Utah Sales Tax Exemption: Who Qualifies, Certificates, and Refunds

A Utah sales tax exemption removes or reduces the state’s 4.85% sales tax (and the local add-ons that push combined rates as high as 9.35%) on specific purchases made by qualifying buyers or involving qualifying products.1Utah State Tax Commission. Sales and Use Tax Rates Effective January 1, 2026 The exemptions are set out in Utah Code 59-12-104, and claiming one almost always means handing the seller a completed exemption certificate before the sale closes.2Utah Legislature. Buyers Who Qualify

Government Agencies

Federal, state, and local government agencies can buy most tangible goods without paying Utah sales tax, on the principle that one level of government shouldn’t be taxing another.2Utah Legislature. Utah Code 59-12-104 – Exemptions Native American tribal governments qualify on the same footing and use the same certificate.

Construction materials are the sharp exception. State and local agencies get the exemption on construction materials only when the agency pays the seller directly and the materials are installed by government employees. A contractor buying materials for a government project doesn’t automatically inherit the exemption unless the project falls into a specific category such as a public school or public transit district.3Utah State Tax Commission. Publication 42 – Sales Tax Information for Construction Industries Federal agencies face fewer restrictions; their construction material purchases are exempt as long as the agency pays the seller directly.

Religious and Charitable Organizations

Sales to or by religious and charitable organizations are exempt when the transaction relates to the organization’s regular functions and activities.4Utah Legislature. Utah Code 59-12-104.1 – Exemptions for Religious or Charitable Institutions A church buying folding chairs for weekly services qualifies. The same church buying equipment for a side business that generates unrelated income probably doesn’t. The purchase has to connect to what makes the organization religious or charitable in the first place.

Contractors working for these organizations can also buy materials tax-free using Form TC-721, as long as the materials are clearly identified and installed into property owned by the organization.3Utah State Tax Commission. Publication 42 – Sales Tax Information for Construction Industries

Resellers

Products bought for resale in the regular course of business are exempt, whether the item is resold in its original form or used as an ingredient in something the buyer manufactures.2Utah Legislature. Utah Code 59-12-104 – Exemptions This keeps the tax from stacking at every step of the supply chain; it hits once, at the final retail sale. Resellers claim the exemption by giving the vendor a completed Form TC-721 with their Utah sales tax license number.

Airlines and Common Carriers

Commercial airlines get a targeted exemption for food and beverages served in flight and for tangible goods sold to passengers during flights. Parts and equipment installed in aircraft operated by common carriers in interstate or foreign commerce are also exempt.2Utah Legislature. Utah Code 59-12-104 – Exemptions

Products and Business Inputs That Qualify

Manufacturing Machinery and Equipment

Manufacturers located in Utah can buy machinery, equipment, repair and replacement parts, and raw materials tax-free when those items are used in the manufacturing process to produce tangible goods for sale.2Utah Legislature. Utah Code 59-12-104 – Exemptions Scrap recycling operations that process items into tangible products fall under the same provision. Office equipment and office supplies are specifically excluded, so a production-line conveyor is exempt but the copier at the front desk is not.

Agricultural Inputs

Tangible goods used primarily and directly in farming operations are exempt, including items that become part of real estate and items installed by contractors.2Utah Legislature. Utah Code 59-12-104 – Exemptions Hay sold for livestock feed is separately exempt, as are seasonal crops, seedling plants, and garden produce sold by the producer during harvest season.

The farming exemption has some hard edges. Hand tools, janitorial supplies, and office equipment don’t qualify. Neither do items used in activities that merely support farming, such as distribution, research, or transportation of farm products. Vehicles registered under Utah law are exempt for only two years after purchase, even if they’re used exclusively on the farm.

Prescription Drugs and Medical Equipment

Drugs prescribed for human use are exempt, whether the buyer presents a prescription or a hospital purchases in bulk. Durable medical equipment, mobility-enhancing equipment, and disposable home medical supplies qualify with a prescription. Prosthetic devices used in or on a human body are exempt with a prescription or when purchased by a medical facility.5Utah State Tax Commission. Software: Custom Only

Utah taxes prewritten software broadly. Sales, rentals, leases, and use charges are taxable regardless of delivery method, so boxed software, downloads, hosted software, and cloud-based SaaS all carry sales tax when accessed and used in Utah.6Utah State Tax Commission. Publication 64 – Sales Tax Information for Computer and Software Industry Custom software written specifically for a single business is the exception; those license fees are not taxable.

Grocery Food Is Reduced, Not Exempt

Utah does not fully exempt grocery food. It taxes it at a reduced statewide rate of 3% instead of the standard combined rate.7Utah State Tax Commission. Grocery Food Sales and Use Tax Grocery food covers substances sold for human consumption, including unheated bakery items like bread, cookies, and tortillas. Alcoholic beverages, tobacco, and prepared food (sold with eating utensils or heated by the seller) don’t qualify for the reduced rate. Packaging alone doesn’t count as an eating utensil, so a salad in a plastic clamshell isn’t bumped to the full rate simply because of the container.

How to Claim the Exemption

Claiming the exemption means giving the seller the right certificate before or at the time of purchase. Utah uses two:

  • Form TC-721 for religious and charitable organizations, resellers, manufacturers, agricultural producers, and most other private-sector exempt buyers.8Utah State Tax Commission. TC-721 – Utah Sales Tax Exemption Certificate
  • Form TC-721G for federal, state, and local government agencies, Native American tribes, and public elementary and secondary schools.9Utah State Tax Commission. TC-721G – Exemption Certificate

Both forms require the legal name and address of the purchasing entity. If you’re registered for Utah sales tax, you provide your sales tax license number; government agencies and out-of-state buyers who aren’t registered provide other identifying information. You then check the box for the specific legal basis being claimed, such as resale, religious or charitable use, or manufacturing equipment. The category matters because the seller relies on that selection to justify not collecting tax.

Neither form gets mailed to the Tax Commission. The buyer gives the completed certificate directly to the seller, and both parties keep copies. For in-person purchases, hand over a physical copy so the seller can zero out the tax line on the receipt. For online orders, many larger retailers let you upload a certificate to a business account so future orders automatically exclude tax. If a seller refuses to accept a valid certificate and charges tax anyway, ask for a credit or refund, and if that fails, request a refund directly from the Tax Commission.10Utah State Tax Commission. Multi-State Buyers and the Streamlined Certificate

Utah has been a full member of the Streamlined Sales and Use Tax Agreement since October 2012.11Streamlined Sales Tax Governing Board. Utah – Streamlined Sales Tax Businesses operating in multiple states can use the Streamlined Sales Tax Exemption Certificate in place of separate state forms; all 24 member states accept it.12Streamlined Sales Tax Governing Board. Exemptions You don’t have to register through the Streamlined Sales Tax Registration System to use it. For resale purchases, provide your Utah sales tax ID or any other state’s ID if you’re not registered where you’re claiming the exemption. Check each state’s taxability matrix before assuming a Utah exemption type works elsewhere, and give the completed certificate to your supplier, not to any government agency.

Refunds When Tax Was Paid in Error

If you paid sales tax on a purchase that should have been exempt, start with the seller and ask for a credit or refund. When the seller is out of business or won’t cooperate, go directly to the Tax Commission using Form TC-62PR (Application for Refund of Utah Sales and Use Tax).10Utah State Tax Commission. The deadline is the later of three years from the due date of the seller’s return or two years from the date the tax was paid to the Tax Commission. Along with the TC-62PR, submit proof that tax was charged (invoices or receipts), proof of payment (canceled checks or bank statements), and documentation showing that you or the items qualify. Requests involving more than 12 purchases must include electronic copies of the supporting documents on a USB drive, CD, or via email.

Records, Seller Good Faith, and Penalties

Both buyers and sellers should keep every exemption certificate along with the corresponding invoices for three years, matching the general audit period.13Utah State Tax Commission. Sales and Use Tax FAQ During an audit, the certificate is the primary evidence justifying why tax wasn’t collected. If you can’t produce it, the Tax Commission can assess the unpaid tax plus interest. Digital copies are fine; organize them by vendor or date so you can pull the right one quickly.

Sellers who accept a certificate in good faith aren’t required to collect the tax and can report the sale as exempt. Good faith means the seller had no actual knowledge the certificate was false, and the seller isn’t obligated to investigate the buyer’s operations or verify the license number. If the Tax Commission later decides the buyer wasn’t entitled to the exemption, the liability falls on the buyer, not the seller, as long as the certificate was accepted without knowledge of a problem.

Using a certificate to avoid tax on purchases that don’t qualify exposes the buyer to the tax originally owed plus interest at 6% annually, calculated daily from the date the tax was due.14Utah State Tax Commission. Penalties and Interest Additional penalties under Utah Code 59-1-401 and 59-1-402 depend on whether the underpayment was due to negligence, substantial understatement, or fraud. Something else worth watching: if you buy an item tax-free for an exempt purpose and later put it to a taxable use, you owe use tax at that point. Manufacturing equipment reassigned to an office function is the classic example. Reporting and paying that use tax is on the buyer, and ignoring it just means the bill arrives during an audit with interest attached.
