The Vienna, VA meals tax is a 4% local tax on prepared food and beverages sold within town limits. Added to Virginia’s 6% retail sales tax, diners pay a combined 10% on restaurant meals. The town raised the rate from 3% to 4% on January 1, 2026, after a Town Council vote on August 25, 2025.1Town of Vienna. On a $20 meal, that works out to $0.80 in town meals tax and $1.20 in state sales tax, for a total of $2.00 added to the bill.
What the Tax Applies To
The meals tax reaches any food or beverage, alcoholic drinks included, sold ready to eat. It does not matter whether you sit down at the table or carry it out the door. Town Code Section 6-32 covers sit-down restaurants, fast-food counters, cafes, caterers, and food trucks operating inside the town.3Town of Vienna, VA. The question is whether the food is prepared and ready to eat, not where you consume it.
What’s Exempt
Food bought for home consumption, as defined under the federal Food Stamp Act, is exempt. That covers most of what fills a supermarket cart: canned goods, frozen meats, boxed cereal, dairy, and the like. The carve-out has its own carve-outs, though. Sandwiches, salad bar items, prepackaged single-serving salads, and unsealed beverages stay taxable even inside a grocery store.4Virginia Code Commission. Vending machine sales are excluded entirely. The state statute bars localities from applying the meals tax to anything bought from a vending machine.4Virginia Code Commission. Code of Virginia 58.1-3833 – County Food and Beverage Tax
Nonprofits, churches, and charitable organizations get a partial exemption. Food sales are exempt the first three times in a calendar year. Starting with the fourth event, the exemption covers the first $100,000 in gross receipts for the year, provided proceeds fund the organization’s mission. Public and private schools, from elementary through higher education, are exempt on meals sold to students and staff.4Virginia Code Commission. Factory-sealed alcohol bought to take home is also outside the meals tax. The tax only reaches alcohol when it is served as part of a prepared food transaction.
You Don’t Pay Fairfax County’s Tax on Top
Fairfax County launched its own 4% meals tax on January 1, 2026, the same day Vienna’s rate rose. The county tax does not apply inside Vienna. Vienna is an incorporated town levying its own meals tax, so a meal bought in town is taxed at the town’s 4% and not again at the county’s.5Fairfax County. A detail that trips people up: the town does not accept postmarks as proof of timely payment. Your payment has to be physically in the finance department’s hands by the 20th. A payment mailed on the 19th with a clear postmark is still late if it arrives on the 21st.3Town of Vienna, VA. Meals Tax Mail early, or use the portal.
Delivery Apps
Orders coming in through DoorDash, Uber Eats, or Grubhub complicate collection. Virginia’s marketplace facilitator statute requires those platforms to collect and remit state sales tax on orders they facilitate.7Virginia Code Commission. Code of Virginia 58.1-612.1 – Tax Collectible From Marketplace Facilitators Local meals taxes can work differently. Some jurisdictions do not allow third-party platforms to register for remitting the local food and beverage tax, which leaves the restaurant on the hook for the town’s 4%.
If you run a Vienna restaurant and use delivery platforms, confirm with the town’s finance department whether each platform is remitting the meals tax for you or whether that duty stays with the restaurant. Guessing wrong leads to double-charging customers or coming up short at remittance time.
Federal Deduction for Business Meals
When you pay the meals tax on a business meal, the tax is part of the total meal cost and follows the same federal rules as the food. For 2026, the business meal deduction is capped at 50% of the expense. The temporary 100% restaurant deduction from 2021 and 2022 has expired.8Office of the Law Revision Counsel. 26 U.S. Code 274 – Disallowance of Certain Entertainment, Etc., Expenses
A $50 business dinner in Vienna with $5 in combined taxes totals $55, of which $27.50 is deductible. The meal has to be an ordinary and necessary business expense: client dinners, team lunches, or meals while traveling overnight for work. Social meals do not count.
Restaurant owners can deduct the meals tax they remit to the town as an ordinary business expense under Internal Revenue Code Section 162. The $10,000 state and local tax deduction cap on individual returns does not apply to taxes paid in carrying on a trade or business.
