A State of Florida employee bonus is not an entitlement. Under Section 110.1245 of the Florida Statutes, bonuses are paid only from money the Legislature specifically appropriates for that purpose, and each agency must build a distribution plan approved by the Office of Policy and Budget in the Governor’s office.1Florida Senate. Florida Code Title X Chapter 110 Part I Section 110-1245 – Savings Sharing Program; Bonus Payments; Other Awards If the budget cycle does not fund a bonus, no agency can create one on its own.
Who Decides Whether Bonuses Get Paid
The Legislature controls the money. Section 110.1245 says bonuses “are subject to specific appropriation by the Legislature,” which means agencies cannot repurpose existing funds to pay them.1Florida Senate. Florida Code Title X Chapter 110 Part I Section 110-1245 – Savings Sharing Program; Bonus Payments; Other Awards Bonus funding usually appears inside the General Appropriations Act for the fiscal year.
Section 110.217 authorizes lump-sum bonuses as part of the broader pay administration system, giving managers room to reward employees inside existing pay bands.2Florida Senate. Florida Statutes Chapter 110 – State Employment That authority sits on the books year-round. The checks still only move when the Legislature puts money behind them.
Who Qualifies for a Standard Lump-Sum Bonus
Section 110.1245 lays out four requirements, and missing any single one disqualifies you:1Florida Senate. Florida Code Title X Chapter 110 Part I Section 110-1245 – Savings Sharing Program; Bonus Payments; Other Awards
- You were employed before July 1 of the fiscal year and remained continuously employed through the distribution date.
- You were not on leave without pay for more than six consecutive months during the fiscal year.
- You had no sustained disciplinary action between July 1 and the distribution date, including written reprimands, suspensions, dismissals, and discipline-based demotions.
- You demonstrated commitment to the agency’s mission, exceeded normal job expectations, and showed initiative.
Even then, the statute caps distribution at 35 percent of an agency’s total authorized positions. If more employees qualify than that ceiling allows, some will go without. The Office of Policy and Budget can waive the cap, but the agency has to justify the request.1Florida Senate. Florida Code Title X Chapter 110 Part I Section 110-1245 – Savings Sharing Program; Bonus Payments; Other Awards When demand exceeds funding, agencies may also prorate payments.
Separate Programs With Their Own Rules
Some bonus programs run entirely outside the general Chapter 110 framework. The Heroes in the Classroom sign-on bonus under Section 1012.715 is targeted at honorably discharged military veterans and retired first responders who become full-time classroom teachers. To qualify, you need a professional or temporary teaching certificate, a clean disciplinary record from the last five years of prior service, and an agreement to teach for at least two consecutive school years.3Online Sunshine. Section 110.1245 also sets up a savings sharing program on a separate track. An employee or group that proposes a procedure or idea adopted by the state, and that reduces state expenditures, can receive a cash award tied to the actual savings realized. The agency head recommends the award, and the Legislative Budget Commission has to approve each one. The program covers Career Service employees, Selected Exempt Service employees, and comparable judicial branch positions. Unlike the standard bonus, the payout is proportional to a measurable outcome rather than a performance review.
When and How You Get Paid
Once the Legislature funds bonuses, each agency has to submit a distribution plan to the Office of Policy and Budget by September 15. The plan has to include eligibility criteria, a periodic evaluation process, and a method for peer input that factors into bonus decisions. Standard lump-sum bonuses are paid in June of each year.1Florida Senate. Florida Code Title X Chapter 110 Part I Section 110-1245 – Savings Sharing Program; Bonus Payments; Other Awards
The Department of Financial Services processes the payment through the Florida Accounting Information Resource (FLAIR) system, the same system that handles all state payroll.4Florida Department of Financial Services. Florida Accounting Information Resource (FLAIR)
Clawback If You Leave Early
Some programs demand the money back if you don’t finish a required commitment period. Heroes in the Classroom is the clearest example: accept the sign-on bonus, fail to maintain employment for two consecutive school years, and you must reimburse the full amount.3Online Sunshine. Florida Statutes 1012.715 – Heroes in the Classroom Sign-On Bonus Before you accept any targeted bonus, read the terms for a repayment clause.
What Taxes Come Out of Your Bonus
Florida does not impose a state income tax on individuals, so no state withholding touches your bonus. Federal withholding does.
The IRS classifies bonuses as supplemental wages. Employers can either apply a flat 22 percent federal income tax rate to the bonus or combine it with your regular paycheck and withhold at your normal rate. The flat method is more common because it’s simpler for payroll.5Internal Revenue Service. Publication 15 – Employer’s Tax Guide If your supplemental wages pass $1 million in a calendar year, the rate on the amount above $1 million jumps to 37 percent.6Internal Revenue Service. Publication 15-A – Employer’s Supplemental Tax Guide
FICA still applies. Social Security tax is 6.2 percent on earnings up to the 2026 wage base of $184,500, and Medicare tax is 1.45 percent with no cap, for a combined 7.65 percent.7Internal Revenue Service. Topic 751 – Social Security and Medicare Withholding Rates If your total wages for the year exceed $200,000, your employer also withholds an additional 0.9 percent Medicare surtax on the earnings above that threshold.8Internal Revenue Service. Topic No. 560 – Additional Medicare Tax
One way to soften the tax hit: Florida state employees are immediately eligible for the Florida Deferred Compensation Plan, a 457(b) account that allows pre-tax or Roth contributions of up to $24,500 in 2026. Employees age 50 and older can add an $8,000 catch-up, and those aged 60 through 63 can add $11,250. Directing part of your includible compensation into this account, if the plan permits it, may reduce the taxable impact of a bonus in the year you receive it.
How a Bonus Changes Your Overtime Pay
If you are non-exempt, this matters. Under the Fair Labor Standards Act, nondiscretionary bonuses must be included in your regular rate of pay when calculating overtime.9U.S. Department of Labor. Fact Sheet 56C – Bonuses Under the Fair Labor Standards Act (FLSA) A bonus is nondiscretionary when employees know about it in advance and can expect it for meeting specific goals, which covers performance bonuses, attendance bonuses, and production bonuses.
Truly discretionary bonuses, where the employer alone decides at or near the end of the period whether to pay and how much, can be excluded from the regular rate.10Office of the Law Revision Counsel. United States Code Title 29 Section 207 Florida’s standard lump-sum bonus is an interesting case: the statute spells out eligibility criteria in advance and agencies distribute by an approved plan, which gives qualifying employees a reasonable expectation of payment and leans toward nondiscretionary treatment.
When a nondiscretionary bonus applies, the employer divides total compensation for the covered period (bonus included) by total hours worked, then pays an additional half-time premium on each overtime hour.9U.S. Department of Labor. Fact Sheet 56C – Bonuses Under the Fair Labor Standards Act (FLSA) If you worked overtime during a bonus-covered period and never saw an overtime adjustment, that’s worth flagging to payroll.
If You Were Skipped or Shorted
Start inside your agency. File a written request with your HR or payroll office and attach your performance evaluations, employment records, and the agency’s bonus distribution plan. Agencies typically respond within 30 to 60 days.
If the internal answer doesn’t resolve it, the Division of Administrative Hearings holds formal hearings before an Administrative Law Judge when there are disputed issues of fact in an agency decision. Discrimination complaints go to the Florida Commission on Human Relations, which investigates and resolves employment discrimination cases.11Florida Commission on Human Relations. About the Florida Commission on Human Relations
Unionized employees have another route. Chapter 447 of the Florida Statutes governs public employee labor relations, and the Public Employees Relations Commission handles unfair labor practice charges under Section 447.503. PERC can order remedies including cease-and-desist orders and back pay.12Online Sunshine. Florida Statutes Chapter 447 – Labor Organizations Collective bargaining agreements can establish bonus eligibility rules, payment schedules, and grievance procedures that differ from the default statutory framework, but negotiated terms still cannot exceed what the Legislature appropriates. Court cases over bonus denials are rare because judges consistently treat them as discretionary legislative decisions rather than vested employee rights.
