller, or a catalog company that did not charge Louisiana sales tax, you owe consumer use tax. For 2026, Louisiana applies a flat 9% consumer use tax rate regardless of your specific parish rate.11Louisiana Department of Revenue. Louisiana Consumer Use Tax Return (R-1035)

Individuals have two options: report it on the Louisiana individual income tax return (Form IT-540 for residents), or file a standalone Form R-1035. For 2026 purchases, the deadline is the due date of the 2026 state income tax return, May 17, 2027. Businesses don’t use Form R-1035; they report use tax on their regular dealer sales tax returns.11Louisiana Department of Revenue. Louisiana Consumer Use Tax Return (R-1035)

Remote Sellers Shipping Into Louisiana

Out-of-state businesses must collect and remit Louisiana sales tax once they cross either threshold during the current or prior calendar year: more than $100,000 in gross revenue from Louisiana deliveries, or 200 or more separate transactions shipped to Louisiana addresses.12Louisiana Sales and Use Tax Commission for Remote Sellers. Frequently Asked Questions Sales made through a marketplace facilitator such as Amazon count toward the marketplace’s threshold, not the individual seller’s.

Once you cross, register with the Louisiana Sales and Use Tax Commission for Remote Sellers within 30 calendar days and begin collecting within 60 days of approval. Registration and filing go through the dedicated remote sellers portal at remotesellersfiling.louisiana.gov, not the Parish E-File system used by local dealers.13Louisiana Sales and Use Tax Commission for Remote Sellers. Buying an Existing Business

Purchasing a business in St. James Parish pulls you into the seller’s tax history. Under R.S. 47:308, the buyer must withhold enough of the purchase price to cover any outstanding tax, interest, and penalties until the seller produces either a receipt from the Secretary of Revenue showing full payment or a certificate confirming nothing is owed.14Louisiana State Legislature. Louisiana Revised Statutes 47:308

Skip that step and you are personally liable for whatever the seller owed, up to the total price you paid. The state will not honor a side contract between buyer and seller that tries to shift that liability. Request a Louisiana Department of Revenue Letter of Good Standing from the seller before closing; the Department will not issue one if there are outstanding balances or unfiled returns.15Louisiana Department of Revenue.
