Texas State Residency Requirements: Timeframes and Proof

Becoming a resident of Texas means physically living in the state with the intention of making it your permanent home, but the Texas residency requirements you need to meet depend entirely on what you’re trying to do. A driver’s license has a 30-day deadline. In-state tuition takes a year. Divorce takes six months. Voter registration processes in 30 days. Each system has its own clock and its own proof.

The common thread is domicile. Under Texas common law, domicile is the place you live with the intent to stay. Physical presence alone isn’t enough, and neither is intent alone. Courts and agencies look at what you actually do: where you moved your belongings, where you work, where you bank, whether you registered to vote, whether you enrolled your kids in school. A six-month work contract with plans to leave afterward doesn’t create domicile. A vacation out of state doesn’t end it.

Driver’s License and Vehicle Registration

If you bring a vehicle with you when you move, you have 30 days to register it in Texas.1Texas Department of Motor Vehicles. Before registering an out-of-state vehicle, you’ll usually need a Texas inspection. Commercial vehicles always require a safety inspection. Non-commercial vehicles in certain metropolitan counties need an emissions inspection. In counties that require neither, you can self-certify the VIN on the Application for Texas Title and Registration (Form 130-U). You’ll need proof of insurance at inspection.3Texas Department of Motor Vehicles. Out of State and Imported Vehicles

Voter Registration

Texas Election Code Section 13.001 requires that a voter be a U.S. citizen, at least 18 years old, and a resident of the county where they apply. There is no minimum number of days you must live in the county before you can apply. What matters is timing: your registration takes effect 30 days after the county voter registrar receives it, so you need to register at least 30 days before an election you want to vote in.4Texas.gov. Residency for voting is the place where you actually sleep and keep a fixed home you intend to return to. A hotel or temporary work site doesn’t qualify. A P.O. Box isn’t a residence. You register with your street address, and that address determines your polling location.

If you move to a different Texas county, update your registration. Your old county cancels the previous record, and your new county processes a fresh one. You’ll receive a new voter certificate within about 30 days. Change your address fewer than 30 days before an election and you’ll vote at your previous polling location for that election.5Texas.gov. Six Months for Divorce

Texas Family Code Section 6.301 requires that either the person filing or their spouse have been domiciled in Texas for at least six months before the divorce petition is filed. On top of that, at least one spouse must have lived in the specific county where the petition is filed for at least 90 days.6Texas Public Law. Texas Family Code Section 6.301 – General Residency Rule for Divorce Suit

Both requirements have to be met. If neither spouse qualifies, the court lacks jurisdiction and dismisses the case. The parties cannot waive the timelines by agreement. Anyone who has just moved to Texas and wants to file immediately has to wait out the six months, or file in the state where they previously lived if that state permits it.

One Year for In-State Tuition

Texas Education Code Section 54.052 creates three ways to qualify as a resident for tuition purposes at a public university.7Texas Public Law. Texas Education Code 54.052 – Determination of Resident Status

Independent Students

An independent student must establish domicile in Texas at least one year before the census date of the semester they enroll in, and maintain that domicile continuously for the full 12 months. Merely living in Texas doesn’t satisfy the standard. You also need one qualifying activity: gainful employment, ownership of residential property, or operating a business in the state.

Gainful employment has a specific meaning here. It must cover at least half your tuition and living expenses, or average at least 20 hours per week. Self-employment counts. Being a homemaker or relying primarily on public assistance counts. Student jobs, work-study, stipends, fellowships, and teaching or research assistantships do not.8University of Houston. Residency Reclassification A campus job paying half your rent won’t satisfy the requirement, because it’s conditioned on your student status.

Dependent Students

A dependent student qualifies through a parent who has established and maintained Texas domicile for the 12 consecutive months before the census date. The parent must meet the same standard, including one of the qualifying activities.7Texas Public Law. Texas Education Code 54.052 – Determination of Resident Status

Texas High School Graduates

Students who graduated from a Texas high school (or earned the equivalent diploma in Texas) qualify if they lived in the state continuously for the three years before graduation and for the year before the semester’s census date.7Texas Public Law. Homestead Exemption for Property Owners

Once you own a home in Texas and use it as your principal residence, you can claim a residence homestead exemption that reduces your property tax bill. You need an ownership interest, the property must be your principal residence, and you cannot claim a homestead exemption on any other property in or outside Texas.10Texas Comptroller of Public Accounts. Property Tax Exemptions

The largest piece is the school district exemption, which removes $140,000 from your home’s taxable value for school district taxes. Counties that collect farm-to-market or flood control taxes must offer an additional $3,000 exemption. Individual taxing units may adopt a local option exemption of up to 20 percent of appraised value, with a $5,000 floor.10Texas Comptroller of Public Accounts. Property Tax Exemptions

File the application with the appraisal district in the county where the property sits. The general deadline is April 30. If you miss it, you can still file a late application up to about two years after the taxes for that year become delinquent. Buy a property after January 1 and you may receive a prorated exemption for that tax year, provided the previous owner did not already claim the same exemption.10Texas Comptroller of Public Accounts. Documents That Prove Texas Residency

Every agency wants documents that tie your name to a physical Texas address. The specifics vary, but the same handful of records tends to satisfy most requirements.

For a driver’s license or state ID, the Department of Public Safety asks for two documents showing your name and Texas residential address. Acceptable items include a current utility bill dated within 180 days, a residential lease, a mortgage statement, or a property deed. Everything must be printed and show a residential address, not a P.O. Box.11Texas Department of Public Safety. Texas Residency Requirement for Driver Licenses and ID Cards If you can’t produce two qualifying documents in your own name, which comes up often for people living with a spouse or family member whose name is on the bills, you can use a Texas Residency Affidavit (Form DL-5). Someone who can verify your address completes it along with supporting documentation.12Texas Department of Public Safety. Texas Residency Affidavit

Public universities use a Core Residency Questionnaire and ask for supporting records covering the full 12 consecutive months before the census date: utility bills, lease agreements, warranty deeds, and similar proof of continuous domicile.13Office of the Registrar. Texas Residency Documentation

For voter registration, you can mail a completed application to your county voter registrar, submit one in person, or update an address online through the Secretary of State’s website. Whichever method you use, expect about 30 days for processing before your registration becomes active and your voter certificate arrives in the mail.4Texas.gov.
