A Tennessee sales tax exemption certificate lets qualifying buyers — nonprofits, government agencies, resellers, farmers, and manufacturers — purchase goods without paying the state’s 7% sales tax or the local tax of up to 2.75%. You apply through the Tennessee Taxpayer Access Point (TNTAP), receive a certificate with a unique exemption number, and present that number to vendors at the point of sale. There is no application fee, but using a certificate for a purchase that doesn’t qualify can cost you the unpaid tax, penalties, and interest, with a fraud penalty as high as 100% of the underpayment.
Who Qualifies
Tennessee recognizes five main groups of exempt purchasers, and the certificate you need depends on which one you fall into.
Nonprofit Organizations
Churches, schools, hospitals, orphanages, volunteer fire departments, and similar organizations listed in Tennessee Code 67-6-322 can buy tangible goods, software, and taxable services tax-free. Any organization holding a current IRS determination under Section 501(c)(3) also qualifies, provided it operates on a nonprofit basis and no earnings benefit private individuals.1Justia Law. Government Agencies
Federal, state, and local government entities use the Government Certificate of Exemption.3Tennessee Department of Revenue. Sales and Use Tax Forms Not every government purchase qualifies, though. Resellers
Businesses buying inventory for resale use the Streamlined Sales Tax Certificate of Exemption, which is honored across all 24 Streamlined Sales Tax member states.5Streamlined Sales Tax Governing Board. Farmers and Nursery Operators
Tennessee Code 67-6-207 exempts a broad range of agricultural inputs: tractors, grain bins, crop-dusting aircraft, poultry environment control systems, seeds and seedlings for food or fiber, and the fertilizers and pesticides used to grow them.8Justia Law. - Produced and sold at least $1,500 in agricultural products during the year, including government payments
- Own land assessed under the Agricultural Forest and Open Space Land Act of 1976 (Greenbelt)
- Operate a for-hire custom farm services business, such as plowing, planting, or harvesting
- File farm income on IRS Schedule F, Form 4835, or Schedule E

Manufacturers
Businesses whose principal activity is fabricating or processing tangible goods for resale pay no sales tax on industrial machinery under Tennessee Code 67-6-206. The exemption also covers water, gas, electricity, and other energy fuels consumed at qualifying locations. You must apply for a certificate of qualification for each manufacturing location and give the authorization number to your vendors.10Justia Law. How to Apply
Applications go through TNTAP. Agricultural, nonprofit, and green energy applications can be submitted without a TNTAP account; other exemption types require you to log in.11Tennessee Department of Revenue. Exemptions, Certificates and Credits No filing fee applies.
Have this ready for any application:
- Legal name matching your Secretary of State or federal filings
- Federal Employer Identification Number (FEIN)
- Both a physical location address and a mailing address
- Phone number and email for a designated contact person
Nonprofit applicants must attach federal exemption documentation, such as an IRS 501(c)(3) determination letter. A separate application is required for each physical location.2Tennessee Department of Revenue. Processing Time and What You Receive
Once the Department of Revenue has everything it needs, processing typically takes three to five business days.12Tennessee Department of Revenue. On approval, you receive a certificate with a unique exemption number to provide to vendors when making tax-free purchases.

Renewing Every Four Years
Nonprofit and agricultural exemption certificates are valid for four years. Every fourth year, the Department of Revenue reissues certificates to current holders, but only after the holder confirms continued eligibility. Renewed certificates are mailed before the current ones expire.14Tennessee Department of Revenue. If your renewal doesn’t arrive on time, call the Taxpayer Services Division at 615-253-0600 and choose option seven. Missed renewals often trace back to an outdated mailing address. If your location address changes, you’ll need to file a new application with supporting documentation before a new certificate will issue.14Tennessee Department of Revenue. Using the Certificate Correctly
Present your certificate to the vendor before or at the time of purchase. The vendor keeps a copy and forgoes charging you sales tax. Keep your own copy along with invoices for tax-free purchases so you can back up the exemption if the department later questions whether a purchase qualified.
One boundary trips up buyers and their vendors regularly. Contractors and subcontractors are treated as the end users of materials they purchase for construction projects, even when they’re working for a tax-exempt organization. A contractor building an addition to a hospital or a church still owes sales tax on the lumber, concrete, and other materials.16Tennessee Department of Revenue. Tennessee also does not accept out-of-state certificates for entity-based exemptions like nonprofit or government status. An out-of-state nonprofit either obtains a Tennessee certificate or presents its federal 501(c)(3) determination letter directly to the vendor.7Tennessee Department of Revenue. Other Exemptions
What Sellers Need to Do
If you’re on the seller side, you have to keep a copy of every exemption certificate you accept and confirm it hasn’t expired. Verifying the certificate through TNTAP does not replace keeping the physical copy on file.17Tennessee Department of Revenue. Sales and Use Tax Certificate Verification
To verify, log into TNTAP, click “View Exemptions Link” under Exemptions, select “Sales & Use Tax Certificate Lookup,” choose the certificate type, and enter the Location ID printed on the certificate. Tennessee Code 67-6-523 requires every dealer to keep invoices, exemption certificates, and other records of taxable transactions for three years.19Tennessee Department of Revenue. Sales and Use Tax Record-keeping Requirements If an audit later finds the certificate was invalid and you didn’t keep it on file, you can be liable for the uncollected tax. Penalties for Misusing a Certificate
Using an exemption certificate for a purchase that doesn’t qualify means you owe the unpaid tax plus penalties and interest. The standard penalty is 5% of the unpaid tax per month or partial month of delinquency, up to 25%. Interest runs at 11.50% annually through at least June 30, 2026.21Tennessee Department of Revenue. Fraud is a different tier. If the department determines the failure to report and pay tax was a deliberate attempt to evade, the penalty jumps to 100% of the underpayment. That fraud penalty replaces all other departmental penalties and cannot be waived by the Commissioner. If Your Application Is Denied or You Receive an Assessment
You can request an informal conference in writing within 30 days of the date on the notice of proposed assessment. The department contacts you within ten days to schedule it, either in person or via Microsoft Teams, and a hearing officer reviews your explanation.23Tennessee Department of Revenue.
