Virginia has no magazine capacity limit for deer hunting. Rifles, pistols, and shotguns used to take deer in the Commonwealth are not restricted by how many rounds the magazine holds. The rules that do apply focus on minimum caliber, muzzle energy, and weapon type.1Virginia Department of Wildlife Resources. Legal Use of Firearms and Archery Tackle
Where the Confusion Comes From
Virginia does have a three-shell shotgun rule, which is probably why so many hunters go looking for a deer magazine limit in the first place. That rule applies only to migratory game birds — doves, ducks, geese. For those species, a shotgun cannot hold more than three shells in the magazine and chamber combined.2Virginia Code Commission. Virginia Administrative Code 4VAC15-270-80 – Shotgun Shell Capacity for Nonmigratory Game, Crows, and Migratory Game Birds
Deer are nonmigratory game. The same regulation explicitly allows unplugged shotguns for hunting nonmigratory game and crows.2Virginia Code Commission. Virginia Administrative Code 4VAC15-270-80 – Shotgun Shell Capacity for Nonmigratory Game, Crows, and Migratory Game Birds If you deer hunt with a shotgun, you do not need a plug and there is no shell limit. If you also hunt waterfowl on the same trip, keep a plug on hand, because switching species switches rules.
What Virginia Does Regulate for Deer Firearms
The restrictions that matter for deer are about the gun itself, not its capacity.
- Rifles and pistols must be at least.23 caliber for deer, bear, or elk.3Virginia Code Commission. Virginia Administrative Code 4VAC15-270-10 – Size Rifles for Hunting Bear, Elk, and Deer
- Pistols must also produce at least 350 foot-pounds of muzzle energy.1Virginia Department of Wildlife Resources. Legal Use of Firearms and Archery Tackle
- Shotguns, including muzzleloading shotguns, cannot be larger than 10 gauge.1Virginia Department of Wildlife Resources. Legal Use of Firearms and Archery Tackle
- Fully automatic firearms are prohibited for all wildlife hunting.1Virginia Department of Wildlife Resources. Legal Use of Firearms and Archery Tackle
- Muzzleloading rifles must be.40 caliber or larger; muzzleloading pistols other than revolvers must be.45 caliber or larger; muzzleloading revolvers must be.44 caliber or larger.1Virginia Department of Wildlife Resources. Legal Use of Firearms and Archery Tackle
None of these categories carries a magazine capacity limit when used on deer.
The One Place a Capacity Rule Could Appear: Federal Land
If you hunt on a national wildlife refuge or in a national forest, state law is only half the picture. Federal regulations require you to follow Virginia hunting law and any refuge-specific restrictions posted at the area headquarters.4eCFR. 50 CFR 32.2 – What Are the Requirements for Hunting on Areas of the National Wildlife Refuge System Those local rules can include weapon type limits, closed zones, and potentially capacity requirements that do not exist under general Virginia law.
Virginia has substantial national forest acreage in its western counties, and each unit sets its own conditions. Before you go, pull up the posted regulations for the specific refuge or forest unit where you plan to hunt.
Penalties for the Rules That Do Exist
Virginia enforces its deer hunting firearm rules under Title 29.1. A violation of any hunting regulation is a Class 3 misdemeanor, carrying a fine of up to $500 and no jail time.5Virginia Code Commission. Virginia Code 29.1-505 – Penalty for Violation of Regulations Using an undersized rifle, hunting with a fully automatic firearm, or exceeding a bag limit all fall under this provision.
A second hunting conviction within three years of a prior one triggers mandatory license revocation. The court must revoke the hunting license and can also prohibit hunting, fishing, and trapping in Virginia for one to five years. Hunting during a prohibition period is a Class 2 misdemeanor, and the court can add another one-to-five-year ban on top.6Virginia Code Commission. Virginia Code 29.1-338 – Revocation of License and Privileges; Penalties A first-time offender faces the fine, not automatic revocation.
Quick Compliance Check
Before deer season, confirm three things. Your rifle or pistol is at least .23 caliber. If it’s a pistol, it generates at least 350 foot-pounds of muzzle energy — manufacturer specs or a ballistics chart will show this. If it’s a muzzleloader, it meets the caliber floor for its specific type. No modification to the magazine is required for any of them.
If you also hunt migratory birds, keep a shotgun plug on hand or, simpler still, use separate guns for the two kinds of hunting. And if your trip takes you onto federal land, check the refuge or forest unit’s own regulations, since that is the only place additional firearm restrictions on deer hunting are likely to turn up.
