Virginia Sales Tax on Cars: Rates, Exemptions, and Penalties

Virginia sales tax on cars is a 4.15% Motor Vehicle Sales and Use Tax (SUT) applied to every vehicle purchase, with a $75 minimum. The tax is calculated on the gross sale price or the vehicle’s NADA trade-in value, whichever is higher, and it applies whether you buy from a dealer, from a private seller, or bring a car in from another state.1Virginia Department of Motor Vehicles. How the Tax Is Calculated

Multiply the gross sales price by 4.15%. A $30,000 car generates $1,245 in SUT. On a very cheap vehicle, the $75 floor still applies.2Virginia Department of Motor Vehicles. DMV Fees

“Gross sales price” is the total you pay, dealer processing fee included. Trade-in credits, unpaid liens, and other price reductions come out of that figure before the tax is calculated.1Virginia Department of Motor Vehicles. Motor Vehicle Sales and Use Tax Buy a $25,000 car, trade in a vehicle worth $7,000, and you pay 4.15% on $18,000, roughly $290 less than you’d pay without the trade. Dealer Purchases vs. Private Sales

At a dealership, the dealer calculates the SUT, collects it as part of your paperwork, and remits it to the DMV. You don’t touch the math.1Virginia Department of Motor Vehicles. Motor Vehicle Sales and Use Tax

In a private sale, you pay the SUT directly to the DMV when you title and register the car. The DMV compares your reported sale price against the National Automobile Dealers Association (NADA) trade-in value. If your price is more than $1,500 below NADA, you’ll need to submit an SUT-1A form explaining the gap. For vehicles more than five model years old, a handwritten bill of sale or a Vehicle Price Certification form may be accepted instead.1Virginia Department of Motor Vehicles. Used Cars

Used vehicles are taxed at the same 4.15% rate, on the sale price or NADA value, whichever is higher.1Virginia Department of Motor Vehicles. Motor Vehicle Sales and Use Tax This is the rule that surprises private-sale buyers. Even if the seller gave you a bargain, the DMV can tax you on NADA unless you can document why the car is worth less. A bill of sale that notes mechanical problems or high mileage is the usual way to support a lower price.

Leased Vehicles

If you lease, you don’t pay the full SUT upfront. The 4.15% is added to each monthly lease payment and spread across the term.1Virginia Department of Motor Vehicles. Out-of-State Purchases and New Residents

Buying in another state doesn’t get you out of Virginia’s SUT. When you title the car in Virginia, you owe 4.15% of the purchase price or NADA value, whichever is higher.1Virginia Department of Motor Vehicles. Motor Vehicle Sales and Use Tax

Virginia does credit sales tax you already paid the other state. If North Carolina charged you its 3% highway use tax, Virginia collects the 1.15% difference. Exemptions

Family Gifts

Vehicles gifted between spouses or between parents and children (in either direction) are exempt from the SUT.5Virginia Code Commission. Virginia Code 58.1-2403 – Exemptions The exemption doesn’t reach siblings, grandparents and grandchildren, aunts, uncles, or cousins. Those transfers are taxed on NADA market value. To claim the family gift exemption, the recipient signs a statement confirming no money was exchanged.

Inherited Vehicles

Revocable Living Trusts

Moving a vehicle between yourself and your own revocable living trust is not taxed, as long as the grantor and the trust beneficiary are the same person.7Virginia Code Commission. Virginia Code 58.1-811 – Exemptions

Active-Duty Military

Under the Servicemembers Civil Relief Act, active-duty members stationed in Virginia but legally domiciled elsewhere are protected from Virginia personal property taxes on their vehicles, and the protection extends to a servicemember’s spouse.8Office of the Law Revision Counsel. 50 USC 4001 – Residence for Tax Purposes The exemption does not apply if the vehicle is used in a trade or business in Virginia.

Nonprofits and Government Agencies

A federal 501(c)(3) status may support an SUT exemption, but Virginia’s retail sales tax exemption certificate does not work for vehicle purchases. Other Fees at Titling and Registration

The SUT is one line on the receipt. Plan for these as well:

  • Titling fee: $15 per vehicle.10Virginia Department of Motor Vehicles. Title Your Vehicle or Trailer
  • Annual registration: $30.75 for passenger vehicles up to 4,000 pounds, or $35.75 for vehicles between 4,001 and 6,500 pounds. Some localities add a local registration fee.2Virginia Department of Motor Vehicles. DMV Fees

These are separate from the SUT and due at the time you title and register.

Penalties for Underreporting or Evasion

The DMV will not issue a title or registration until the SUT is paid. If the DMV finds you underreported the purchase price, it reassesses at NADA value and adds interest and late fees.12Virginia Department of Taxation. Audits

Deliberate evasion is heavier. Falsifying a bill of sale or otherwise misrepresenting a transaction to reduce the tax is a Class 1 misdemeanor in Virginia, punishable by up to 12 months in jail and a fine of up to $2,500.13Virginia Code Commission.
