Utah Unemployment Benefits: Eligibility, Filing, and Denials

Filing a New Claim To collect, you need to have lost your job through no fault of your own, meet minimum earnings during a lookback period, and stay available for full-time work while you look for a new one.

Who Qualifies

Two things have to line up. Your separation from your last job has to be a qualifying one, and your wage history has to be strong enough.

Why You Left Matters

Layoffs, reductions in force, and company closures qualify. Quitting voluntarily without good cause, or being fired for misconduct, generally disqualifies you.3Utah.gov. Am I Eligible for Benefits? Your Earnings History

You must have earned at least $5,500 during your base period, defined as the first four of the last five completed calendar quarters before you file. Total base period wages must also be at least 1.5 times your highest-earning quarter.3Utah.gov. Am I Eligible for Benefits? So if your best quarter was $4,000, you’d need at least $6,000 across the base period.

If you don’t qualify under the standard base period, Utah lets you use an alternative: the most recent four completed calendar quarters. That helps workers whose earnings landed too recently to fall inside the standard window.5Workforce Services – Utah.gov. UI Claimant Guide

When Quitting Still Qualifies

Leaving voluntarily doesn’t automatically end your chances. Utah recognizes “good cause” when staying would have created a hardship a reasonable person couldn’t tolerate and quitting was the only realistic option.6Utah Administrative Code. R994-405 Ineligibility for Benefits

  • Your employer required you to break state or federal law, or conditions posed a real threat to your health or safety.
  • You were subjected to unlawful sexual harassment or prohibited discrimination and your employer either failed to act or clearly would not have.
  • A medical condition made it impossible to continue, supported by medical evidence, with no reasonable accommodation available.
  • You had a definite, immediate offer of other full-time permanent work when you quit.
  • Your active-duty military spouse was reassigned for at least 180 days and commuting to your old job wasn’t practical.
  • You lost your means of getting to work and no other reasonable transportation existed.

DWS expects you to have tried alternatives first. Walking out without attempting to resolve the situation usually counts against you unless doing so would have been pointless.

How Much You’ll Get and For How Long

Utah takes your highest-earning quarter from the base period, divides by 26, and subtracts $5. That’s your weekly benefit amount. An example: high quarter of $10,400 divided by 26 is $400, minus $5, so $395 a week. Any figure over $801 caps at $801.

How to File

All new claims are filed online at jobs.utah.gov. DWS does not take claims by phone.2Employer Solutions – Utah.gov. Filing a New Claim Before you start, pull together:

  • Social Security number, date of birth, mailing address, phone, and email.
  • An 18-month employment history: employer names and addresses, dates worked, gross earnings, and reason for leaving each job.
  • Bank routing and account numbers for direct deposit.
  • Your Alien Registration Number or other work authorization if you aren’t a U.S. citizen.
  • DD-214 or SF-8 forms if you had recent military or federal service.

Pay stubs and W-2s aren’t required but help you enter wages accurately. What Happens After You File

Your first eligible week is a non-payable waiting week. You still file for it to establish the claim, but no money comes for that week.1Workforce Services – Utah.gov. Frequently Asked Questions DWS then contacts your former employers to verify what you reported and check the reason for separation. Resolving open issues can take up to four weeks. You’ll receive a written determination stating whether the claim is approved, your weekly benefit amount, and how many weeks you can collect.

Weekly Filing and Job Search

Every week you want a payment, you have to file a weekly claim at jobs.utah.gov and answer questions about that specific week: whether you worked, your gross earnings, any job offers you refused, and whether you were able and available for full-time work.9Utah Department of Workforce Services. You must make at least four new full-time job contacts per week. A new contact is an employer you haven’t approached before, or a former employer about a new opening. Applications, interviews, and networking all count. Keep detailed records of who, when, and how, because DWS can audit your search at any time, and sloppy or missing records can get your benefits suspended.9Utah Department of Workforce Services. Some claimants get the four-contact requirement deferred: union members on an out-of-work list who earned at least half their base-period wages through the union, workers whose employer expects to recall them within ten weeks, people with a definite job offer starting within three weeks, workers whose primary occupation is seasonally unavailable, and claimants in a DWS-approved training program.10Legal Information Institute (LII). Once benefits start, you also have to accept suitable work if it’s offered. What counts as suitable widens the longer you’re unemployed, taking into account your skills, prior earnings, prevailing local wages, commuting distance, and health and safety. You can always refuse a job vacant because of a strike, one paying substantially below the local norm, or one that would require you to join a company union or drop a legitimate one.11Utah Legislature. Working Part-Time While Collecting

Part-time work doesn’t automatically end your benefits. If you earn less than your weekly benefit amount and work fewer than 40 hours, you can still get a partial payment. Utah applies a 30% earnings allowance: you keep the full benefit until your earnings pass 30% of your weekly benefit amount, and every dollar above that reduces your check dollar for dollar.4Utah Department of Workforce Services. If your weekly benefit is $400, you can earn up to $120 with no reduction. Earnings at or above $400, or 40 or more hours in the week, mean no payment. Severance, PTO, and Retirement Income

Severance, vacation payouts, PTO, holiday pay, and other separation payments have to be reported. For any week those payments equal or exceed your weekly benefit amount, you get nothing and no waiting-week credit.4Utah Department of Workforce Services. Claimant Guide

Retirement income and disability retirement can also reduce your benefit. If retroactive retirement payments cover weeks when you were already collecting unemployment, DWS treats the overlap as an overpayment and will require you to pay it back. Taxes

Unemployment is taxable federal income. DWS sends a Form 1099-G in January showing the prior year’s total. You can have federal tax withheld from each payment by submitting IRS Form W-4V to DWS; otherwise you may need to make quarterly estimated payments to avoid owing at filing time.12Internal Revenue Service. If Your Claim Is Denied

You have 15 days from the date on any adverse decision to file an initial appeal. That deadline is strict.8Workforce Services – Utah.gov. File UI Appeal The appeal goes to an Administrative Law Judge, who holds a hearing where you and your former employer can testify under oath, submit documents, and cross-examine each other’s witnesses. If the ALJ rules against you, you have 30 calendar days to appeal to the Workforce Appeals Board, a three-member panel appointed by the governor. The Board does not rehear testimony; it reviews the hearing record and any written arguments you submit, then affirms, reverses, or modifies the ALJ’s decision. If you can show good reason for not presenting certain evidence at the original hearing, the Board can send the case back for another look. Overpayments and Fraud

If DWS pays you benefits you weren’t entitled to, you owe the money back whether the mistake was yours or the agency’s. Non-fault overpayments don’t accrue interest, and DWS can set a repayment schedule based on your income. If repayment would leave you unable to cover basic living expenses, you may qualify for a waiver: you have to currently be collecting Utah unemployment, your total family resources must fall below 70% of the Lower Living Standard Income Level, and you have to request the waiver within 10 days of the notice.15Legal Information Institute (LII). Fraud is a different category. If DWS finds you intentionally misrepresented information, you lose 13 weeks of eligibility for the first week of fraud plus six additional weeks for each further week of fraud, up to 49 weeks per determination. You repay the overpaid amount plus a civil penalty equal to that amount, so $1,000 in fraudulent benefits means $2,000 owed.
