The Virginia DMV point system assigns three, four, or six demerit points for each traffic conviction and rewards conviction-free years with safe driving points that offset them. Reach eight demerits in twelve months and you get a warning letter; twelve in twelve months or eighteen in twenty-four means a mandatory driver improvement clinic; eighteen in twelve months or twenty-four in twenty-four means an automatic ninety-day suspension followed by six months of probation.
How Demerit Points Are Assigned
Points attach when you are convicted, not when the officer hands you the ticket. The DMV sorts every moving violation into one of three tiers.1Virginia Department of Motor Vehicles. The Points System
- Six points: reckless driving, driving under the influence, manslaughter, driving on a suspended license, and passing a stopped school bus.
- Four points: failing to yield, following too closely, and speeding ten to nineteen miles per hour over the limit.
- Three points: improper U-turns, failing to signal, and driving without working headlights or taillights.
If a single traffic stop produces two or more convictions, the DMV counts points only for the most serious one. The full violation list sits on the DMV’s point assessment page.1Virginia Department of Motor Vehicles. The Points System
How Safe Driving Points Work
For every full calendar year you hold a valid Virginia license with no convictions and no suspensions, the DMV adds one safe driving point to your record. The cap is five.2Virginia Code Commission. Virginia Code 46.2-494 – Safe Driving Point Credit
Those points offset demerits directly, applied against the oldest active demerits first. A full five-point cushion can absorb a minor three-point violation entirely and still leave a positive balance. If the DMV later finds out about a conviction from a year it already credited you for, the safe driving point for that year is invalidated retroactively.2Virginia Code Commission. Virginia Code 46.2-494 – Safe Driving Point Credit
The buffer matters because the thresholds that trigger a warning, a clinic, or a suspension are calculated against your net balance. A driver sitting at zero has far less margin than one carrying the full five.
What Happens as Demerit Points Add Up
Virginia uses a graduated response. You will usually hear from the DMV before anything serious happens, but the gap between the first warning and a suspension is not large.
- Advisory letter: eight demerit points in twelve months. No action required, but it is a clear signal that another conviction could cost you.
- Mandatory driver improvement clinic: twelve points in twelve months, or eighteen points in twenty-four months. Skip the clinic and your license is suspended until you complete it.
- Automatic ninety-day suspension plus six months of probation: eighteen points in twelve months, or twenty-four points in twenty-four months. Any demerit-point conviction during that probation period triggers additional suspension.
These counts run against your net balance, so safe driving points can keep you below a threshold you would otherwise cross.
The Driver Improvement Clinic
A driver improvement clinic is an eight-hour course on defensive driving and current traffic law, available in person or online, with the cost capped at $100.3Virginia Department of Motor Vehicles. Driver Improvement
Finishing one adds five safe driving points, subject to the same five-point ceiling that caps all safe driving points. If you already have three, the clinic brings you to five rather than eight. You can take the clinic voluntarily for point credit once every twenty-four months.3Virginia Department of Motor Vehicles. Driver Improvement
You can also attend a second time within that twenty-four-month window for an insurance premium reduction under a separate Virginia provision, but the second attendance earns no additional safe driving points. When the DMV orders you to take a clinic as a sanction, that mandatory attendance does not reset your voluntary eligibility clock.
How Long Points and Convictions Stay on Your Record
Demerit points stay active for two years from the date you committed the offense, not the date of conviction. After twenty-four months they fall off your active balance and no longer count toward any threshold.4Virginia Code Commission. Virginia Code 46.2-493 – Demerit Points Valid for Two Years
One exception: if the points were the basis for a suspension or probation that runs past the two-year mark, they stay valid until that sanction ends.4Virginia Code Commission. Virginia Code 46.2-493 – Demerit Points Valid for Two Years
The conviction itself outlasts the active points. Serious offenses like DUI and reckless driving remain on your driving transcript for up to eleven years. Less severe infractions stay for about five.1Virginia Department of Motor Vehicles. The Points System
Insurance companies pull the full transcript rather than the active point balance, so a conviction can keep affecting your premium long after the demerit points have expired. Treat the point system and the insurance timeline as two separate clocks.
Tickets From Other States
Virginia belongs to the Driver License Compact, under which member states share conviction information. When another member state convicts you of a moving violation, it reports the conviction to Virginia, and the Virginia DMV assigns demerit points based on its own schedule rather than the other state’s.
The compact covers moving violations and major offenses such as DUI. It does not cover parking tickets or equipment violations. A speeding ticket from most other states will land on your Virginia record with Virginia-level points.
CDL Holders Face Stricter Rules
If you drive commercially, two things change. First, federal regulations prohibit states from allowing CDL holders to use diversion programs or any other mechanism that would keep a conviction off the federal CDL record. Virginia follows this and specifically bars CDL holders from attending driving school to reduce or dismiss a traffic charge, whether the violation happened in a commercial vehicle or a personal one.5eCFR. 49 CFR 384.226 – Prohibition on Masking Convictions The voluntary clinic that non-CDL drivers use to pick up safe driving points cannot be used as a tool to make the underlying charge go away.
Second, federal law adds CDL disqualification periods for “serious traffic violations,” which include speeding fifteen or more miles per hour over the limit, reckless driving, improper lane changes, following too closely, and texting while driving a commercial vehicle.6eCFR. 49 CFR 383.51 – Disqualification of Drivers
- Second serious violation within three years: 60-day CDL disqualification.
- Third or subsequent serious violation within three years: 120-day CDL disqualification.
These disqualifications apply when the violations occur in a commercial vehicle, and they can also apply to violations in a personal vehicle if the conviction leads to suspension or revocation of your driving privileges.6eCFR. 49 CFR 383.51 – Disqualification of Drivers
Checking Your Balance
You can see your current demerit and safe driving point totals by logging into your account on the Virginia DMV website. The DMV also sells a full driving transcript showing your complete conviction history alongside active points.1Virginia Department of Motor Vehicles. The Points System
Check it periodically. Reporting errors do happen, and a misposted conviction or miscounted total can push you across a threshold you would otherwise stay under. If something looks wrong, contact the DMV before an advisory letter or clinic order forces the issue.
