A vertical driver’s license in California stays legally valid after you turn 21 and remains good until the expiration date printed on the front. You don’t have to replace it the day of your birthday. But the format causes real friction at bars, liquor stores, and airport checkpoints, and knowing where you’ll actually run into trouble matters more than the card’s technical validity.
The Card Stays Valid Until It Expires
The DMV issues vertical licenses to people under 21 as a visual cue that the cardholder is below the drinking age. Turning 21 doesn’t change anything on the card itself. It continues to work as government-issued identification and proof of your driving privileges until the printed expiration date.1California Department of Motor Vehicles. California licenses are generally valid for five years from the date of issue. If you were issued a vertical card at 18, it can stay vertical until you’re 23. When you renew through the normal process, the DMV automatically issues the horizontal adult format. There’s no separate step to switch orientations at 21.
Buying Alcohol With a Vertical License
This is the part most people get wrong. California doesn’t require a business to accept your vertical ID, even if your birth date on the card plainly shows you’re over 21.
Business and Professions Code Section 25660 gives sellers an affirmative defense: if a bartender or cashier checks a valid government ID showing name, date of birth, photo, and description, and the ID reasonably appears legitimate, the business is protected from liability if the sale turns out to involve a minor.2California Legislative Information. The Department of Alcoholic Beverage Control itself notes that nothing in Section 25660 overrides a licensee’s right to refuse service under Section 25659.4Alcoholic Beverage Control. Business and Professions Code Section 25660 Documentary Evidence of Age and Identity So a bar, nightclub, or liquor store can legally turn you away for a vertical ID. You don’t have a legal right to force them to accept it.
Tobacco, Cannabis, and Traveling Out of State
The same discretion applies to tobacco and cannabis, both of which require buyers to be 21. Dispensaries typically scan the barcode on the back, which confirms your age regardless of orientation, but some venues still train staff to give vertical cards extra scrutiny and can refuse the sale.
Out of state, expect more pushback. Bartenders and clerks unfamiliar with California’s format may not know how to verify it, and no federal law requires them to accept an out-of-state vertical card for age-restricted purchases.
Flying and REAL ID
Since May 7, 2025, boarding a domestic flight or entering certain federal buildings requires a REAL ID-compliant license, a passport, or another federally accepted document.5Transportation Security Administration. REAL ID The vertical format doesn’t tell you whether your card is compliant. Look for a gold bear-and-star symbol on the front. If it’s there, your vertical license works at TSA checkpoints exactly like a horizontal REAL ID.
If the symbol is missing, the card won’t get you through security no matter how far the expiration date is. Replacing it with a REAL ID-compliant horizontal card is the simplest fix if you plan to fly.
Replacing It Early
You don’t have to wait for the card to expire. The DMV lets you apply for a replacement at any time, and once you’re 21, the new card comes in the horizontal format. You can apply online or in person at a field office, and a new photo is taken either way.

If your current card isn’t REAL ID-compliant, this is a good moment to upgrade at the same time by bringing the required identity documents.
Traffic Stops and Law Enforcement
Police won’t give you trouble over a vertical license. It proves your identity and your driving privileges, and officers are trained to recognize the format. A traffic stop works the same whether your card is vertical or horizontal. The card’s legal validity depends on the printed expiration date, not the orientation.
