An unattended vehicle ticket in New York is issued under Vehicle and Traffic Law Section 1210 and carries a maximum fine of $150 for a first offense, plus a mandatory $30 surcharge. It’s a traffic infraction, not a moving violation, so it adds zero points to your license. You can fight it, and in many cases you should, because the officer has to prove you left the vehicle running or unlocked while unattended, and clerical errors on these tickets are common.
What VTL 1210 Requires Before You Walk Away
The statute is more specific than most drivers realize. Before leaving your car unattended, you must stop the engine, lock the ignition, remove the key, and set the parking brake. There’s one carve-out. You don’t have to remove the key if it’s hidden from sight inside the vehicle for convenience or emergency purposes. Even then, the engine still has to be off and the ignition locked.2New York State Senate. New York Code VAT 1210 – Unattended Motor Vehicle
The law doesn’t limit itself to public streets. It applies wherever you leave the vehicle unattended, including a private driveway or a parking lot.
Push-Button Start and Remote Starters
VTL 1210 was written for cars with physical ignition keys. It requires “removing the key from the vehicle,” which creates real ambiguity for push-button start vehicles and aftermarket remote starters. If you warm up your car remotely on a cold morning, the engine is running and the ignition is unlocked, which technically runs afoul of the statute. No amendment or published court interpretation has cleaned this up, so if you use remote start you’re carrying some enforcement risk.
The Full Cost of a First Offense
Under VTL 1800, a first conviction of a traffic infraction where no other penalty is specified is capped at $150. A second offense within 18 months raises the ceiling to $300, and a third within that same window can reach $450.3New York State Senate. The fine isn’t the whole bill. Every traffic infraction conviction adds a $25 mandatory surcharge and a $5 crime victim assistance fee. If Your Ticket Is Actually for Idling in NYC
Check what statute your ticket cites, because New York City enforces separate anti-idling rules that are heavier than VTL 1210. Under NYC Administrative Code Section 24-163, no vehicle may idle for more than three minutes while parked or stopped, and the limit drops to one minute near a school.5NYC311. Commercial diesel vehicles cited for idling face fines starting at $350 for a first offense and reaching $2,000 for repeat violations. Non-commercial vehicles can still face penalties in the hundreds under the city’s air code. The absence of an anti-idling sign is not a defense.
Where to Fight the Ticket
Where you contest depends on where you were cited. Outside New York City, VTL 1210 tickets are handled by the town or village justice court listed on the ticket itself. Whichever venue applies, respond by the date on the summons. If you plan to plead not guilty, request the hearing in writing before that date.
Defenses That Actually Work
Start with the paperwork. Read the ticket line by line. A wrong license plate number, wrong vehicle color, wrong location, or an incorrect date can each be grounds for dismissal, and these clerical mistakes happen more often than drivers expect.
Beyond errors on the face of the ticket, the strongest defenses come from evidence that the vehicle wasn’t actually unattended or wasn’t running. Dashcam footage, surveillance video from a nearby business, or a witness who saw you standing next to the car or heard the engine off can undercut the officer’s account. If you stepped a short distance from the car and kept it in sight, that’s a credible argument you weren’t leaving it unattended in any meaningful sense.
Outside New York City, many courts allow plea negotiation on traffic infractions. You can ask the prosecutor to reduce the charge or the fine, particularly on a first offense with an otherwise clean record. You aren’t required to hire an attorney for an infraction, but a local traffic lawyer will know which arguments land with which judges.
What It Does to Your License and Registration

The bigger risk is what happens if you ignore the ticket. If you fail to appear in court by the return date, the DMV can suspend your license, and the suspension stays until you resolve the case. Failure to appear is treated separately from failure to pay: a 2021 reform largely eliminated license suspensions for simply not paying a traffic fine, and drivers who can’t afford the full amount can enter a payment plan instead. Paying the Fine and Payment Plans
Outside New York City, pay through the court on your ticket, in person, by mail, or online where the court offers it. If the full amount is a problem, New York now allows monthly installment plans. Payments under these plans are capped at 2% of your monthly net income or $25 per month, whichever is greater. Whatever you decide, don’t sit on it. Late responses add penalties, and a failure-to-appear suspension is a far larger problem than the original fine. If you’re going to fight, request your hearing by the summons date. If you’re going to pay, do it before late fees attach.
