Vail Sales Tax: Rates, Lodging, and Use Tax

The Vail sales tax rate is 9.4 percent on most retail purchases, one of the higher combined rates in Colorado’s mountain communities.1Town of Vail. Sales Tax Vail is a home-rule municipality, so it writes its own tax code and collects the town’s share directly instead of routing it through the state.2American Legal Publishing. Vail, CO Code of Ordinances – Preamble For businesses, that means two separate filing systems and two sets of rules.

How the 9.4 Percent Breaks Down

Five taxing authorities stack to reach that total:1Town of Vail. Sales Tax

  • Town of Vail: 4.5 percent
  • State of Colorado: 2.9 percent
  • Eagle County: 1.0 percent
  • Eagle County Transportation: 0.5 percent
  • Regional Transportation Authority: 0.5 percent

Vail collects its own 4.5 percent through a dedicated online portal. The remaining 4.9 percent from the state, county, and transportation authorities flows through the Colorado Department of Revenue.

What Vail Taxes

The tax applies broadly. The town code covers the sale, rental, and lease of tangible personal property at retail, including digital products and internet subscription services.3American Legal Publishing. Vail, CO Code of Ordinances – Property and Services Taxed Ski gear at a Vail Village shop, a week’s equipment rental, or a digital download all trigger the 9.4 percent rate.

Several service categories are also taxable:3American Legal Publishing. Vail, CO Code of Ordinances – Property and Services Taxed

  • Telecommunications billed to a Vail address
  • Commercial gas and electric service (not residential resale)
  • Lodging: hotel rooms, short-term rentals, and similar accommodations
  • Pay television, including cable and streaming delivered within town limits

Restaurant meals and prepared food are fully taxable at 9.4 percent. The code specifically covers restaurants, cafés, hotels, caterers, food trucks, and any establishment that regularly sells prepared food or drinks.3American Legal Publishing. Groceries Are Taxed at a Reduced Rate

Groceries for home consumption are not exempt in Vail. The town charges 4.0 percent on food for home consumption instead of its standard 4.5 percent rate, but the tax still applies.1Town of Vail. Colorado eliminated its 2.9 percent state sales tax on groceries, but that doesn’t zero out the local portion. A grocery run in Vail still carries the 4.0 percent town rate plus applicable county and transportation taxes.

Lodging Carries an Extra Tax

Short-term stays in Vail carry the full 9.4 percent sales tax plus a 1.4 percent town lodging tax, bringing the combined rate on accommodations to at least 10.8 percent.4Town of Vail. Lodging Tax The lodging tax applies to any stay of fewer than 30 days, in a traditional hotel or a short-term rental booked through an online platform.

Rates for short-term rentals versus hotels may differ. If you operate lodging in Vail, contact the Finance Department to confirm the exact combined rate for your property type.

Exemptions

The town code fully exempts several categories from the 4.5 percent local tax:5American Legal Publishing. Vail, CO Code of Ordinances – Exemptions

  • Sales to federal, state, and local government agencies acting in their official capacity
  • Sales to registered charities conducting their regular charitable activities
  • Human prescription drugs, insulin supplies, blood and urine testing kits, oxygen equipment, prosthetic devices, wheelchairs, hospital beds, and corrective eyeglasses, contact lenses, or hearing aids
  • Sales to public and nonprofit schools, including post-secondary institutions
  • Construction materials picked up by the purchaser or purchased with a building permit number (these are subject to use tax instead)
  • Cigarettes, which are taxed separately under state excise rules

Buyers claiming an exemption must present a valid certificate to the seller. Merchants should keep those certificates on file; the town will ask for them during an audit. A missing certificate turns an exempt sale into a taxable one, and the business, not the buyer, owes the difference.

Use Tax on Construction Materials

Vail’s use tax is narrower than in many towns. It applies only to construction and building materials, not to general purchases made outside town.6Town of Vail. Use Tax on Construction and Building Materials The tax applies when materials are used within town limits, regardless of where the supplier sits. Furniture, carpeting, window coverings, and removable fixtures are specifically excluded.

The town collects use tax when a building permit is issued, based on estimated project cost. Projects valued at $100,000 or more require a Final Project Cost Reconciliation Return after completion, and any underpayment is due within 90 days of the final inspection.6Town of Vail. Use Tax on Construction and Building Materials If you pick up materials from a retailer in another Colorado town, you can generally avoid paying that town’s local sales tax by showing your Vail building permit at the point of purchase.
