Virginia Garnishment Exemptions: Wages, Homestead, and Benefits

Virginia garnishment exemptions protect a broad slice of what a creditor might otherwise reach: wages up to a weekly floor, equity in your home, a specific list of personal property, retirement accounts, most government benefits, and life insurance values. Several of those protections are more generous than federal law. The catch is that most of them apply only if you are a “householder” and file the right paperwork before the return date on the garnishment summons.1Virginia Code Commission. How Much of Your Wages Can Be Garnished

For ordinary consumer debts, Virginia caps wage garnishment at the lesser of 25% of your disposable earnings for the week, or the amount by which those earnings exceed 40 times the higher of the federal or Virginia minimum wage.1Virginia Code Commission. Virginia Code Title 34 – Homestead and Other Exemptions With the federal minimum wage at $7.25 per hour, that means no garnishment at all if your disposable earnings are $290 a week or less. Federal law only kicks in at 30 times the minimum wage, or $217.50 a week, so Virginia’s floor is higher.2Office of the Law Revision Counsel. 15 US Code 1673 – Restriction on Garnishment

Disposable earnings means gross pay minus legally required deductions: federal, state, and local taxes, Social Security, and state unemployment insurance. Voluntary deductions like health premiums, union dues, 401(k) contributions, and charitable giving are not subtracted, so the disposable-earnings number is higher than your take-home pay.3U.S. Department of Labor. Extra Exemption for Parents of Minor Children

If you support minor children who live with you and your household gross income is $1,750 a month or less, you can claim an additional weekly exemption on top of the standard wage cap: $34 for one child, $52 for two, or $66 for three or more. To get it, you file an affidavit with proof of your dependents and household income along with your exemption claim.4Virginia Code Commission. Debts That Bypass the Standard Cap

The 25% cap does not apply to child support, spousal support, bankruptcy orders, or tax debts. For support obligations, up to 60% of your disposable earnings can be taken, or 50% if you are currently supporting another spouse or child. Those figures rise to 65% and 55% when support payments are more than 12 weeks overdue.1Virginia Code Commission. Virginia Code Title 34 – Homestead and Other Exemptions

Federal student loan garnishment is set by federal law at up to 15% of disposable pay, and the Department of Education does not need a court order to start it.5Office of the Law Revision Counsel. 20 USC 1095a – Wage Garnishment Requirement

Homestead Exemption for Your Home and Other Property

Virginia’s homestead exemption lets you protect up to $5,000 in real or personal property of your choosing, plus $500 for each dependent you support. If you are 65 or older, the base doubles to $10,000. On top of that, you can exempt up to $50,000 in equity in property used as your principal residence.6Virginia Code Commission. The residence protection is the piece most people care about, and it is the piece most people miss, because it requires a separate filing step. To claim the exemption for real estate, you sign a homestead deed and record it in the circuit court of the county or city where the property sits, just as you would record a regular deed. The deed must describe the property with reasonable certainty, state its cash value, disclose any prior homestead deeds you have filed, and carry your acknowledgment under oath.8Virginia Code Commission. The homestead exemption cannot be used to avoid child support or spousal support.10Virginia Code Commission. Virginia Code 8.01-512.4 – Notice of Exemptions from Garnishment and Lien

Personal Property Protected Without a Homestead Deed

Separate from the homestead exemption, Virginia’s “poor debtor’s exemption” under Code § 34-26 protects a defined list of personal property from seizure. These items are exempt for every householder whether or not a homestead deed has been filed.11Virginia Code Commission. Virginia Code 34-26 – Poor Debtors Exemption; Exempt Articles Enumerated

  • Household furnishings including beds, dressers, floor coverings, kitchen appliances, cookware, and eating utensils, up to $5,000 total.
  • Wearing apparel up to $1,000.
  • Motor vehicles not needed for work, up to $10,000 total (a perfected security interest such as a car loan takes priority).
  • Tools, instruments, machines, and even motor vehicles necessary for your occupation or trade, up to $10,000. Vehicles used only for commuting do not count, and “occupation” includes enrollment in school or college.
  • Family Bible and wedding rings, with no dollar cap.
  • Family heirlooms and portraits, up to $5,000.
  • All animals kept as pets rather than for sale or profit.
  • Firearms up to $3,000 total.
  • Burial plots and preneed funeral contracts up to $5,000.
  • Medically prescribed health aids, with no dollar cap.
  • Any portion of a tax refund attributable to the Child Tax Credit, Additional Child Tax Credit, or Earned Income Credit.
  • Unpaid spousal or child support owed to you.

The dollar caps matter more than people expect. If your furniture is worth $7,000, a creditor could in theory reach the $2,000 above the exemption. Courts sometimes require an itemized list with values, so keeping an inventory of household goods and their replacement costs pays off if you ever need to file a claim.

Retirement Accounts and Pensions

Tax-qualified retirement accounts are exempt from creditor garnishment to the same extent they would be protected in federal bankruptcy. That covers 401(k) plans, traditional and Roth IRAs, 403(b) plans, 457 plans, and similar arrangements meeting IRS qualification rules.12Virginia Code Commission. Public employee pensions under the Virginia Retirement System have their own protection. Those benefits, including optional insurance tied to the pension, are exempt from garnishment except for child support and spousal support enforcement.13Virginia Code Commission. Government Benefits

Most federal benefit payments are protected from garnishment by creditors. Social Security retirement and disability benefits, Supplemental Security Income, veterans’ benefits, federal civil service retirement, and black lung benefits are all shielded under federal law.10Virginia Code Commission. One caveat runs through nearly all these federal benefit exemptions: they may not apply in child support or alimony cases. Federal law allows garnishment of Social Security, veterans’ benefits, and other federal payments to enforce support obligations even though ordinary creditors cannot touch them.10Virginia Code Commission. Keeping Benefits Protected in a Bank Account

Once federal benefits land in your bank account, they can become harder to distinguish from other money. Federal rules require banks to automatically protect up to two months’ worth of directly deposited federal benefits (Social Security, SSI, VA, and several others) when they receive a garnishment order. If your balance is larger than two months of benefits, the excess is not automatically protected. You would need to file a court claim to prove the extra funds are exempt benefit money. Life Insurance and Annuities

Virginia protects not only death benefit proceeds but also the cash surrender value of a policy, the withdrawal value of any settlement, and all other benefits from a life insurance policy or annuity contract.17Virginia Code Commission. Virginia Code 38.2-3122 – Proceeds and Avails of Life Insurance Policies and Annuity Contracts Free of Certain Claims The protection reaches the insured, the policy owner, and beneficiaries who are the insured’s spouse, dependent child, or other dependent.

Three situations break the protection. It does not apply if you took out or assigned the policy for a creditor’s benefit. Premiums paid with intent to defraud creditors can be clawed back with interest. And any policy issued within six months before you file for bankruptcy or are declared insolvent is not covered.17Virginia Code Commission. IRS Levies Follow Different Rules

An IRS wage levy does not use a percentage cap. The IRS exempts a fixed dollar amount based on your filing status and number of dependents, then takes the rest. For 2026, the weekly exempt amounts are $309.62 for a single filer, $619.23 for married filing jointly, and $464.42 for head of household, plus $101.92 for each dependent.18Internal Revenue Service. Everything above those amounts goes to the IRS. Virginia’s standard wage garnishment exemptions under § 34-29 do not apply to state or federal tax debts, so the homestead exemption and the 25%/40-times-minimum-wage cap cannot be used to reduce an IRS levy.1Virginia Code Commission. Virginia Code Title 34 – Homestead and Other Exemptions If you receive an IRS levy notice, requesting a Collection Due Process hearing within 30 days is typically the most effective way to pause collection and negotiate an alternative.

How to Actually Claim Your Exemptions

Most Virginia exemptions are not applied automatically. When a creditor obtains a garnishment order, you receive a notice explaining your right to claim exemptions and a form to fill out. Virginia courts use a standardized claim form under Code § 8.01-512.4 that lists each available exemption with checkboxes and space for supporting details.10Virginia Code Commission. For wage garnishment, the homestead exemption claim must be filed after the summons is served on your employer but no later than the return date of the summons. Miss that deadline and you can lose the exemption for that garnishment.9Virginia Code Commission. Virginia Code 34-17 – When Exemption May Be Set Apart; Garnished Wages After filing, the court sets a hearing. You bring evidence such as pay stubs, bank statements, or documentation of your dependents. The creditor can challenge your claim, and the judge decides whether each exemption applies. If it is granted, garnished funds are released back to you.

For real property, the homestead deed described above must be recorded separately in the local circuit court. For personal property, the § 34-26 exemptions generally apply without a separate recording, but you still have to assert them through the claim process when a garnishment or levy actually hits.

Your Job During a Garnishment

Federal law prohibits your employer from firing you because your wages are garnished for any one debt. An employer who violates that rule faces fines up to $1,000 and up to one year of imprisonment.19Office of the Law Revision Counsel. 15 USC 1674 – Restriction on Discharge from Employment by Reason of Garnishment The protection is limited to “any one indebtedness,” so an employer could lawfully terminate an employee with garnishments for two or more separate debts. Virginia has no additional protection on this point, so the federal one-debt rule is the only safeguard.
