Why Your Refund May Be Smaller Than Expected

The usual reason is a debt offset under Virginia’s Setoff Debt Collection Act, Virginia Code sections 58.1-520 through 58.1-535. The state can redirect part or all of your refund to cover debts owed to government agencies, including delinquent child support, unpaid court fines, overdue state agency debts, and delinquent local taxes. The IRS is also a claimant agency, so outstanding federal tax debt can absorb your Virginia refund.6Virginia Code Commission. Code of Virginia – Article 21 Setoff Debt Collection Act

If your refund is offset, you’ll get a written notice naming the agency that claimed the money and the amount taken. Anything left over is sent to you normally.

Offsets aren’t the only cause. The Department of Taxation may also adjust a return for math errors, missing schedules, or credits that weren’t fully documented, which can reduce the refund or trigger a request for more information before any money is released.

How to Dispute an Offset

You have 30 days from the date of the offset notice to send a written hearing request to the claimant agency. Miss the 30 days and the offset becomes final.7Virginia Code Commission. Code of Virginia 58.1-526 Hearing Procedure Once you request a hearing, collection through the offset pauses until the agency issues a decision. If the claimed amount turns out to be wrong, the agency adjusts it at the hearing.

If you lose and still believe the offset is wrong, you have 30 days after the final decision to appeal in the circuit court where you live or where the claimant agency’s main office is located. For debts claimed by the IRS, the dispute follows federal procedures rather than Virginia’s hearing process.6Virginia Code Commission. Code of Virginia – Article 21 Setoff Debt Collection Act
