Texas Contract Cancellation Laws: Deadlines, Notice, and Leases

Texas contract cancellation laws give consumers fixed windows to walk away from certain agreements no matter what the contract says: three business days for door-to-door sales, home equity loans, credit repair contracts, and health spa memberships; six days for timeshares; 14 days for contracts for deed; and 10 to 20 days for most life insurance policies. These rights come from statute, not from the contract, and a clause telling you otherwise doesn’t override them.

Contracts You Can Cancel and How Long You Have

Door-to-Door and Home Solicitation Sales

Texas Business and Commerce Code Chapter 601 gives you three business days to cancel any consumer purchase made outside a merchant’s regular place of business. That includes your home, a hotel conference room, a parking-lot tent sale, or anywhere that isn’t the seller’s permanent storefront. The right applies to goods or services costing more than $25, or real property purchases over $100.1State of Texas. At the time of sale, the seller must give you a completed contract or receipt printed in the same language used during the sales presentation, along with a cancellation form. If the seller skips this step, your cancellation right still exists, and the seller has committed a deceptive trade practice.1State of Texas. The federal FTC Cooling-Off Rule runs alongside it, covering purchases of $25 or more at your home and $130 or more at other temporary locations like convention centers or hotel rooms.2eCFR. 16 CFR Part 429 – Rule Concerning Cooling-off Period for Sales Made at Homes or at Certain Other Locations Where both apply, whichever gives you stronger protection controls.

Several transactions fall outside the Texas home solicitation law, including farm equipment purchases, insurance sales regulated by the Texas Department of Insurance, purchases on a preexisting revolving charge account, and real estate transactions handled by a licensed attorney or real estate broker.1State of Texas. Timeshare Purchases

Under Property Code Section 221.041, you can cancel a timeshare purchase before the sixth day after you sign and receive a copy of the contract or receive the required disclosure statement, whichever comes later. This right cannot be waived; any contract language that tries to eliminate or shorten it is voidable by the purchaser.3State of Texas. Texas Property Code 221.041 – Purchaser’s Right to Cancel

You can hand-deliver your notice, mail it by prepaid U.S. mail, or send it by overnight carrier to the developer or its agent for service of process. The developer must refund all payments within 30 days of receiving the cancellation notice, or within five days of receiving good funds from you, whichever is later.4State of Texas. Contracts for Deed

If you’re buying property through a contract for deed or similar arrangement where the seller keeps title until the full price is paid, Texas gives you 14 days to cancel for any reason. Send a signed, written cancellation by certified or registered mail (return receipt requested), by telegram, or deliver it in person before the 14th day after signing.5State of Texas. Once the seller receives your notice, they have 10 days to return all payments you’ve made and cancel any security interest that arose under the contract. The seller must also include a clearly visible cancellation statement in the contract itself, printed in 14-point bold or uppercase type near the signature line.5State of Texas. Beyond the 14-day window, you can also cancel and get a full refund if the seller failed to provide required disclosures about the property’s condition, tax payment history, or insurance coverage. Those failures are treated as deceptive trade practices, which opens additional remedies.6State of Texas. Texas Property Code Chapter 5 – Conveyances – Section 5.069

Home Equity Loans and Cash-Out Refinances

Federal law under the Truth in Lending Act gives you three business days to rescind a home equity loan, a home equity line of credit, or a cash-out refinance. It does not apply to a purchase mortgage.7Office of the Law Revision Counsel. 15 USC 1635 – Right of Rescission as to Certain Transactions

The clock starts on whichever event happens last: the loan closing, your receipt of required disclosure documents, or your receipt of the rescission notice. If the lender never provides proper disclosures, the rescission right extends to three years from the date the loan closed.8eCFR. 12 CFR 1026.15 – Right of Rescission

To rescind, notify the lender in writing. The notice is effective when mailed, not when received. The lender must give you two copies of a rescission notice at closing that explains the right, describes how to exercise it, and includes the deadline. If you close on a home equity loan and don’t get that notice, your window is dramatically longer than three days.8eCFR. 12 CFR 1026.15 – Right of Rescission

Credit Repair Contracts

Federal law gives you three business days to cancel any contract with a credit repair organization, without penalty. The company must provide a cancellation form at the time you sign, and you cancel by mailing or delivering a signed, dated notice before midnight of the third business day.9Office of the Law Revision Counsel. 15 USC 1679e – Right to Cancel Contract

Health Spa Memberships

Life Insurance Policies

Ending a Lease Early Without Penalty

A residential lease isn’t a buyer’s-remorse contract, but two Texas statutes let tenants exit early in specific circumstances.

Family Violence Victims

Property Code Section 92.016 allows tenants who are victims of family violence to break a lease without penalty. You provide the landlord with one qualifying document: a protective order, an order of emergency protection, or documentation from a licensed healthcare provider, mental health provider, or family violence advocate who examined or assisted you.12State of Texas. If your abuser does not live with you, give the landlord the documentation plus 30 days’ written notice, and you owe rent during those 30 days. If your abuser is a co-tenant or occupant, you can leave immediately after providing the documentation.12State of Texas. Military Service Members

Under Property Code Section 92.017, service members and their dependents can terminate a lease early and avoid liability for future rent when the tenant enters military service after signing the lease, or when a service member already in the military receives orders for a permanent change of station or a deployment of 90 days or more. You must deliver written notice of termination along with a copy of the relevant military orders or documentation of entry into service. How to Deliver a Valid Cancellation Notice

Nearly every statutory cancellation right in Texas requires written notice. A phone call won’t do. Sign and date your notice, state your intent to cancel clearly, and get it to the other party by the deadline.

The safest delivery method for most situations is certified mail with return receipt requested, because it proves both the mailing date and the receipt. Some statutes allow more: the timeshare law permits hand delivery or overnight carrier, and home equity rescission notices can go by mail, telegram, or any other written form.8eCFR. 12 CFR 1026.15 – Right of Rescission Certified mail is the one approach that works almost everywhere.

Timing rules vary. Most Texas cancellation statutes treat notice as effective when mailed, so a postmark within the deadline is enough even if the seller receives it later.14Federal Trade Commission. Buyer’s Remorse: The FTC’s Cooling-Off Rule May Help Some contracts specify the other party must actually receive the notice by the deadline. Read the statute or contract language governing your situation before relying on a mailing date alone.

The federal E-SIGN Act generally allows electronic records and signatures to satisfy writing requirements, but only if you affirmatively consented to receive electronic communications and haven’t withdrawn that consent.15Office of the Law Revision Counsel. 15 USC 7001 – General Rule of Validity In practice, if the seller ran the transaction on paper, a cancellation email may not satisfy the statutory notice requirement. When the stakes are high, send the cancellation on paper by certified mail even if you also follow up electronically.

Texas courts enforce notice requirements strictly. In Besteman v. Pitcock, a Texas appellate court held that a buyer who failed to give timely written notice to exercise a contractual option lost the right entirely, rejecting the argument that the forfeiture was disproportionate.16FindLaw. Besteman v. Pitcock (2008) Missing the deadline or using the wrong method can forfeit a valid cancellation right.

What Sellers Can and Can’t Do With Cancellation Clauses

No contract can waive a statutory cancellation right. A timeshare developer who writes “all sales final” into the contract has accomplished nothing; the six-day cancellation right under Property Code Section 221.041 still applies, and the waiver clause is voidable by the buyer.3State of Texas. Texas Property Code 221.041 – Purchaser’s Right to Cancel The same holds for home solicitation sales, credit repair contracts, and every other agreement covered by a cancellation statute.

When a contract adds its own cancellation terms, Texas courts enforce them if the terms are clear, voluntarily agreed to, and not unconscionable. Cancellation fees are the usual battleground. Courts uphold a preset fee when the amount is a reasonable estimate, made at signing, of the losses the other side would actually suffer. If the figure is designed to punish rather than compensate, or bears no relationship to any foreseeable harm, courts treat it as an unenforceable penalty. Take-it-or-leave-it contracts drafted entirely by one side face closer review.

What Happens If You Cancel Without a Right

If you cancel a contract outside a statutory window and without a valid contractual right, the other party can sue for breach. Texas courts award compensatory damages for direct financial harm and consequential damages for indirect losses like missed business opportunities. If the contract specifies a liquidated damages amount for early termination, courts will enforce it unless it qualifies as an unreasonable penalty.

In some cases, particularly real estate and long-term service agreements, a court may order specific performance, meaning you have to follow through on the contract rather than just pay money. Courts reserve this for situations where the subject of the contract is unique enough that damages alone won’t make the other party whole.

The non-breaching party has a duty to mitigate. They can’t ignore the cancellation, let damages pile up, and send you the full bill. A landlord who knows you’ve vacated, for example, must make reasonable efforts to re-rent the unit rather than charge you for the entire remaining lease term.

Tax consequences can catch people off guard. When a creditor cancels or forgives $600 or more of your debt, they must report it to the IRS on Form 1099-C, and the forgiven amount is generally treated as taxable income.17IRS. Where Statutory Cancellation Doesn’t Reach

A standard home purchase, where title transfers at closing, does not carry the same cancellation right as a contract for deed. Once you sign a purchase contract, you’re generally bound unless a contingency, such as financing or inspection, hasn’t been met.

Employment contracts sit outside the cooling-off framework entirely. Texas is an at-will employment state, so most employees can leave a job at any time and employers can end the relationship just as freely. Employees on fixed-term written contracts, common for physicians, educators, and executives, may face notice periods, non-compete restrictions, or financial penalties for leaving before the term ends. Whether those provisions hold up depends on whether they’re reasonable, and the liquidated-damages-versus-penalty analysis that governs commercial contracts applies here too.
