Transgender rights in Massachusetts are among the broadest in the country. State law prohibits discrimination based on gender identity in employment, housing, public accommodations, lending, and education, requires insurers to cover medically necessary gender-affirming care, and gives you administrative paths to change your name, birth certificate, and driver’s license. Federal documents are a separate story: a January 2025 executive order has restricted gender marker changes on passports and Social Security records, which makes the state-level protections even more important to understand and use.
Where Discrimination Is Illegal
Gender identity is a protected characteristic under M.G.L. c. 151B, § 4. An employer cannot refuse to hire you, fire you, or treat you differently in pay or working conditions because you are transgender. The same chapter bars labor organizations from excluding members on that basis and prohibits discriminatory job advertisements. Housing is covered by the same statute, so landlords and sellers cannot refuse to rent or sell to you because of your gender identity.1General Court of Massachusetts. Massachusetts General Laws Part I, Title XXI, Chapter 151B, Section 4
Public spaces were added to the list in 2016. The Transgender Anti-Discrimination Act amended Chapter 272 to require any business or facility open to the public to grant access consistent with a person’s gender identity. That reaches retail stores, restaurants, gyms, and government offices.2General Court of Massachusetts. Massachusetts Acts 2016 Chapter 134 – An Act Relative to Transgender Anti-Discrimination
Filing a Complaint With MCAD
The Massachusetts Commission Against Discrimination investigates complaints in employment, housing, public accommodations, education, credit, and lending, and it explicitly enforces gender identity as a protected class.3Mass.gov. MCAD Complaints of Discrimination If the commission finds discrimination likely occurred, it can prosecute and adjudicate the case.4Mass.gov. Guide to the MCAD Case Process
You have 300 days from the last discriminatory act to file. Miss that deadline and you can be permanently barred from pursuing the claim.5Mass.gov. Deadline for Filing a Complaint of Discrimination at the MCAD If you prevail, remedies can include back pay, front pay, emotional distress damages, out-of-pocket expenses, and attorney’s fees. Under M.G.L. c. 151B, § 9, the MCAD can also impose a civil penalty of up to $50,000 on an employer with a history of discriminatory practices.
Health Insurance and Gender-Affirming Care
Massachusetts insurers must cover medically necessary gender-affirming care. The Division of Insurance has made clear through Bulletin 2014-03 and Bulletin 2021-11 that denying medically necessary treatment because of gender identity or a gender dysphoria diagnosis is prohibited sex discrimination under state insurance law.6Mass.gov. Bulletin 2021-11 – Prohibited Discrimination on the Basis of Gender Identity or Gender Dysphoria Including Medically Necessary Gender Affirming Care and Related Services If a plan covers hormone therapy or a surgical procedure for a cisgender patient, it cannot deny the same treatment to a transgender patient based solely on the gender dysphoria diagnosis.
The rule applies to state-regulated private plans and to MassHealth. Blanket exclusions for all transition-related claims are not allowed. What counts as medically necessary is a decision between you and your provider.
When a claim is denied, start with the insurer’s internal appeal. If that fails, file a complaint directly with the Division of Insurance. Categorical denials of gender-affirming care are exactly what the DOI bulletins were written to prevent.
Changing Your Legal Name
Legal name changes go through the Probate and Family Court using the Petition for Change of Name of Adult, Form CJP 27, filed in the county where you live.7Mass.gov. Probate and Family Court Petition to Change Name of Adult You can file in person, by mail, or through e-filing.
The petition asks for your current name, your new name, a statement that the change is not for fraud or to avoid obligations, any prior name changes, and criminal history. Bring a certified copy of your birth certificate. The filing fee is $165, with a one-time $22 fee if you e-file, and a possible $15 citation fee once the court reviews your case.8Mass.gov. Probate and Family Court eFiling – Change of Name If you cannot afford the fees, file an Affidavit of Indigency to request a waiver.9Mass.gov. Indigency (Waiver of Court Fees)
Massachusetts normally requires newspaper publication of a name change. Transgender petitioners can file a motion to waive publication along with the petition, and courts grant these waivers routinely where safety or privacy is at stake.10Mass.gov. Checklist of Forms – Change of Name for Adult Waiver requests get closer scrutiny if you have a criminal record or are also changing your last name.
Approval produces a court decree, and the process typically runs two to six months depending on the court’s caseload. That decree is the document that unlocks every other update.
Updating Your Massachusetts Birth Certificate
Under M.G.L. c. 46, § 13, you can change the sex designation on your Massachusetts birth record to female, male, or X by submitting a sworn affidavit to the Registry of Vital Records and Statistics. No medical documentation, court order, or name change is required for a gender marker update by itself. The affidavit states that the change conforms to your gender identity and is not for any fraudulent purpose.11Mass.gov. Massachusetts General Laws c.46, Section 13
To change both the name and gender marker, submit your court-ordered name change decree with the affidavit. You can file by mail (notarize the affidavit if mailing) or in person by scheduling an appointment with the Registry at (617) 740-2600. The city or town clerk where your birth was recorded can also process amendments.12Mass.gov. Amend a Birth Certificate for Sex of the Subject
This process only applies if you were born in Massachusetts. If you were born in another state, you have to follow that state’s amendment rules, which vary widely.
Updating Your Driver’s License or State ID
The RMV lets you change the gender designation on your license or ID to M, F, or X. Complete a license or ID application, schedule an appointment at an RMV Service Center, and plan to have a new photo and signature taken. The amendment fee is $25, and you must surrender your existing card.13Massachusetts Registry of Motor Vehicles. Change Information on Your Driver’s License or ID Card
The RMV’s Gender Designation Change Form has historically required a medical or social service provider to verify that your gender identity can reasonably be expected to continue for the foreseeable future.14Commonwealth of Massachusetts. Gender Designation Change Form Call the RMV before your appointment to confirm which forms are currently required, since this process has been updated more than once. If you’re also changing your name, bring the court decree.
Federal Documents Under the 2025 Executive Order
Executive Order 14168, signed January 20, 2025, directed federal agencies to reflect biological sex at birth on government identification. The practical effects reach passports and Social Security records.
Passports
The State Department no longer issues passports with an X gender marker. Passports are issued only with an M or F marker that matches biological sex at birth. Passports already issued with an X marker or an updated gender marker remain valid until they expire.15U.S. Department of State. Sex Marker in Passports
Social Security
Your Social Security card does not display a gender marker, but the underlying SSA record carries a sex designation that can surface on credit reports, hospital records, federal student aid, and background checks. As of January 2026, the executive order has frozen gender marker changes on Social Security records.
Name changes with SSA are still available. Complete Form SS-5 and submit it to your local SSA office with original or certified copies of your court-ordered name change decree and proof of identity.16Social Security Administration. Application for Social Security Card (Form SS-5) Your Social Security number does not change. SSA notifies the IRS once the update is processed, and the new card usually arrives in about 10 to 14 business days.
Tax Returns
Once your SSA record is updated, make sure the name on your tax return matches your Social Security card exactly. If a W-2 was issued under your old name, ask for a corrected form or note the correction on your filed copies. A name mismatch with SSA records can delay your refund.17Internal Revenue Service.
