Texas Cigarette Tax: Rates, Age Limits, and Penalties

Buy a standard pack of 20 cigarettes in Texas and you are paying $1.41 in state excise tax and $1.01 in federal excise tax built into the shelf price, plus state and local sales tax of up to 8.25% calculated on top of that price. The Texas cigarette tax, in other words, is layered: two excise taxes baked in before the pack reaches the shelf, then sales tax applied to the total at the register.

What You Pay Per Pack

Texas Tax Code Chapter 154 sets the state excise rate at $70.50 per 1,000 cigarettes for standard cigarettes weighing three pounds or less per thousand. That works out to $1.41 per pack of 20 and $14.10 per carton of ten packs. Heavier cigarettes, those weighing more than three pounds per thousand, are taxed at $72.60 per 1,000 units, about $2.10 more per thousand than the standard rate.1State of Texas. The federal excise tax sits on top of that. Under 26 U.S.C. ยง 5701, small cigarettes carry a federal tax of $50.33 per 1,000, which equals $1.0066 per pack and is typically rounded to $1.01.2Office of the Law Revision Counsel. 26 USC 5701 – Rate of Tax That rate has been in place since April 2009, when the Children’s Health Insurance Program Reauthorization Act raised it from $0.39.3TTB: Alcohol and Tobacco Tax and Trade Bureau. Federal Excise Tax Increase and Related Provisions Combined, the excise burden on a standard pack reaches roughly $2.42 before anything else is added.

Then comes sales tax. Texas charges a 6.25% state sales tax, and local jurisdictions (cities, counties, transit authorities, and special-purpose districts) can add up to another 2%, pushing the combined rate as high as 8.25%.4Texas Comptroller. Sales and Use Tax Sales tax is applied to the shelf price, which already includes the excise taxes, so you effectively pay tax on the taxes. A pack priced at $8.00 in a jurisdiction with the full 8.25% rate rings up at $8.66.

Every pack sold legally in Texas carries a small adhesive stamp on the cellophane wrapper proving the excise tax has been paid. The Comptroller requires it on each individual package before retail sale, and auditors or law enforcement can verify compliance just by looking.5Cornell Law School. 34 Texas Administrative Code 3.101 – Cigarette Tax and Stamping Activities Any pack without a valid stamp is subject to seizure.

Minimum Age to Buy

You have to be 21 to buy cigarettes in Texas. Federal “Tobacco 21” law took effect on December 20, 2019, and prohibits retailers from selling tobacco products, including cigarettes and e-cigarettes, to anyone under 21.6FDA. Tobacco 21 Texas law in the Health and Safety Code mirrors that, making it a criminal offense to sell, give, or cause to be given a cigarette or tobacco product to anyone younger than 21.7State of Texas. Buying Online or From Out of State

Ordering cigarettes from an out-of-state website does not get you out of paying Texas excise tax, and federal law puts hard limits on how cigarettes can even be shipped. The Prevent All Cigarette Trafficking (PACT) Act bans mailing cigarettes through the United States Postal Service, and nonmailable cigarettes deposited in the mail are subject to seizure. Senders face criminal fines, imprisonment, and civil penalties.8U.S. Customs and Border Protection. Any distributor shipping cigarettes across state lines must register with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) and with the tax administrators of every state they ship into. They have to file monthly reports listing each customer’s name, address, the brand purchased, and the quantity shipped, organized by city and ZIP code, no later than the 10th day of the following month.9ATF. Prevent All Cigarette Trafficking (PACT) Act Remote sales to consumers must comply with all applicable state and local excise tax, stamping, and licensing requirements. The Texas tax follows the cigarettes.

Penalties for Unstamped Cigarettes

Texas treats cigarette tax violations seriously, with both civil and criminal exposure. A distributor, wholesaler, or retailer who violates Chapter 154 faces a civil penalty of up to $2,000 for each violation, and the Comptroller can deny, suspend, or revoke a permit over the same conduct.10State of Texas. On the criminal side, selling unstamped cigarettes, offering unstamped cigarettes as prizes or gifts, and knowingly smoking unstamped cigarettes are Class A misdemeanors under Texas law. Selling cigarettes without a valid permit is also a Class A misdemeanor.11State of Texas. How Texas Compares Nationally

State cigarette excise tax rates run from as low as $0.17 per pack to more than $5.00 per pack. At $1.41, Texas sits slightly below the national midpoint. Add the $1.01 federal excise and local sales tax of up to 8.25% on the shelf price, and the total tax load on a single pack in Texas can easily top $3.00, depending on where you buy and what the pack costs.
