Utah traffic school is a state-approved defensive driving course that can do two separate things for you after a ticket: get the charge dismissed through a plea in abeyance, and knock 50 points off your driving record once every three years.1Legal Information Institute. Utah Admin Code R708-3-5 – Point Increase or Decrease The two benefits run on different tracks, and you can sometimes get both from a single course.
The Two Benefits, Kept Separate
The dismissal path runs through the court. A plea in abeyance means you plead guilty or no contest, but the court holds that plea without entering a conviction. Finish the conditions the court sets — almost always a defensive driving course plus a clean period with no new violations — and the court withdraws your plea and dismisses the charge.2Utah Legislature. Utah Code 77-2a-3 – Manner of Entry of Plea – Powers of Court – Expungement Miss the deadline or pick up another violation during the abeyance period and the court enters your guilty plea as a conviction. That conversion is automatic and usually happens without a hearing.
The point reduction runs through the Driver License Division. Complete an approved course and the DLD removes 50 points from your record, but only once every three years.1Legal Information Institute. Utah Admin Code R708-3-5 – Point Increase or Decrease If you already received a point reduction within the past three years, a new course can still satisfy a plea in abeyance, but the DLD will not take additional points off.
One more piece of the plea in abeyance: both the prosecutor and the defendant have to agree. A judge cannot order one on their own.3Utah Legislature. Utah Code 77-2a-2 – Plea in Abeyance Agreement – Negotiation – Contents – Terms of Agreement For routine traffic offenses, many Utah courts streamline this, and some let the clerk accept a plea in abeyance for qualifying offenses without a hearing.4Utah Courts. Who Qualifies
Standard moving violations such as speeding, running a red light or stop sign, failure to yield, and improper passing typically qualify. The court has discretion, so a plea in abeyance is not a right, but courts approve them routinely for first-time or infrequent offenders with common infractions.
Some offenses are off the table. A court will not accept a plea in abeyance for driving under the influence or for sexual offenses against a minor.4Utah Courts. Pleas in Abeyance Reckless driving, which carries 80 points on its own, is generally too serious for this path as well.5Utah Courts. Traffic Offenses
What the Course Looks Like
Utah’s standard defensive driving course runs four hours and covers collision prevention, hazard awareness, and techniques to improve driving ability. There is no behind-the-wheel component. The whole course is classroom-based, either in person or online.6Utah Safety Council. DDC Frequently Asked Questions Most online providers end with a final exam that requires 80% to pass, with unlimited retakes.
Expect to pay roughly $25 to $75, depending on format and provider. That is separate from any court fees tied to the plea in abeyance itself.
Picking an Approved Course
Not every driving course online is accepted by Utah courts or the DLD. The Driver License Division keeps a list of approved providers, and many nationally advertised courses are not on it.7Utah Driver License Division. Approved Online Schools Before you pay, check the DLD’s list or confirm with the court that ordered the course.
When you register, have your citation number from the original ticket and the court case number from your hearing. Enter the exact completion deadline the judge set so the provider can process your certificate in time. Wrong jurisdiction or a bad case number can delay the paperwork, and courts rarely forgive an administrative mix-up after your abeyance deadline has passed.
Getting Credit After You Finish
The school issues a completion certificate when you pass. Some providers send it directly to the court; others leave submission to you. If it is on you, upload it through the court’s online portal or mail a copy to the clerk. Either way, confirm the court actually received it before the deadline. Do not assume the school handled it.
For the point reduction, the completion also has to reach the DLD. The division verifies you have not already received a reduction in the past three years, then takes 50 points off.1Legal Information Institute. Utah Admin Code R708-3-5 – Point Increase or Decrease You can check your point total through the DLD’s online portal or request a certified record to confirm the change posted.
Why This Matters for Your Record
Just paying the fine counts as a conviction. Utah courts report traffic convictions to the DLD within ten days, and the full point value gets attached to your record.5Utah Courts. Traffic Offenses The conviction also becomes part of your public driving history, which insurers see when they set rates.
Points add up fast. A moderate speeding ticket runs 35 to 75 points depending on how far over the limit, running a red light is 50, and failure to yield is 60.5Utah Courts. Traffic Offenses For adult drivers, 200 points in three years triggers a mandatory 60-day suspension, with longer suspensions at higher totals.8Legal Information Institute. Utah Admin Code R708-3-8 – Point System Thresholds for Provisional Licensed Drivers Provisional drivers face a lower bar — 70 or more points can mean a suspension or denial lasting 30 days to a year.9Utah Driver License Division. Utah Points System A single course removes 50 points immediately instead of asking you to wait and drive flawlessly for a year or two.
Commercial Driver License Holders
If you hold a CDL, traffic school will not keep a conviction off your record. Federal law prohibits states from masking, deferring, or diverting any traffic conviction for CDL holders, and the rule applies whether you were driving a commercial vehicle or your personal car when you got the ticket.10eCFR. 49 CFR 384.226 – Prohibition on Masking Convictions The only exception is parking violations. A Utah court cannot offer a CDL holder a plea in abeyance on a speeding ticket or any other moving violation. The conviction has to appear on your driving record.
This catches CDL holders off guard, especially after a ticket in a personal vehicle on a day off. If you hold a CDL and get cited, the better path is usually to talk to an attorney about reducing the charge to a lesser offense before conviction, rather than relying on traffic school afterward.
