Tax-Free West Virginia: Social Security, Pensions, Homestead

West Virginia tax exemptions have expanded sharply since 2023, and the 2026 tax year brings the biggest change yet: a full state income tax exemption on Social Security benefits for every resident, regardless of income. That joins a lineup of breaks already on the books, including full exclusions for military and first responder pensions, a refundable credit that returns every dollar of vehicle property tax, a homestead exemption for seniors and disabled homeowners, an $8,000 retirement income deduction, and an annual back-to-school sales tax holiday.

Social Security Is Fully Exempt in 2026

Starting with the 2026 tax year, 100 percent of taxable Social Security income is excluded from West Virginia personal income tax.1West Virginia Tax Division. Social Security Modification Residents with federal adjusted gross income under $50,000 (or $100,000 for joint filers) already had the full exemption in prior years. The 2026 change finishes a phase-in that gave higher-income taxpayers a 35 percent reduction in 2024 and 65 percent in 2025 before reaching the full exclusion.

The exemption covers whatever portion of your Social Security is counted as taxable on your federal return, including Old Age and Survivors benefits and Social Security Disability Insurance.2West Virginia Legislature. West Virginia Code 11-21-12 – West Virginia Adjusted Gross Income of Resident Individual You claim it as a decreasing modification on your state return. No separate application is needed.

Military and First Responder Pensions Are Fully Excluded

If you receive military retirement pay, none of it is subject to West Virginia income tax. Since the 2018 tax year, 100 percent of retirement income from the Armed Forces, Reserves, National Guard, Coast Guard, Public Health Service, and the National Oceanic and Atmospheric Administration qualifies for a full decreasing modification under W. Va. Code ยง 11-21-12(c)(7). Survivorship annuities tied to those pensions receive the same treatment.2West Virginia Legislature. West Virginia Code 11-21-12 – West Virginia Adjusted Gross Income of Resident Individual

Retired members of West Virginia’s law enforcement and fire services get the same treatment through a separate provision. Pension income from the West Virginia State Police Retirement System, the Deputy Sheriff Retirement System, local police retirement plans, and the West Virginia Firemen’s Retirement System is fully excluded, including survivorship annuities. There is no income cap and no phase-in.

The $8,000 Senior and Disability Retirement Deduction

Anyone age 65 or older, or anyone certified as permanently and totally disabled, can subtract up to $8,000 of income from any source when calculating West Virginia taxable income. A married couple filing jointly where both spouses qualify can deduct up to $16,000.2West Virginia Legislature. One catch matters here. The $8,000 is reduced dollar-for-dollar by other decreasing modifications you claim under the same statute, including the Social Security exemption and any military or first responder pension exclusion. If those other modifications already reach $8,000 per person, this deduction drops to zero. The deduction is most useful for retirees drawing on a private pension, 401(k), or IRA whose Social Security and military exclusions haven’t already used up the room.

Income Tax Rates Keep Falling

Rate cuts have been running in parallel with these targeted exemptions. HB 2526, signed in 2023, reduced rates by an average of 21.25 percent and set up a trigger mechanism for further automatic cuts when state revenue hits certain benchmarks.3West Virginia Tax Division. 2026 Income Tax Rate Cut Effective January 1, 2026, the trigger fired again and dropped the top marginal rate from 4.82 percent to 4.58 percent, with every lower bracket reduced by roughly 5 percent as well.

Motor Vehicle Property Tax Credit

You still get a personal property tax bill for your vehicles from the county assessor and still pay it to the county sheriff. The state then returns the full amount through a refundable income tax credit. If the credit exceeds what you owe in state income tax, the balance comes back as a refund.4Legal Information Institute. West Virginia Code R 110-21H-3 – Motor Vehicle Property Tax Adjustment Credit

Timing is where people lose this benefit. The payment must reach the sheriff by the due date. Late payments, delinquent payments, and back taxes don’t count toward the credit, and a payment that arrives one day late disqualifies the entire amount for that vehicle. Keep the receipt from the sheriff’s office; you report the payment on a schedule attached to your state return. File the return even if you owe no state income tax, because the credit is refundable and only paid out through the return.5West Virginia Tax Division. Motor Vehicle Property Tax Adjustment Credit

Leased vehicles qualify. The leasing company claims the credit and is required to pass the savings along to you. If your lease payments don’t reflect that discount, contact the leasing company directly.

Homestead Exemption for Seniors and Disabled Homeowners

Homeowners who are 65 or older, or permanently and totally disabled, can exempt the first $20,000 of their home’s assessed value from property tax.6West Virginia Tax Division. Property Tax Exemptions Assessed value in West Virginia is 60 percent of appraised value, so a home appraised at roughly $33,300 or less would owe no property tax at all. Higher-value homes still see a meaningful reduction.

You apply through your county assessor’s office and generally only need to provide proof of age or disability once. A proposed constitutional amendment to raise the exemption to $40,000 did not make it onto the November 2026 ballot, so the $20,000 figure remains in effect.7Ballotpedia. Back-to-School Sales Tax Holiday

West Virginia waives its 6 percent state sales tax, along with municipal sales taxes, on specific back-to-school purchases for a long weekend each summer. The 2026 holiday runs from July 31 through August 3.8West Virginia Tax Division. Sales Tax Holiday Questions and Answers Price caps apply per item:

  • Clothing: $125 or less per item
  • School supplies: $50 or less per item
  • Instructional materials: $20 or less per item
  • Laptops and tablets: $500 or less per unit
  • Sports equipment: $150 or less per item

Items priced above the cap are taxed on the full price, not just the amount over the limit. A $130 jacket is fully taxable.

Several categories people assume are included actually are not. Clothing accessories like jewelry, handbags, sunglasses, watches, and wallets don’t count as clothing under the rule. Protective equipment such as helmets, safety glasses, and hard hats is excluded. Sewing supplies and materials, including fabric, thread, and zippers, are taxed normally. Anything purchased for use in a trade or business is excluded regardless of price.
