Texas Non-Repairable Title: Rules, Deadlines, and Penalties

A Texas non-repairable title is a vehicle title that permanently prohibits the vehicle from being registered, repaired, rebuilt, or reconstructed. The vehicle can only be used as a source of parts, sold for scrap metal, or exported. What Non-Repairable Means, and How It Differs From Salvage

Under Texas Transportation Code Section 501.091, a non-repairable motor vehicle is one damaged, wrecked, or burned to the point that its only value is as parts or scrap metal. The label also covers vehicles brought into Texas with an out-of-state non-repairable or junked title, vehicles reported by a salvage dealer to TxDMV, vehicles surrendered by the owner for dismantling or scrapping, and vehicles sold strictly for export.2State of Texas. Salvage is a different category. A salvage motor vehicle is one whose repair cost (parts and labor, excluding paint and sales tax) exceeds its pre-damage actual cash value.2State of Texas. Texas Transportation Code 501.091 – Definitions A salvage vehicle can eventually be rebuilt, inspected, and put back on the road with a rebuilt salvage title. A non-repairable vehicle cannot. It is past the point where repair is a legal option.

What You Can and Can’t Do With a Non-Repairable Vehicle

The title itself states on its face that the vehicle cannot be issued a regular title, cannot be registered in Texas, and cannot be repaired, rebuilt, or reconstructed. Texas also blocks a common workaround. You cannot use the body or frame of a non-repairable vehicle to repair, rebuild, or assemble another vehicle.1Texas Department of Motor Vehicles. Salvage/Nonrepairable Motor Vehicle Manual Individual parts pulled from the vehicle can be reused. The chassis and body cannot.

That leaves three legitimate paths:

Selling for Parts

Engines, transmissions, electronics, and body panels often retain real value. Salvage yards, parts recyclers, and individual buyers are the usual market. If you handle enough vehicles this way, you cross into dealer territory (covered below).

Selling for Scrap Metal

If usable parts are minimal, a metal recycler or scrap yard will pay by weight. The payout tracks current steel and aluminum prices along with the vehicle’s weight.

Exporting the Vehicle

Texas law specifically recognizes export as a permitted disposition for a non-repairable vehicle.2State of Texas. Texas Transportation Code 501.091 – Definitions The federal steps for export are separate from the Texas title process and are described further down.

How to Apply for or Transfer the Title

Non-repairable titles are not handled at the county tax assessor-collector’s office. Applications go directly to TxDMV in Austin.1Texas Department of Motor Vehicles. Salvage/Nonrepairable Motor Vehicle Manual

The form is the Application for Salvage or Nonrepairable Vehicle Title, Form VTR-441.3Texas Department of Motor Vehicles. Form VTR-441 – Application for Salvage or Nonrepairable Vehicle Title It asks for:

  • Your name and current address.
  • The vehicle’s make, body style, model year, and VIN.
  • An odometer disclosure with the current reading, certified by both seller and buyer.
  • Evidence of ownership: a properly assigned Texas title, salvage title, non-repairable title, manufacturer’s certificate of origin, or a comparable out-of-state document showing a direct connection to Texas.
  • A lien release if any lien exists on the vehicle. This is not required if ownership isn’t changing.

The application fee is $8, or $10 if you also want a certified copy of the original vehicle title.3Texas Department of Motor Vehicles. Once TxDMV has a complete application, it issues the non-repairable title within six business days. If a lien is recorded, TxDMV mails the title to the lienholder rather than the owner.1Texas Department of Motor Vehicles. Salvage/Nonrepairable Motor Vehicle Manual

The 30-Day Deadline

Buyers in a private sale have 30 calendar days from the purchase date to apply for a new title. Miss that window and you owe an automatic $25 penalty, plus another $25 for every month the title stays late. TxDMV and county tax offices cannot waive or reduce these penalties. Exporting the Vehicle to Another Country

If the plan is to send the vehicle abroad, U.S. Customs and Border Protection adds its own steps on top of the Texas title. The exporter must file Electronic Export Information through the Automated Export System at least 72 hours before the vehicle leaves the country. At export, you present the original certificate of title (or a certified copy) plus two complete photocopies. The vehicle has to be brought to the port of entry the day of export for physical inspection and VIN verification. When Buying or Selling Crosses Into Dealer Territory

No special license is needed to buy or sell a small number of non-repairable vehicles. Cross five in a calendar year, though, and Texas requires a salvage vehicle dealer license. That threshold counts salvage and non-repairable vehicles together. Licensing brings real obligations: a dedicated business location that is not a residence, a visible sign and office for records, a Texas Sales and Use Tax Permit, compliance with local zoning, and registration with the National Motor Vehicle Title Information System (NMVTIS).7Texas Department of Motor Vehicles. One practical note if you’re selling to a salvage yard: legitimate buyers report acquisitions to NMVTIS and will ask for your documentation. A buyer who wants no paperwork is a warning sign, because clean reporting is what keeps the non-repairable status from being washed away in another state.8VehicleHistory.bja.ojp.gov. Penalties for Misrepresenting a Non-Repairable Vehicle

Texas treats title fraud on these vehicles as more than a paperwork issue. A first offense for violating the salvage and non-repairable title requirements is a Class C misdemeanor. A second offense is a Class B misdemeanor. A third or later offense is a state jail felony.9State of Texas. Texas Transportation Code 501.109 – Offenses

The heaviest penalty targets outright fraud. Knowingly providing false information on a non-repairable title application, a certified-copy request, a title assignment, a lien discharge, or any other document required to transfer ownership of a non-repairable vehicle is a third-degree felony carrying two to ten years in prison.9State of Texas.
