Virginia life jacket laws require a U.S. Coast Guard-approved wearable life jacket for every person on any vessel operating on state waters, and they require certain people to actually wear one the whole time the boat is underway: children under 13, everyone on a personal watercraft, and anyone being towed. What Every Boat Must Carry
Every vessel on Virginia waters must have at least one wearable Coast Guard-approved life jacket (Type I, II, III, or V) for each person aboard. Boats 16 feet or longer need one more thing: a throwable flotation device, such as a ring buoy or throw cushion, in addition to the wearable jackets. Adults on standard motorboats and sailboats don’t have to wear their life jackets, but the jackets must be “readily accessible.” That means out in the open or stowed where someone can grab one in seconds. A jacket sealed in its original packaging, locked in a compartment, or buried under gear doesn’t satisfy the requirement. Who Must Wear a Life Jacket at All Times
Children Under 13
Every child under 13 must wear a properly fitting, Coast Guard-approved life jacket whenever a recreational vessel is underway, meaning moving, drifting, or under sail rather than anchored or tied up. The jacket has to be the right size for the child. An adult jacket cinched down with extra straps doesn’t count. Each device has a weight and chest-size range printed on its label, and the child must fall within that range. Officers check this during inspections, and an oversized or improperly secured jacket is treated the same as no jacket at all.
Personal Watercraft Riders
Personal watercraft carry stricter rules than regular boats. The operator, every passenger, and anyone being towed behind the PWC must wear a Coast Guard-approved life jacket at all times. Anyone Being Towed
Water skiers, tubers, and wakeboarders being towed behind any vessel must wear a life jacket. Check the label before using a particular jacket for towed sports. Many life jackets carry usage limitations for high-impact activities like skiing, and using one outside its approved purpose is both a safety problem and a compliance problem.2Virginia Department of Wildlife Resources. Inflatable Life Jacket Rules
Inflatables are legal on most Virginia vessels, with restrictions people miss. The biggest one: inflatable PFDs are approved only for persons age 16 or older. A child or younger teenager cannot use an inflatable to satisfy Virginia’s life jacket requirement, even if the device is Coast Guard-approved.2Virginia Department of Wildlife Resources. Inflatables are also banned outright on personal watercraft, and the label should be checked against approved uses before wearing one for towed sports.4Virginia Department of Wildlife Resources. Equipment Regulations Where inflatables are permitted, they must be in working order: the inflation mechanism needs a full cartridge, the status indicator must show the device is properly armed, the inflatable chambers must hold air, and the oral inflation tube cannot be blocked or broken. An inflatable that looks fine but has an expired cartridge or a jammed indicator won’t pass inspection.
Condition and Fit
Having enough jackets on board is only half of it. Every device must be in “good and serviceable condition” to count. Intact fabric and coatings, working buckles and straps, buoyant material that hasn’t hardened or become waterlogged, and a legible Coast Guard approval label. Sizing matters too. The label lists weight and chest ranges, and the device must match the wearer. An adult in a youth jacket or a child in an adult device is a violation. Penalties
Most life jacket violations are Class 4 misdemeanors. The maximum fine is $250 per violation, with no mandatory minimum, so a judge has discretion to impose anything from a warning-level amount up to the cap.5Virginia Code Commission. Courts can also order completion of a boating safety course, either instead of or in addition to the fine. If the court orders a course and the person fails to complete it within the prescribed period, a separate fine of up to $250 can be imposed for that failure alone.1Virginia Code Commission.
