Virginia Motorcycle Sales Tax: Rate, Trade-Ins, and Exemptions

The Virginia motorcycle sales tax is 4.15% of the purchase price, collected by the Department of Motor Vehicles when you title the bike. On a $10,000 motorcycle, that’s $415. A $75 minimum applies to smaller purchases, and Virginia does not reduce the taxable price when you trade in another vehicle.

How the 4.15% Rate Is Calculated

Virginia Code § 58.1-2402 sets the motor vehicle sales and use tax at 4.15% of the gross sales price for street-legal motorcycles.1Virginia Code Commission. Virginia Code 58.1-2402 – Levy Gross sales price is what you actually pay after manufacturer rebates and dealer incentives, and it includes the dealer processing fee.2Virginia Department of Motor Vehicles. Motor Vehicle Sales and Use Tax Buy a $12,000 motorcycle with a $500 manufacturer rebate and the taxable price is $11,500, so the tax is $477.25.

Every taxable sale carries a $75 statutory minimum. If 4.15% of your price works out to less than $75, you pay $75. That floor engages on motorcycles priced around $1,807 or below. Off-road motorcycles, mopeds, and ATVs sit outside this minimum and are taxed at different rates under the same statute.1Virginia Code Commission. Virginia Code 58.1-2402 – Levy

Trade-Ins Do Not Reduce the Tax

This is where Virginia diverges from many other states. The gross sales price does not include any reduction for trade-ins, unpaid liens, or other credits. If you buy a $15,000 motorcycle and trade in your old bike for $5,000, you still owe 4.15% on the full $15,000, not on the $10,000 you paid out of pocket.2Virginia Department of Motor Vehicles. Private-Party Sales and NADA Value Checks

Buying from a private seller doesn’t change the rate. The DMV still collects 4.15% at titling, and the price recorded on the title certificate acts as your bill of sale.2Virginia Department of Motor Vehicles. For motorcycles less than five model years old, the DMV compares the reported price to the current trade-in value in the NADA Official Used Car Guide. If your reported price is more than $1,500 below the NADA value, you’ll need to submit Form SUT-1A (Affidavit for Procurement of Title) explaining the difference.2Virginia Department of Motor Vehicles. For bikes more than five model years old, you can use Form SUT-1 (Vehicle Price Certification) or a handwritten bill of sale if the title price is missing or wrong.3Virginia Department of Motor Vehicles. Exemptions That Apply to Motorcycles

Virginia Code § 58.1-2403 spells out when the tax doesn’t apply.4Virginia Code Commission. Virginia Code 58.1-2403 – Exemptions A few matter most to motorcycle buyers.

Gifts Within the Immediate Family

A motorcycle given to a spouse, son, daughter, or parent is exempt.4Virginia Code Commission. Virginia Code 58.1-2403 – Exemptions For transfers to a son, daughter, or parent, the exemption is lost if the recipient takes over an unpaid loan on the bike. Transfers to a spouse don’t have that restriction. Only biological and adoptive relationships count; stepchildren and in-laws don’t qualify.5Virginia Department of Motor Vehicles. Motorcycles Titled in Another State

Bringing a motorcycle in from out of state can be exempt if you hold a valid title from another state or a branch of the U.S. Armed Forces and one of two things is true: you’ve owned the motorcycle for more than 12 months, or you’ve owned it for less than 12 months and can show you paid sales tax to the other state.4Virginia Code Commission. Virginia Code 58.1-2403 – Exemptions Own it under 12 months with no proof of tax paid elsewhere, and Virginia will charge the full SUT based on fair market value at registration.

Government and Emergency-Service Use

Motorcycles sold to or used by federal, state, or local government are exempt, along with those registered to qualifying volunteer fire departments or emergency medical services agencies.5Virginia Department of Motor Vehicles. SUT Exempt Transaction Guidelines

The Disabled Veteran Exemption Does Not Apply

Virginia’s disabled veteran vehicle tax exemption specifically excludes motorcycles, trailers, mopeds, and autocycles.5Virginia Department of Motor Vehicles. SUT Exempt Transaction Guidelines Qualifying for that program on a car doesn’t carry over to a bike.

When and How You Pay

The tax is due at the moment of titling, not on a later filing deadline. Bring your paperwork to a DMV customer service center and the tax is collected before the title is issued. You can pay by check, money order, or credit card, and the certificate of title typically arrives by mail within a few weeks.

If you bought from a Virginia dealer, the dealer usually handles titling and tax payment as part of the transaction. For private sales and out-of-state purchases, you handle it yourself. Riding an untitled motorcycle on Virginia roads creates legal exposure beyond the unpaid tax, so don’t let it sit.
