Utah seat belt laws require every driver and passenger in a moving vehicle to be buckled or properly restrained on any public highway, and an officer can pull you over for that alone. The maximum fine is $45 per stop. Children under eight have to ride in a child restraint device unless they’re already 4 feet 9 inches tall. A separate statute keeps your seat belt status out of any personal injury lawsuit, so the real consequences here are a ticket and your own safety.
Who Has to Buckle Up
Under the Motor Vehicle Safety Belt Usage Act, the driver has to wear a properly fastened seat belt whenever the vehicle is on a highway. Every passenger age 16 or older has the same independent obligation and can be ticketed personally for riding unbuckled.1Utah Legislature. Utah Code 41-6a-1803 – Driver and Passengers Seat Belt or Child Restraint Device Required
The driver also carries responsibility for younger occupants. If a passenger is between 8 and 15, the driver has to make sure that passenger is buckled in. If a child is under eight, the driver has to secure the child in a restraint device. That obligation follows whoever is behind the wheel, so if you’re driving someone else’s kids, the duty is yours, not their parents’.1Utah Legislature. One point worth knowing: if an officer finds several unbuckled occupants in your car, the driver can only receive a single citation for that stop. The statute treats it as one offense no matter how many people were unrestrained.1Utah Legislature. Utah Code 41-6a-1803 – Driver and Passengers Seat Belt or Child Restraint Device Required
Children Under Eight
A child under eight has to ride in a child restraint device that meets federal safety standards, installed and used the way the manufacturer directs. The requirement holds until the child’s eighth birthday, with one exception written into the statute: a child under eight who has already reached 57 inches (4 feet 9 inches) in height may use a standard seat belt instead.1Utah Legislature. The law does not spell out when a child should be rear-facing versus forward-facing, or when to move from a harness seat to a booster. Utah leaves that to the manufacturer’s instructions for the particular seat you own.
Rideshare and Taxis
Rides booked through transportation network companies like Uber and Lyft, and traditional taxicabs, work differently. In those vehicles, the adult passenger traveling with the child is responsible for the child’s restraint, not the driver. If you’re ordering a rideshare with kids, plan to bring and install your own car seat.1Utah Legislature. Utah Code 41-6a-1803 – Driver and Passengers Seat Belt or Child Restraint Device Required
When the Law Doesn’t Apply
The exceptions are narrow. You’re outside the seat belt requirement only in these situations:
- You have written verification from a licensed physician or physician assistant stating you can’t wear a seat belt for physical or medical reasons. Keep the document with you.
- Your vehicle was manufactured before July 1, 1966.
- Your vehicle or your seating position was never required under federal law to have a belt installed.
- You’re a passenger and every belted seating position is already occupied by someone else.
- You’re a passenger on a public transit vehicle with a gross vehicle weight rating over 10,000 pounds.
That’s the complete list. There’s no occupational exemption for mail carriers, delivery drivers, or anyone else. If the vehicle has belts and you’re on a Utah highway, you buckle up.2Utah Legislature. Utah Code 41-6a-1804 – Exceptions
The Ticket: Fine, Points, and How to Reduce It
Utah is a primary enforcement state. An officer can stop you solely because someone in the vehicle isn’t wearing a seat belt, with no other violation needed.3TowardZeroDeaths.org. Utah Department of Public Safety Together for Life Increasing Seat Belt Use in Rural Utah
The maximum fine is $45. Utah’s 2026 Uniform Fine Schedule lists the suggested fine at $45 with a zero-percent surcharge, so nothing extra is added on top.4Utah Legislature. Utah Code 41-6a-1805 – Penalty for Violation5Utah Courts. 2026 State of Utah Uniform Fine Schedule
Compared to other traffic offenses, a seat belt citation is relatively mild. No points go on your driving record. It’s classified as a non-moving violation, so it generally does not raise your auto insurance rates. And you can cut the fine to $15 by completing a two-hour safety course approved by the Department of Public Safety. If the ticket was for a child restraint violation, you also have to show proof that you’ve acquired or rented an appropriate restraint device.4Utah Legislature. Seat Belt Status in a Personal Injury Case
If you were in a crash someone else caused and you weren’t wearing your seat belt, that fact cannot be used against you. Utah Code 41-6a-1806 bars a defendant from introducing your failure to wear a belt as evidence of comparative or contributory negligence. It can’t be used to argue your injuries were your own fault, and it can’t be used to reduce the damages you recover. The seat belt law exists for enforcement and safety; it does not change how fault gets allocated after an accident.
