Virginia Small Estate Affidavit PDF: Form, Notarization, and Fees

The Virginia small estate affidavit PDF is a fillable form you can download from your local circuit court clerk’s office or county website, complete with the eight sworn statements required by Virginia Code § 64.2-601, have notarized, and present directly to the bank, brokerage, employer, or other institution holding the asset.1Dinwiddie County, Virginia. Small Estate Affidavit – Fillable The standardized forms circuit courts distribute include checkboxes for common asset types and blank fields for the required details, so the work is mostly a matter of confirming you qualify and filling the form in accurately.

Confirm You Qualify Before Filling Anything In

Every one of these conditions must be true before you use the affidavit:2Virginia Code Commission. Virginia Code 64.2-601 – Payment or Delivery of Small Asset by Affidavit

  • The decedent’s entire personal probate estate, wherever located, was worth no more than $75,000 at the date of death.
  • At least 60 days have passed since the date of death.
  • No one has applied for or been granted appointment as executor or administrator in any jurisdiction.
  • If the decedent left a will, it has already been admitted to probate.

The $75,000 cap counts only personal property that would pass through probate. Jointly held accounts, life insurance paid to a named beneficiary, and payable-on-death accounts don’t count because they never enter the probate estate.

Only a “successor” can sign and use the form. Virginia defines a successor as anyone other than a creditor who is entitled to the property under the will or, if there was no will, under Virginia’s intestacy rules.3Virginia Code Commission. Virginia Code 64.2-600 – Definitions Surviving spouses, children, and other statutory heirs qualify.

One boundary the form cannot cross: real property. Land and buildings can never be transferred by small estate affidavit, regardless of value.3Virginia Code Commission. Virginia Code 64.2-600 – Definitions If the decedent owned a house, you’ll need a different process for that title. The form does cover bank, savings, credit union, and brokerage accounts; securities; deposits; tax refunds and overpayments; tangible property like furniture or jewelry; instruments evidencing a debt; and motor vehicles (title transfers are handled through the DMV rather than the form’s holder).

What the PDF Asks You to Fill In

Section 64.2-601 requires the affidavit to contain eight specific statements. The fillable PDFs distributed by circuit courts track these one for one, so as you work through the form you’re really working through the statute:2Virginia Code Commission. Virginia Code 64.2-601 – Payment or Delivery of Small Asset by Affidavit

  • A statement that the total personal probate estate does not exceed $75,000.
  • A statement that at least 60 days have passed since the death.
  • Confirmation that no application for a personal representative is pending or granted anywhere.
  • If the decedent had a will, confirmation that it was duly probated.
  • The basis for the claiming successor’s entitlement to the asset: surviving spouse, beneficiary under a will, or heir under intestacy law.
  • Names and addresses of all successors, to the extent known.
  • The name of the specific person designated to receive the asset on behalf of all successors.
  • An acknowledgment that the designated successor accepts a fiduciary duty to safeguard the asset and promptly distribute it to the other successors as required by law.

Alongside those statements, you’ll describe the specific asset in enough detail for the holder to identify it: an account number for a bank account, a description for tangible property, a check number for an uncashed check. The form typically provides checkboxes for common asset categories with blanks for the identifying details.1Dinwiddie County, Virginia. Small Estate Affidavit – Fillable

All known successors must sign. Because the document is sworn, accuracy matters. Overstating your entitlement, misrepresenting the estate value, or leaving out a known successor exposes you to legal liability.

If the Single Asset Is Worth $35,000 or Less

Under § 64.2-602, when an individual asset is worth $35,000 or less, the holder is permitted to release it to a successor without any affidavit, as long as the 60-day wait has passed and no personal representative has been appointed.4Virginia Code Commission. Virginia Code 64.2-602 – Payment or Delivery of Small Asset Valued at $35,000 or Less Without Affidavit The word is “may,” not “must.” In practice, many banks still ask for the affidavit even at smaller amounts because it gives them documented protection, so bring one either way.

Notarize It, Then Present It

The statute doesn’t spell out notarization, but an affidavit is by definition a sworn statement, and every standard Virginia form includes a notary block. Banks and brokerages will almost always refuse an un-notarized copy. Sign in front of the notary, not before. Virginia caps notary fees at $10 for a paper document and $25 for an electronic one.5Virginia Code Commission. Virginia Code 47.1-19 – Fees Many banks and shipping stores offer notary services at or below those caps.

Present the original notarized affidavit to whoever holds the asset. Under § 64.2-601, a holder receiving a valid affidavit “shall pay or deliver” the asset to the designated successor. That language is mandatory.2Virginia Code Commission. Virginia Code 64.2-601 – Payment or Delivery of Small Asset by Affidavit Section 64.2-603 separately protects the holder: anyone who releases an asset based on a valid affidavit is “discharged and released to the same extent as if that person dealt with the personal representative of the decedent.”6Virginia Code Commission. Virginia Code 64.2-603 – Discharge and Release of Payor Most transfers go through within a few business days.

For a vehicle, take the affidavit to the DMV along with a certified or notarized death certificate, the title (or an application for a replacement), and proof of your address; the DMV, not the affidavit’s holder, handles the title change.7Virginia Department of Motor Vehicles. If a Bank Refuses to Comply

Sometimes a bank employee is simply unfamiliar with the statute. Ask to speak with a branch manager or the legal department, and bring printed copies of § 64.2-601 and § 64.2-603 to the conversation. If that fails, § 64.2-603 gives you the right to bring a court proceeding to compel delivery and recover damages on proof of your rightful claim.6Virginia Code Commission. What You Owe After You Collect

Signing the form makes you a fiduciary. You have a legal obligation to safeguard the asset and promptly distribute it to any other successors entitled to a share.2Virginia Code Commission. Virginia Code 64.2-601 – Payment or Delivery of Small Asset by Affidavit Keep funds that belong to a sibling or other heir and you are personally liable.

Legitimate debts also don’t disappear when an estate skips formal probate. Virginia Code § 64.2-528 sets the order in which the decedent’s debts must be paid, starting with administration costs, family allowances, and funeral expenses (capped at $5,000), then federal priority debts and taxes, final medical expenses (capped at $4,000 per hospital or nursing facility and $550 per individual provider), state debts and taxes, fiduciary debts, child support arrearages, local government debts, and finally everything else on equal footing.8Virginia Code Commission. Virginia Code 64.2-528 – Order in Which Debts and Demands of Decedents to Be Paid The affidavit form asks whether anyone is entitled to payment for funeral expenses or taxes for exactly this reason. Distribute funds to heirs while ignoring legitimate debts and you can be held responsible for the unpaid obligations.

One task the affidavit itself doesn’t mention: the final federal income tax return. With no court-appointed personal representative, the person in charge of the property files and signs it, signing as “personal representative.” If the return produces a refund, attach IRS Form 1310 (Statement of Person Claiming Refund Due a Deceased Taxpayer). The return covers income earned through the date of death and follows the normal individual deadlines.9Internal Revenue Service. Filing a Final Federal Tax Return for Someone Who Has Died

When the Form Won’t Work

If the personal probate estate exceeds $75,000, the affidavit is not available and you’ll need to open a formal probate case with the circuit court clerk in the jurisdiction where the decedent lived. The court appoints a personal representative, who files an inventory of probate assets within four months and submits annual accountings to the Commissioner of Accounts.10Virginia State Bar. What It Costs

A certified copy of the death certificate from the Virginia Department of Health is $12 per search.11Virginia Department of Health. Online Application for a Vital Record Notarization is capped at $10 (paper) or $25 (electronic).5Virginia Code Commission. Virginia Code 47.1-19 – Fees A vehicle transfer carries the DMV’s own title and registration fees. There are no court filing fees. That’s the whole point of using the form.
