An uncontested divorce in Oregon is possible when you and your spouse agree on every issue in the dissolution — property, debts, support, and anything involving children — and submit that agreement to the circuit court with the required forms and a $301 filing fee.1Oregon State Legislature. Oregon Revised Statutes Chapter 21 – Court Fees and Charges Oregon is a no-fault state, so you only need to show that irreconcilable differences caused the marriage to break down; neither spouse has to prove wrongdoing.2Oregon Revised Statutes. Oregon Code 107.025 – Irreconcilable Differences as Grounds for Dissolution or Separation With full agreement in place, many couples never set foot in a courtroom.
Who Can File in Oregon
Residency depends on where you married. If you were married in Oregon, either spouse only needs to live in the state when the petition is filed; there is no minimum duration. If you married anywhere else, at least one spouse must have lived in Oregon continuously for six months before filing.3Oregon State Legislature. Oregon Code ORS 107.075 – Residence Requirements
That split catches people. Marry in Portland and move away, and the spouse still in Oregon can file right now. Marry in California and move to Oregon four months ago, and you wait until month six.
What You Have to Agree On
“Uncontested” means the agreement is complete before you file. One unresolved issue flips the case into a contested proceeding with hearings and possibly a trial.
Property and Debts
Oregon presumes both spouses contributed equally to anything acquired during the marriage, regardless of whose name is on the title. The presumption covers real estate, vehicles, bank accounts, retirement plans, and pensions.4Oregon State Legislature. Oregon Code ORS 107.105 – Provisions of Judgment You can agree to divide things differently, but the equal-contribution starting point frames the negotiation. Debts work the same way: credit cards, mortgages, car loans, and student debt all have to be assigned to one spouse or split.
Specificity matters. Vague language — “split the retirement accounts” without naming the plans or stating how — creates enforcement headaches later. Identify each asset and each debt.
Spousal Support
Oregon recognizes transitional, compensatory, and maintenance support, and your agreement should address whether any applies.4Oregon State Legislature. Oregon Code ORS 107.105 – Provisions of Judgment If neither spouse wants support, say so in writing. Silence invites a later motion.
Children
Minor children trigger extra documents and a closer look from the judge. Those requirements are covered below.
The Forms You File
Oregon publishes standardized forms through the Oregon Judicial Department and at circuit court clerks’ offices.5Oregon Judicial Department. Oregon Judicial Department – Divorce – Forms Every uncontested dissolution needs:
- A Petition for Dissolution of Marriage, with names and dates of birth for both spouses and any children, plus a statement of the relief requested.6Oregon State Legislature. Oregon Code 107.085 – Petition; Title; Content
- A Confidential Information Form from each spouse, holding Social Security numbers and other sensitive identifiers; these stay out of the public file.
- A Record of Dissolution for state statistical records.
- A proposed General Judgment of Dissolution incorporating every agreed term. This is what the judge signs to end the marriage.7Oregon Judicial Department. General Judgment of Dissolution of Marriage
Your written settlement agreement is the spine of that judgment. Write it so a stranger could execute the terms without asking you questions.
Co-Petitioners or Petitioner and Respondent
You can start the case two ways. Both spouses can sign the petition together as co-petitioners, which skips formal service and tends to move faster.6Oregon State Legislature. Oregon Code 107.085 – Petition; Title; Content Or one spouse files as the petitioner and the other is the respondent, who then has 30 days from service to file a response.8Oregon Judicial Department. Extra Requirements With Minor Children
Parenting Plan
Oregon law requires a parenting plan in every case involving parenting time.10Oregon Judicial Department. Parenting Plans At a minimum it must specify how much time the children spend with each parent. The Judicial Department publishes a standard template broken out by the child’s age,11Oregon Judicial Department. Standard Parenting Plan but you are free to write your own. The court cares that the plan is specific enough to enforce and that it serves the child’s best interests.
UCCJEA Affidavit
Each parent files an affidavit under the Uniform Child Custody Jurisdiction and Enforcement Act, listing where the children have lived for the past five years and disclosing any other custody proceedings.12Oregon State Legislature. Oregon Code ORS 109.767 – Information to Be Submitted to Court It confirms Oregon has authority over custody in your case.
Child Support
Oregon calculates child support on a formula that weighs each parent’s income, earning capacity, existing obligations, and parenting time.13Oregon State Legislature. Oregon Code ORS 25.275 – Formula for Determining Child Support Awards The Oregon Department of Justice posts an online calculator for estimates.14Oregon Department of Justice. Child Support Calculator Information Even when you both agree on a number, the judge checks it against the guideline. A material deviation needs a written explanation.
Parenting Education
Many Oregon counties require both parents to complete a court-approved parenting education class before the judge will sign the judgment.15Oregon Judicial Department. Parent Education The completion certificate has to be on file before entry.16Oregon State Legislature. Oregon Code ORS 3.425 – Family Law Education Programs Rules vary by county, so check with your circuit court early. Waiting until the end can push your judgment back by weeks.
Filing, Fees, and Service
File with the circuit court clerk in the county where either spouse lives. Oregon courts accept electronic filing through the OJD eFile system, available at any hour from anywhere.17Oregon Judicial Department. OJD eFile Most courthouses have eFile kiosks, and paper filing at the clerk’s window is still accepted.
The filing fee is $301.1Oregon State Legislature. Oregon Revised Statutes Chapter 21 – Court Fees and Charges If you cannot afford it, a judge can waive or defer all or part of the cost based on your finances.18Oregon Public Law. Oregon Code 21.682 – Authority to Waive or Defer Fees and Court Costs A waiver eliminates the fee; a deferral pushes it to a later date. Use the court’s fee deferral and waiver request forms.
Co-petitioners skip service. When one spouse files alone, the respondent has to be served, which Oregon allows through a private process server, the county sheriff, or any Oregon resident 18 or older who is not a party to the case.19Oregon Judicial Department. Guide to Serving Legal Papers in Family Law Cases After delivery, a Proof of Service is filed with the court. A cooperative respondent can skip the whole step by signing an Acceptance of Service.
How the Judgment Gets Signed
Oregon does not impose a mandatory waiting period. Your dissolution takes effect the moment a judge signs the judgment.20Oregon Judicial Department. Responding to a Petition for Dissolution In an uncontested case the judge reviews your proposed General Judgment and, if it is complete, signs it without a hearing. The clerk enters the judgment and issues a notice of entry. That entry date is the official end of the marriage.
Timing turns on your paperwork, whether service is needed, and the court’s processing load. Co-petitioners with complete packets sometimes have a signed judgment in a few weeks. Cases requiring service add at least the 30-day response window on top.
Tax Points to Build Into Your Agreement
Property transfers between spouses incident to divorce are not taxable events under federal law. No gain or loss is recognized, and the receiving spouse takes the original tax basis, so capital gains will come due only when that spouse later sells.21Office of the Law Revision Counsel. 26 USC 1041 – Transfers of Property Between Spouses or Incident to Divorce The transfer must happen within one year of the divorce or be related to the end of the marriage.
For divorces finalized after December 31, 2018, spousal support is neither deductible by the payer nor taxable to the recipient.22Office of the Law Revision Counsel. 26 USC 215 – Repealed Price any support figure accordingly.
Only one parent claims a given child in a given tax year. The IRS defaults to the parent the child spent the greater number of nights with. To let the other parent claim the child, the custodial parent signs IRS Form 8332 releasing the claim for that year.23Internal Revenue Service. Form 8332 – Release/Revocation of Release of Claim to Exemption for Child by Custodial Parent A divorce judgment alone does not transfer the credit; the signed form attached to the return is what makes it work.
Your marital status on December 31 sets your filing status for the full year. Finalized by that date and you file single, or head of household if you have a qualifying dependent. Not final and you remain married for tax purposes.24Internal Revenue Service. Tax Considerations for People Who Are Separating or Divorcing
What to Do After the Judgment Is Signed
The signed judgment ends the marriage. It does not update the rest of your life.
If the settlement divides a 401(k) or private-sector pension, you need a Qualified Domestic Relations Order to split it. The QDRO is a separate document drafted to the plan’s rules and approved by both the plan administrator and a judge. It commonly takes three to six months, and each plan needs its own order. Start right after the judgment is signed; waiting creates real risk if the account holder retires, begins drawing benefits, or dies before the order is in place. Oregon PERS runs its own process under state law and does not require a QDRO if the judgment itself contains enough detail about how benefits are divided.25Oregon PERS. If you want a former name restored, ask for it in the petition or the judgment and the court will include a name-change provision. Take a certified copy to the Social Security Administration and the DMV. If you did not request it during the divorce, file a separate name-change petition with your circuit court later.
Transfer vehicle titles within 30 days to avoid DMV late fees.27Oregon Driver and Motor Vehicle Services. Titling and Registering Your Vehicle Record real estate transfers with the county recorder using a new deed. Update beneficiary designations on life insurance, retirement accounts, and bank accounts. Beneficiary designations often override what the judgment says, so a forgotten form can send assets to an ex-spouse years later. This is the step most people skip, and by the time anyone notices, it is usually too late to fix.
