Virginia Rejection Sticker Rules: 15-Day Limit, Reinspection, and Penalties

Under Virginia’s rejection sticker rules, a failed safety inspection gets you a rejection sticker that acts as a temporary stand-in for an approval sticker for 15 calendar days. During that window you can drive the vehicle, you’re shielded from equipment-violation charges for the documented defects, and you have a cheap path back to the same station for reinspection once the repairs are done.1Virginia Code Commission. Virginia Code 46.2-1158 – Frequency of Inspection; Scope A vehicle can only hold one rejection sticker at a time, and a station cannot issue a new one to a vehicle that already carries one or shows evidence of having had one.2Virginia Code Commission. 19VAC30-70-60 – Rejection Stickers

What the Sticker Protects You From

For 15 calendar days after the inspection date, the rejection sticker stands in for an approval sticker and places no travel restrictions on the vehicle.2Virginia Code Commission. 19VAC30-70-60 – Rejection Stickers The statute goes further: during that window you cannot be charged with a vehicle equipment violation under Articles 3 through 9 of the motor vehicle code for the defects the inspector documented.1Virginia Code Commission. That shield has real limits. It covers the fix-it ticket, not the consequences of driving on a known hazard. If a documented brake defect causes a crash during those 15 days, you are still civilly responsible for the harm, and the rejection sticker itself becomes evidence that you knew the brakes were bad.2Virginia Code Commission. 19VAC30-70-60 – Rejection Stickers The 15 days are for arranging repairs, not for extending the life of unsafe equipment.

When the 15 Days Run Out

Once the sticker expires, two things change at once. You lose the equipment-violation shield, and you lose access to the discounted reinspection. Any station that inspects a vehicle with an expired rejection sticker must perform a complete inspection and may charge the full inspection fee.1Virginia Code Commission. Virginia Code 46.2-1158 – Frequency of Inspection; Scope From that point on you’re also exposed to a traffic summons for driving without a valid inspection.

Reinspection: Same Station vs. Different Station

Where you take the vehicle for reinspection matters, and the difference is substantial.

Back to the Original Station

Returning within the 15-day window to the station that rejected the vehicle is the fastest and cheapest route. The inspector only has to recheck the items that originally failed, unless a new obvious defect has appeared in the meantime. The station can charge no more than $1 for this reinspection.3Virginia Code Commission. Virginia Code 46.2-1167 – Charges for Inspection and Reinspection You get a maximum of two reinspections at that station during the validity period.2Virginia Code Commission. 19VAC30-70-60 – Rejection Stickers

If a new defect turns up during reinspection, the vehicle won’t get an approval sticker until that one is fixed too. Burning both tries by coming back with the brake pads sorted but a tail light newly cracked is a common way to lose the cheap-reinspection option. Fix everything before you go back.

A Different Station

You can take the vehicle elsewhere, but the second station must perform a complete inspection of the entire vehicle, not just the originally failed items.2Virginia Code Commission. 19VAC30-70-60 – Rejection Stickers The full inspection fee applies: up to $20 for a standard passenger vehicle, or up to $51 for a tractor truck, a truck rated at 26,000 pounds or more, or a bus seating more than 15 passengers.3Virginia Code Commission. Virginia Code 46.2-1167 – Charges for Inspection and Reinspection

If the original rejection involved brakes, there’s an extra wrinkle. When the new inspector cannot tell which wheels were pulled during the first inspection, all four wheels have to come off to confirm every brake defect was addressed.2Virginia Code Commission. 19VAC30-70-60 – Rejection Stickers Bringing repair receipts that identify which wheels were serviced can save time and money.

Don’t Peel the Sticker Off

Neither you nor a mechanic may remove a valid or expired rejection sticker unless the vehicle has passed all inspection requirements.2Virginia Code Commission. 19VAC30-70-60 – Rejection Stickers Removing an expired sticker to start fresh at a new station doesn’t work either, because the regulation bars any station from issuing a new rejection sticker to a vehicle that shows evidence of having previously received one. The only legitimate way to clear the sticker is to pass inspection.

Penalties for Driving Without a Valid Inspection

Driving with an expired rejection sticker, or with no sticker at all, is a traffic infraction.4Virginia Code Commission. Virginia Code 46.2-1158.02 – Penalty for Failure to Have Motor Vehicle Inspection The maximum fine matches a Class 4 misdemeanor, up to $250.5Virginia Code Commission. Virginia Code 46.2-113 – Violations of This Title; Penalties

There is a meaningful escape valve. A court has the discretion to dismiss the summons if you can show the defects have been corrected or that you’ve come into compliance with the inspection requirement after the ticket was issued.4Virginia Code Commission. Virginia Code 46.2-1158.02 – Penalty for Failure to Have Motor Vehicle Inspection Passing inspection before the court date is the strongest version of that showing.

If You Think the Rejection Was Wrong

Start with the station’s manager or owner. If that doesn’t resolve the dispute, the Virginia State Police supervising trooper assigned to that station is the next step and can decide whether the rejection followed proper inspection criteria.6Virginia Code Commission. 19VAC30-70-10 – Official Inspection Station Requirements

Formal complaints use Form SP-164 (Inspection Station Complaint/Report), which captures the vehicle details, the inspection in question, and the nature of the dispute. An Area Supervisor reviews the complaint, and it can be escalated further within the State Police.7Virginia Department of Motor Vehicles (DMV) – Regulatory Information System (RIS). Inspection Station Complaint/Report (Form SP-164) A station found to have violated inspection rules can face license suspension, suspension of the inspector’s certification, or court action.6Virginia Code Commission. 19VAC30-70-10 – Official Inspection Station Requirements

Filing a complaint does not extend your 15-day window. If the review drags on, the sticker will expire on its own schedule. One practical option is to take the vehicle to a different station for a fresh complete inspection while the complaint sits. A passing inspection there resolves the problem regardless of how the complaint ends.
