What the Officer Had to See

If your lane change forced another driver to brake or swerve, it wasn’t safe, whether or not you signaled.

An officer doesn’t need to see a collision to write the ticket. They evaluate what they observed in real time: how close the surrounding vehicles were, whether anyone reacted to avoid contact, whether you signaled, and how abruptly you moved. A smooth, signaled merge into an open lane is legal. Cutting across two lanes in traffic with no signal is exactly what these statutes target.

Getting the Ticket Dismissed With a Driving Safety Course

  • You must notify the court of your request on or before the appearance date on your citation. Miss that deadline and you lose this option.
  • You can’t use this option if you completed a driving safety course to dismiss another ticket within the 12 months before the date of the current offense.
  • The court still charges a fee, but a successful dismissal keeps the conviction off your record.

This one is a right you can demand if you’re eligible, not something the judge has to grant.

Deferred Disposition as the Backup

Deferred disposition is an agreement with the court. You plead guilty or no contest, the judge sets conditions to follow during a probationary period, and if you meet all the requirements, the case is dismissed. There’s no probation officer, but you do have to complete whatever the judge orders and bring proof back. Expect to pay a fine and court costs as part of the deal. A successful deferred disposition avoids a conviction on your driving record and may be eligible for expunction afterward.

Deferred disposition is at the judge’s discretion, not a right. If you’ve used a driving safety course dismissal in the past year, this is likely your only path to keeping the ticket off your record.

Fighting the Ticket at Trial

At trial, the prosecution must prove the violation beyond a reasonable doubt. You get to cross-examine the officer and present your own evidence.
