Utah 1099 Form: Deadlines, TAP Filing, and Penalties

The 1099 filing requirements in Utah are narrower than most businesses expect: you only have to send a 1099 to the Utah State Tax Commission (USTC) when you withheld Utah income tax from the payment. If no Utah tax came out, there is generally no state filing to make, even though you still file the form federally. One new exception takes effect in 2026 for payment platforms issuing Form 1099-K. Everything that does get filed goes electronically through the Taxpayer Access Point (TAP), and the deadline is January 31.1Utah State Tax Commission. Pub 14

When Utah Actually Requires a 1099

The trigger is withholding. Any 1099-series form that reports Utah income tax withheld must be submitted to the USTC. If you issued a 1099 with nothing in the state withholding box, Utah does not want a copy.2Utah State Tax Commission. Employer Withholding

The forms this most commonly affects are:

  • Form 1099-NEC, for nonemployee compensation
  • Form 1099-MISC, for rents, royalties, and other miscellaneous payments
  • Form 1099-R, for retirement and pension distributions

Utah does not set separate dollar thresholds. Your state obligation follows whatever federal threshold applies to the form. For tax year 2026, the federal threshold for Form 1099-NEC rose from $600 to $2,000 in nonemployee compensation, so a $1,500 contractor payment produces no 1099 at all, state or federal, even if some Utah tax was withheld.3Internal Revenue Service. Form 1099 NEC and Independent Contractors The IRS will index this threshold for inflation starting in 2027.4Internal Revenue Service. 2026 Publication 1099 – General Instructions for Certain Information Returns

The New 1099-K Rule for Payment Platforms

Utah House Bill 60 created a reporting duty that sits outside the withholding trigger. Starting with tax year 2026, payment settlement entities (PayPal, Venmo, Stripe, credit card processors, and similar companies) must file Form 1099-K with the USTC whenever the payment exceeds the federal 1099-K threshold and the payee has a Utah address. This one applies even when no Utah tax was withheld. The federal 1099-K threshold for 2026 is $20,000 in gross payments and more than 200 transactions.4Internal Revenue Service. 2026 Publication 1099 – General Instructions for Certain Information Returns

If you are a small business that receives payments through a third-party platform, this duty sits with the platform, not with you. The first filings under the new rule will be due in early 2027 for 2026 activity.

The January 31 Deadline

Utah 1099s with state withholding are due to the USTC by January 31 of the year after the tax year. That matches the federal deadline for furnishing recipient copies. When January 31 lands on a weekend or legal holiday, the deadline moves to the next business day.5Utah Legislature. Utah Code 59-10-406 – Withholding of Tax

You also owe Form TC-941E, the annual withholding reconciliation. It summarizes the Utah income tax you withheld and remitted during the year, and it is filed electronically through TAP as part of your fourth-quarter withholding return. The W-2s and 1099s are uploaded separately through the same system.2Utah State Tax Commission. Employer Withholding

File the TC-941E every year you hold an active Utah withholding account, even a year in which you had no employees and withheld nothing. Skipping a zero-balance year is a common way to pick up an unnecessary penalty notice.

A federal extension does not extend your Utah deadline. If you file Form 8809 with the IRS for a 30-day federal extension, you still need to contact the USTC directly for additional time on the state side.6Internal Revenue Service. How to File With Utah

Utah does not participate in the IRS Combined Federal/State Filing Program. Filing with the IRS does nothing for your Utah obligation. You submit separately and directly to the USTC.7Utah State Tax Commission. Electronic Filing and Annual Reconciliation

Paper filing is not allowed. Every W-2 and 1099 must be filed electronically regardless of volume, and Utah assesses a specific penalty for failure to file electronically.7Utah State Tax Commission. Electronic Filing and Annual Reconciliation

Submitting Through TAP

All uploads go through TAP at tap.utah.gov. You will need a Utah Withholding Tax Account Number, which you obtain by filing Form TC-69 through TAP. Payroll services and third-party preparers filing on behalf of Utah clients must register separately as a payroll service or third-party preparer in TAP.8Utah State Tax Commission. TAP FAQ – Withholding

There are two upload formats. For smaller volumes, use the official Utah 1099 Excel template, saved as an .xls file. The template has strict rules: do not alter cell formats, do not leave blank rows, and use Paste Special (Values) when copying data in.9Utah State Tax Commission. Penalties for Late or Missing 1099s

Utah’s penalty for late 1099s and W-2s is per form and scales with how late you are. The first 14 days past January 31 carry no per-form penalty. After that:10Utah Legislature. Utah Code 59-1-401 – Offenses and Penalties

  • 15 to 30 days late: $30 per form, capped at $75,000 per calendar year
  • 31 days late through June 1: $60 per form, capped at $200,000 per calendar year
  • After June 1, or never filed: $100 per form, capped at $500,000 per calendar year

A separate penalty of $50 per information return, up to $1,000, applies to failing to file an information return or a complete supporting schedule.10Utah Legislature. Utah Code 59-1-401 – Offenses and Penalties

Late Payment of the Associated Tax

If you file the TC-941E on time but pay the withholding tax late, a separate late-payment penalty applies:10Utah Legislature. Utah Code 59-1-401 – Offenses and Penalties

  • 1 to 5 days late: the greater of $20 or 2% of the unpaid tax
  • 6 to 15 days late: the greater of $20 or 5% of the unpaid tax
  • More than 15 days late: the greater of $20 or 10% of the unpaid tax

If the underpayment resulted from negligence, Utah adds a 10% penalty on the underpaid portion. If the USTC finds you intentionally disregarded the law, it rises to 15% of the entire underpayment.10Utah Legislature. Utah Code 59-1-401 – Offenses and Penalties

Federal Penalties Apply On Top

Utah penalties do not substitute for federal ones. For 2026, the IRS assesses its own per-form penalties:11Internal Revenue Service. Information Return Penalties

  • Up to 30 days late: $60 per form
  • 31 days late through August 1: $130 per form
  • After August 1, or never filed: $340 per form
  • Intentional disregard: $680 per form with no annual cap

A business with 50 late forms can accumulate several thousand dollars in combined state and federal penalties before interest is calculated. That math is the reason January 31 is worth treating as a fixed deadline.

Fixing a 1099 After You Filed It

If you find a wrong dollar amount, a bad TIN, or an incorrect recipient name on a 1099 you already filed, submit a corrected return as soon as possible. The IRS does not set a hard deadline for corrections, but penalties grow over time, and corrections filed before August 1 face materially lower federal penalties than later ones.11Internal Revenue Service. Information Return Penalties

For Utah, submit the corrected 1099 through TAP using the same upload process as the original. The corrected form must include all the original information along with the corrected fields, and you need to give the recipient an updated copy.
