If you ship into Utah from out of state, you have to collect and remit Utah sales tax once your gross revenue from sales delivered to Utah addresses exceeds $100,000 in either the current or previous calendar year. That’s the entire test for an individual remote seller. Utah dropped its old 200-transaction trigger effective July 1, 2025, so the dollar figure is now the only thing that matters.1Utah State Tax Commission. Out-of-State (Remote) Sellers
What Counts Toward the $100,000
The threshold in Utah Code 59-12-107 is based on gross revenue, not taxable revenue.2Utah Legislature. Utah Code 59-12-107 – Definitions — Collection, Remittance, and Payment of Tax by Sellers or Other Persons Every sale delivered into Utah counts, including exempt items, wholesale transactions, and shipping charges. You can cross the line and owe a registration even if most of what you sell into the state isn’t actually taxable. Wholesalers are the group this surprises most often.
The statute looks at both the current and the previous calendar year. If you hit $100,000 in 2025, you’re on the hook for 2026 regardless of how 2026 shapes up. Once you cross, start collecting.
Selling Through Amazon, Etsy, or Walmart
When you sell through a marketplace, the platform collects and remits Utah sales tax on those orders. Utah law treats the facilitator as the seller for those transactions, which means it files the returns and faces the audit, not you.3Utah State Tax Commission. Marketplace Facilitators and Sellers
Two things trip sellers up here. First, the facilitator’s protection only covers sales made through its platform. Direct sales from your own website, trade shows, or wholesale orders are yours to track, and if those non-marketplace sales alone exceed $100,000 in Utah, you have to register and collect on them yourself.4Utah Legislature. Utah Code 59-12-107.6 – Marketplace Facilitator Tax Collection and Remittance Second, you can’t collect tax on a transaction a marketplace is already handling. Double collection isn’t allowed.
Note that facilitators themselves have a broader nexus trigger than individual sellers: $100,000 in combined sales or 200 separate transactions. The 200-transaction threshold still applies to them.4Utah Legislature. Utah Code 59-12-107.6 – Marketplace Facilitator Tax Collection and Remittance
What Utah Taxes
Utah sales tax applies to tangible personal property, digitally transferred products, and certain services. Downloaded music, e-books, movies, ring tones, and software are taxable if the physical version would be taxable.5Utah State Tax Commission. Pub 25 – Sales and Use Tax General Information Prewritten software counts as tangible personal property under Utah law whether it arrives on a disc or by download.
Common exemptions include prescription drugs, certain medical equipment, and items bought for resale in the regular course of business. The resale exemption also covers digital products licensed or purchased for resale.5Utah State Tax Commission. Pub 25 – Sales and Use Tax General Information All of these sales still count toward your $100,000 nexus total even though no tax gets charged at checkout.
Registering for a Utah Sales Tax License
Register through the Taxpayer Access Point at tap.utah.gov. You’ll need your federal employer identification number, legal business name, the date you crossed the nexus threshold, and contact information for owners and officers.6Utah State Tax Commission. Create and Manage a Tax Account There’s no fee for the license, and approval typically comes back by email within a few business days with your account number.
Utah is a full member of the Streamlined Sales and Use Tax Agreement, so you have a second option: register through the SST system at streamlinedsalestax.org.7Streamlined Sales Tax Governing Board. Streamlined Sales Tax That route is useful if you need to register in several member states at once, and remote sellers who register through SST may qualify for free sales tax calculation and reporting software.
Charging the Right Rate
Utah uses destination-based sourcing. You charge the rate for the location where the customer receives the product, not where your business sits.8Utah Legislature. Utah Code 59-12-211 – Definitions — Location of Certain Transactions The state base rate is 4.85%, but local jurisdictions add their own portions, so combined rates run from roughly 6.35% to over 9% depending on the delivery address.
The Tax Commission publishes rate tables by jurisdiction, and the rates change quarterly.9Utah State Tax Commission. Sales and Use Tax Rates Check them at the start of each quarter. Charging last quarter’s rate still counts as under-collection, and you’ll owe the difference.
Digital products follow the same destination rule. Charge the rate for the buyer’s delivery location, not your server location or the billing address. When the delivery location can’t be determined, Utah Code 59-12-211 gives fallback rules based on the buyer’s address on file.
Filing Frequency and Due Dates
The Tax Commission assigns your filing frequency based on annual Utah sales tax liability:10Utah State Tax Commission. Sales and Use Tax
- $50,000 or less: quarterly, with returns due April 30, July 31, October 31, and January 31
- $50,001 to $96,000: monthly
- $96,001 or more: monthly, with mandatory electronic funds transfer payments
Returns are due by the last day of the month following the filing period. July collections, for example, are due by August 31.11Utah State Tax Commission. Monthly Filing and Payment If a due date lands on a weekend or legal holiday, it moves to the next business day. All returns must be filed electronically through TAP.10Utah State Tax Commission. Sales and Use Tax
Each return reports total gross sales and tax collected; TAP calculates the balance due and accepts ACH debit or electronic funds transfer. Monthly filers who file and pay on time qualify for a 1.31% seller discount on certain sales and use taxes.11Utah State Tax Commission. Monthly Filing and Payment
Penalties for Late Filing or Payment
Utah’s penalty tiers escalate with how late you are:12Utah State Tax Commission. Pub 58 – Utah Interest and Penalties
- 1 to 5 days late: the greater of $20 or 2% of unpaid tax
- 6 to 15 days late: the greater of $20 or 5% of unpaid tax
- 16 or more days late: the greater of $20 or 10% of unpaid tax
The same tiers cover both late filing and late payment, and interest accrues on top. Not filing at all is the worst outcome: the penalty jumps straight to the greater of $20 or 10% with no benefit from the lower tiers.12Utah State Tax Commission. Pub 58 – Utah Interest and Penalties
Records to Keep
Utah requires sales tax records for at least three years.13Utah State Tax Commission. Sales and Use Tax FAQ Keep transaction logs, invoices, exemption certificates from wholesale or resale buyers, and documentation separating taxable from exempt sales. If your point-of-sale system overwrites data on a cycle, export it before it’s gone.
Exemption certificates cause more audit problems than anything else. When a buyer claims resale or another exemption, you need a properly completed certificate on file. If it’s missing or incomplete, the Tax Commission can reclassify the sale as taxable and assess tax and penalties on top. Track expiration dates and request renewals before certificates lapse. If the Commission suspects significant underpayment, the review window can extend past three years.
If You Already Owe Back Taxes
If you’ve been selling into Utah past the threshold without collecting, the Voluntary Disclosure Program is the way to limit the damage. It generally waives all penalties and caps the look-back at three years, though you’ll still owe interest on the unpaid tax.14Utah.gov. Utah State Tax Commission Voluntary Disclosure Program
To qualify, the Tax Commission cannot have already contacted you about the liability. You can approach the program anonymously through a representative to size up your options before identifying yourself. For sellers with limited Utah presence, the Commission sometimes agrees to a shorter look-back or even purely prospective compliance.
One boundary matters. If you actually collected sales tax from Utah customers and didn’t remit it, the look-back extends as far back as needed to recover those funds.14Utah.gov. Utah State Tax Commission Voluntary Disclosure Program Not knowing you had an obligation is treated very differently from holding tax you already collected.
