Utah Sales Tax Exemption: Who Qualifies and How to Claim It

A Utah sales tax exemption removes state and local sales tax from a purchase either because of who is buying (a government entity, a qualifying nonprofit) or because of what the purchase is for (resale inventory, manufacturing equipment, farm use, prescription medicine, and a handful of other categories listed in Utah Code 59-12-104).1Utah Legislature. Utah Code 59-12-104 – Exemptions For most exemptions, you claim it by handing the seller a completed Form TC-721 at the register. The seller keeps the certificate on file and does not charge tax. Get the form or the qualification wrong and the tax, plus penalties, can land on either of you.

Who Qualifies Based on the Buyer

Sales to the State of Utah, its institutions, and its political subdivisions are exempt when the purchase is made directly by the government entity using public funds. A county buying office furniture pays no sales tax; a state university buying lab equipment pays no sales tax. Construction materials are the main exception and generally remain taxable unless installed by the entity’s own employees or bought for a public school.1Utah Legislature. Religious and charitable organizations recognized under Internal Revenue Code Section 501(c)(3) or 501(c)(19) qualify for both sales-to and sales-by exemptions. Their purchases are exempt when the items support the group’s regular charitable or religious functions, and sales they conduct as part of those functions are likewise exempt.2Utah Legislature. Utah Code 59-12-104.1 – Exemptions for Religious or Charitable Institutions Unrelated business activities are not covered. A church thrift shop selling donated clothing as part of its charitable mission qualifies; a nonprofit running a commercial venture outside its stated purpose does not.

A nonprofit cannot just show up and claim the exemption. It needs a sales tax exemption number from the Utah State Tax Commission first. That means filing Form TC-160, which asks for the organization’s IRS determination letter and a description of its purpose and funding sources.3Utah State Tax Commission. Once approved, the organization gives its exemption number to sellers at the point of purchase.

Who Qualifies Based on the Purchase

Several exemptions turn on how the item will be used rather than who is buying it.

Resale

Inventory you buy to resell is not taxed, because the final customer will pay sales tax on the finished product. You check the resale box on Form TC-721 and give the seller your Utah sales tax license number.4Utah State Tax Commission. Utah Sales Tax Exemption Certificate If you later pull something out of that inventory for your own use, you owe use tax on it and report it on your next return.

Manufacturing

Utah manufacturers can buy machinery, equipment, repair parts, and materials tax-free when the items are used in the manufacturing process to produce tangible goods for sale.1Utah Legislature. Utah Code 59-12-104 – Exemptions Office equipment and office supplies do not qualify. The exemption covers the production line, not the front office.

Agriculture

Tangible property used primarily and directly in farming is exempt, including tractors, irrigation systems, and items that become part of the land. Hay is specifically exempt, and producers selling their own seasonal crops, seedling plants, and garden produce during harvest season do not charge sales tax on those sales.1Utah Legislature. Utah Code 59-12-104 – Exemptions The exemption does not reach hand tools, janitorial supplies, or equipment used for distribution, research, or transportation. Vehicles that must be registered under state law are also excluded for two years after purchase.

Medical Purchases

Prescription drugs, syringes, and stoma supplies for human use are exempt when issued under a prescription or bought by a hospital or medical facility. Prosthetic devices worn on or in the body qualify under the same conditions.1Utah Legislature. Utah Code 59-12-104 – Exemptions Durable medical equipment is exempt when prescribed and used exclusively for home use. Mobility enhancing equipment such as wheelchairs is exempt when a prescription is presented. Disposable home medical supplies are exempt when prescribed, used exclusively by the patient, and listed as eligible under Medicare or Medicaid. Hospitals and medical facilities do not need individual prescriptions for each purchase; the institutional purchase itself satisfies the requirement.

Pollution Control Equipment

Equipment installed primarily to prevent, control, or reduce water pollution can qualify for an exemption, but only after the Utah Department of Environmental Quality certifies the facility.5Utah Department of Environmental Quality. Two Areas Where People Assume an Exemption and Get It Wrong

Grocery food is not fully exempt in Utah. Food and food ingredients bought at a grocery store are taxed at a reduced combined rate of 3% rather than the full combined rate that applies to other taxable goods.6Utah State Tax Commission. Construction materials are the second trap. A contractor who buys lumber, nails, insulation, or paint and converts them into real property owes sales tax on those materials at the time of purchase, because the contractor is treated as the end consumer, not a reseller.7Utah State Tax Commission. Construction Industry Sales and Use Tax Accounting Methods, Sourcing Rules and Sales and Use Tax Exemptions The contractor cannot collect that tax from the customer on a furnish-and-install contract or show it as a line item labeled “Tax” on the invoice. Items that remain tangible personal property after installation, like appliances, furniture, and trade fixtures, follow the opposite rule: the contractor charges the property owner sales tax on those. Government contract work can escape tax on materials only when the contract formally designates the contractor as the government entity’s purchasing agent by resolution, the contractor identifies itself as such, and purchases are made on purchase orders naming the government entity. Federal projects require materials to be bought directly with federal funds through a government check, purchase order, or credit card.

How to Claim an Exemption at the Register

The workhorse document is Form TC-721, the Utah Sales Tax Exemption Certificate. You fill it in, sign it, and give it to the seller. It is not filed with the state; the seller keeps it on file in case of an audit.4Utah State Tax Commission. Utah Sales Tax Exemption Certificate

The buyer enters name, address, and sales tax license number where applicable, then checks the box for the specific exemption claimed. The form covers resale, agricultural use, government purchases, industrial use, and other categories. Your signature certifies the information is accurate, and if your exemption status changes later, you have to tell the seller.

One TC-721 can serve as a blanket certificate covering ongoing purchases from the same seller, which is practical for businesses that buy regularly from the same suppliers. It has no printed expiration date, but update it whenever your exemption status or license number changes.

Direct Payment Permits for High-Volume Buyers

A business that buys heavily in taxable goods can apply for a Direct Payment Permit, which lets it buy without paying tax to the seller and instead determine taxability and remit tax directly to the Tax Commission on a monthly return. To qualify, the business needs a Utah sales tax license, at least $1,500,000 in purchases in each of the previous three years, and a clean payment history.9Utah State Tax Commission. Applications go on Form TC-62DPA and are processed within 15 days. The permit excludes prepared food, lodging, admission fees, motor vehicles, aircraft, watercraft, and several utility and telecommunications tax categories. The Tax Commission can revoke it at any time for noncompliance.

If You Buy From Utah Vendors Across State Lines

Utah participates in the Streamlined Sales and Use Tax Agreement, so a business operating in multiple member states can use a single SST Exemption Certificate rather than a different form for each state.10Utah State Tax Commission. What Goes Wrong and Who Pays

Sellers carry the risk. If the Tax Commission audits a business and the seller cannot produce a valid exemption certificate for a tax-free sale, the seller owes the uncollected tax plus penalties and interest. Sellers should keep completed certificates on file for at least three years from the date the associated tax return was due, matching the refund claim window.11Utah State Tax Commission. Sales and Use Tax Refund Requests A seller who accepts a certificate that looks complete on its face can act on it in good faith; a seller who accepts an obviously incomplete or suspicious certificate may not get that benefit in audit.

Buyers who file a false certificate face both civil and criminal consequences. Under Utah Code 59-1-401, underpayment due to negligence triggers a 10% penalty on the underpaid amount. Intentional disregard of the law raises the penalty to 15% of the entire underpayment. Intent to evade tax carries the greater of $500 per period or 50% of the full underpayment, and fraud pushes it to 100%.12Utah Legislature. Getting a Refund If You Already Paid Tax

If you paid sales tax on a purchase that should have been exempt, you can file a refund claim with the Tax Commission. The deadline is the later of three years from the due date of the seller’s return or two years from the date the tax was actually paid.11Utah State Tax Commission. Refunds go through the Taxpayer Access Point. You need documentation showing the tax was paid and evidence that the transaction qualified for an exemption. Presenting your exemption certificate at the time of purchase is easier than chasing a refund afterward.
