The 25% Cap and the $217.50 Floor

If your disposable pay for the week is $217.50 or less, the creditor takes nothing.

A few examples show how it plays out:

What Counts as Disposable Earnings

Extra Protection If You Have Dependent Children

Tennessee shaves a little more off the garnishable base for parents. Income Sources a Creditor Cannot Touch

  • Social Security, Families First payments, and local public assistance.
  • All veterans’ benefits.

  • Crime victim reparation awards, protected up to $5,000.
  • Personal bodily injury payments, protected up to $7,500.
  • Child support and alimony you receive, exempt once the funds are more than 30 days past the date you claim the exemption in court.

Retirement money gets its own treatment. Payments from pensions, profit-sharing plans, and annuities receive the same protection as wages under the standard cap. Bank Accounts Holding Federal Benefits

A frequent worry for people on Social Security is that a bank levy will trap their exempt benefits. Federal regulations require the bank to look before it freezes. Anything in the account above the protected amount can still be frozen while the court sorts things out, so keeping benefits in an account separate from other deposits makes proof easier if a dispute arises.

Higher Caps for Support, Student Loans, and Taxes

The 25% ceiling does not apply to family support obligations. Tennessee allows income withholding for child support or alimony up to 50% of income after subtracting Social Security tax, withholding taxes, and health insurance premiums that cover the child.9Justia. IRS wage levies do not use a percentage at all. How the Process Works Once a Judgment Is Entered

A creditor cannot garnish wages without first suing you, winning a judgment, and obtaining a garnishment order from the court. Once the order is served, your employer has 10 days to file a written answer accounting for wages or property it holds, and 30 days to remit the garnishable portion to the court.14Tennessee Administrative Office of the Courts. Challenging a Garnishment With an Exemption Claim

If a garnishment reaches income that should be protected, you can file an exemption claim with the court that issued the order. Fill them out carefully. The court uses your affidavit to decide whether the garnishment causes an unlawful hardship, and any mistakes weaken your credibility. Bring recent pay stubs, benefit award letters, and bank statements showing where your deposits come from. After the clerk accepts the paperwork, serve a copy on the creditor. The court sets a hearing, and if the exemption is granted it issues a modified order to your employer that reduces or ends the withholding.

How Long a Tennessee Judgment Can Follow You

A civil judgment in Tennessee is enforceable for 10 years.
