A TN management consultant is a Canadian or Mexican professional admitted to the United States under the USMCA to provide outside advisory services to a U.S. client. You qualify in one of three ways, your role has to be genuinely advisory rather than operational, and self-employment is off the table. Those three points decide most applications.
Who Qualifies
The USMCA sets three qualifying paths, and you only need to meet one.1eCFR. 8 CFR 214.6 – Citizens of Canada or Mexico Seeking Temporary Entry Under USMCA to Engage in Business Activities at a Professional Level
- A baccalaureate or licenciatura degree from an accredited institution. Any field qualifies, though the degree should make sense in the context of the project you’ve been hired to complete.
- Five years of documented experience working specifically as a management consultant, meaning your primary role was analyzing organizational problems and recommending solutions.
- Five years of experience in a specialty directly related to the specific consulting agreement, even if your prior title was not “consultant.”
The two experience-based paths require a written statement or professional credential attesting to five years of qualifying work.2U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part P Chapter 6 – Requirements for Specific Occupations General management experience does not count toward the second path. You have to show you were doing consulting work, not just holding a senior role.
If your degree was earned outside North America, have it evaluated for U.S. equivalency by a member of the National Association of Credential Evaluation Services (NACES) before you apply. Officers may ask for this.
What Actually Counts as Management Consulting
This is where most applications go sideways. A TN management consultant is an outside advisor brought in to solve a specific organizational problem. You analyze business structures, evaluate operational processes, and recommend strategic changes. The engagement has a defined scope and an end date. A job description that reads like a permanent staff position with day-to-day operational duties will be denied no matter what title appears on the offer letter.
Officers are trained to look past titles. A role labeled “management consultant” that actually involves running a department, supervising employees, or executing routine business functions is not advisory work. The working test: could you hand your report to the client and walk away, leaving them to decide whether and how to act on your recommendations? If yes, it looks like consulting. If you are embedded in the regular workforce doing the company’s ongoing work, it does not.
You can be admitted either as an independent consultant under a direct contract with a U.S. company, or as an employee of a foreign consulting firm that the U.S. entity has hired. Either arrangement is fine, as long as the client-consultant relationship is clear in the paperwork.
Self-Employment Is Not Allowed
TN status does not permit self-employment. Federal regulation defines self-employment to include rendering services to a corporation or entity in which you are the sole or controlling shareholder or owner.1eCFR. 8 CFR 214.6 – Citizens of Canada or Mexico Seeking Temporary Entry Under USMCA to Engage in Business Activities at a Professional Level You cannot route payment through your own U.S.-based consulting company either, because that creates a presumption of self-employment.
State Department consular guidance reinforces this: the U.S. entity hiring you has to be a bona fide organization, not a shell disguising your self-employment.3U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas If your goal is to start and run your own business in the United States, TN is the wrong category; treaty trader (E-1) or treaty investor (E-2) status may fit better.
The Employer Letter and Supporting Documents
The employer support letter is the single most important document in the application. Officers spend more time on it than on anything else, and a vague or generic one is the fastest route to denial. USCIS requires the letter to state the professional capacity in which you will work, the purpose of the engagement, the expected length of stay, and your educational qualifications.4U.S. Citizenship and Immigration Services. TN USMCA Professionals
For management consultants, go further than those basics. Identify the concrete business problem the company needs help solving, explain why outside expertise is necessary, describe the deliverables you will produce, and give a project end date. “Company X needs strategic advice” is not enough. “Company X is restructuring its supply chain after acquiring a competitor and needs an outside consultant to evaluate the merged logistics operations and deliver a transition plan by December 2027” gives the officer something to evaluate.
Along with the letter, bring:
- A valid Canadian or Mexican passport.
- Your diploma and transcripts, plus a NACES evaluation if the degree was earned outside North America.
- Experience letters from former employers or clients, if you are qualifying through the experience path. Each letter should specify your job title, dates of employment, and a detailed description of the consulting work you performed, together substantiating five years.
- A resume or CV that ties your qualifications to the engagement described in the employer letter.
Dates, job titles, and employer names have to match across every document. Discrepancies between your resume, experience letters, and employer support letter raise credibility concerns officers are trained to flag.
How Canadians Apply at the Border
Canadian citizens do not need a visa stamp. You present the complete application package directly to a U.S. Customs and Border Protection officer at a designated port of entry or pre-clearance facility.5U.S. Customs and Border Protection. Traveling on a TN or L1 Visa from Canada The officer reviews the documents, asks questions about the engagement, and decides on the spot. There is a $30 I-94 processing fee at land ports of entry.6U.S. Customs and Border Protection. I-94 – Payment Process
Be ready to explain the project in plain terms. Officers are not looking for rehearsed corporate language. They want to understand what organizational problem you are solving, what the deliverables are, and when the project ends. If you can’t articulate those three things clearly, the application is in trouble no matter how strong the paperwork is.
As an alternative route, your employer can file a Form I-129 petition with USCIS before you travel. If approved, you present the approval notice and proof of Canadian citizenship at the port of entry.4U.S. Citizenship and Immigration Services. TN USMCA Professionals
How Mexican Citizens Apply at a Consulate
Mexican citizens have to obtain a TN visa stamp before traveling. The process starts with Form DS-160, the online nonimmigrant visa application, and an interview scheduled at a U.S. Embassy or Consulate.7U.S. Embassy and Consulates. TN Visa The non-petition-based visa application fee is $185.8U.S. Department of State. Fees for Visa Services
Bring the full application package to the interview, including the employer letter, degree documents, any experience letters, and a printed DS-160 confirmation page. The consular officer evaluates the same substantive questions a CBP officer would: whether the role is genuinely advisory, whether you meet the qualifying requirements, and whether the engagement is temporary. Dates and details in the DS-160 need to match the employer letter and supporting documents.
How Long You Can Stay and How Often You Can Renew
Each TN admission can be granted for up to three years.3U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas There is no cap on renewals. USCIS policy is explicit that a Canadian or Mexican citizen may be granted TN status as many times as needed, as long as the person intends to remain in the United States temporarily.9U.S. Citizenship and Immigration Services. USCIS Policy Manual Volume 2 Part P Chapter 4 – Extension of Stay and Change of Status
Canadians can present a new application package at the border as the current status nears expiration. Both Canadian and Mexican citizens can also extend from inside the United States by having their employer file Form I-129.10U.S. Citizenship and Immigration Services. I-129, Petition for a Nonimmigrant Worker Premium processing is available if timing is tight.
The practical catch is that each renewal invites fresh scrutiny of your nonimmigrant intent. Year after year of renewals on the same engagement can look like permanent employment rather than temporary consulting, and officers tend to ask harder questions each time about when the project will end. TN status does not allow dual intent; every time you apply, you are representing that you intend to leave when the engagement ends.3U.S. Department of State Foreign Affairs Manual. 9 FAM 402.17 USMCA Professionals – TN and TD Visas Filing a green card petition while in TN status can create a presumption of immigrant intent that leads to a denial at the next renewal or re-entry.
Bringing Your Family
Your spouse and unmarried children under 21 can accompany you in TD (Trade Dependent) status. TD dependents may enroll in school but cannot work.4U.S. Citizenship and Immigration Services. TN USMCA Professionals A spouse who needs to work has to qualify for a work-eligible status on their own.
Taxes
TN professionals are subject to U.S. Social Security and Medicare taxes (FICA) from the first day of employment, whether or not they are resident aliens for income tax purposes.11Internal Revenue Service. Alien Liability for Social Security and Medicare Taxes of Foreign Teachers, Foreign Researchers and Other Foreign Professionals Your employer withholds those taxes the same way they would for a U.S. worker.
The United States has totalization agreements with both Canada and Mexico that can prevent double social security taxation. If your home country’s social security agency issues a certificate of coverage confirming you remain in its system, you may be exempt from U.S. FICA for a defined period. Without that certificate, the default rule applies and U.S. payroll taxes are withheld in full.
