Virginia Medical Card: Certification, Limits, and Restrictions

Virginia does not issue a physical medical marijuana card. To buy cannabis legally from a Virginia dispensary, what you actually need is a written certification from a healthcare practitioner registered with the Virginia Cannabis Control Authority (CCA). That certification is the document people mean when they say “Virginia medical card,” and it is currently the only legal path to buy cannabis in the state.

Who Can Issue Your Certification

A written certification must come from a physician, physician assistant, or nurse practitioner who is registered with the CCA to evaluate patients for medical cannabis.1Virginia Code Commission. What Happens During the Consultation

The practitioner reviews your medical history, discusses your symptoms, and decides whether cannabis is appropriate. If approved, they issue the written certification on a form provided by the CCA. The document lists your name and address, the practitioner’s contact information, the date issued, and the practitioner’s signature.2Virginia Code Commission. Telehealth is allowed as long as the visit uses real-time audio and video.3Virginia Cannabis Control Authority. Medical Cannabis Providers You can get certified from home. Many telehealth practices charge somewhere between $50 and $150 for the consultation, though pricing varies.

How Long the Certification Lasts

A written certification is valid for one year from the date it was issued, unless the practitioner sets an earlier expiration.2Virginia Code Commission. Virginia Code 4.1-1601 – Certification for Use of Cannabis for Treatment You cannot hold active certifications from more than one practitioner at the same time. To avoid a gap in dispensary access, schedule your renewal before the expiration date.

What to Bring to the Dispensary

On your first visit to a Virginia-licensed dispensary, bring three things:

The residency piece trips people up, so have a backup document ready if your driver’s license is out of state. After your first purchase at a given dispensary, you do not need to physically present the certification each visit as long as the dispensary keeps an electronic copy on file.2Virginia Code Commission. How Much You Can Buy and Possess

Certified patients can possess substantially more cannabis than the one-ounce general adult limit. Dispensaries can provide up to four ounces of botanical (flower) cannabis per 30-day period. For other cannabis products such as oils and edibles, the limit is a 90-day supply, with each individual dose capped at 10 milligrams of THC.1Virginia Code Commission. Do You Need to Register With the State?

No. Virginia used to require patients to register with the Board of Pharmacy before purchasing, but that requirement was eliminated in July 2022. Registration through the CCA patient portal is now optional.5Virginia Cannabis Control Authority. Medical Cannabis Program Overview Some patients register voluntarily because it can simplify identity verification during a law enforcement encounter, but your written certification alone is enough to buy from a dispensary.

Sending Someone Else to Pick Up

If you cannot get to a dispensary yourself, you can designate a “registered agent” to pick up on your behalf. The simplest route is to have your practitioner name that person directly on your written certification, in which case no separate registration with the CCA is needed.4Virginia Cannabis Control Authority. For minors or vulnerable adults, a parent or legal guardian handles the designation under the same rules.

What a Certification Does Not Cover

A written certification gives you legal access to dispensaries and higher possession limits inside Virginia. It does not override several other rules that catch new patients off guard.

Firearms

Federal law prohibits anyone who uses a controlled substance from possessing a firearm or ammunition.6Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts Cannabis is still federally classified as Schedule I, so this applies to every certified patient in Virginia. When buying a firearm from a licensed dealer, ATF Form 4473 asks whether you use any controlled substance. Answering “no” while holding a medical certification can expose you to a federal charge for providing false information.

Travel

Your Virginia certification carries no legal weight outside Virginia. Transporting cannabis across state lines is a federal offense regardless of whether both states have medical programs, and that covers driving, flying, and shipping. TSA operates under federal authority and reports discovered cannabis to law enforcement. Some other states have reciprocity programs that let visiting patients access local dispensaries, but the rules vary and Virginia’s certification is not universally accepted.

Public Use

Consuming cannabis in any public place is illegal in Virginia even with a certification. A first offense carries a civil penalty of up to $25, a second offense adds the potential for a substance abuse education or treatment program, and a third or later violation is a Class 4 misdemeanor.7Virginia Code Commission. Work

Virginia prohibits employers from firing or disciplining an employee for lawful use of cannabis oil under a valid written certification. The protection has real limits. It covers cannabis oil specifically, not botanical flower. Employers can still act on impairment at work and can bar possession during work hours. The protection does not apply where compliance would put the employer in violation of federal law or cost them a federal contract, and there is a separate carve-out for defense industrial base employers, who can refuse to hire or retain anyone testing above set THC thresholds.8Virginia Code Commission.
