Virginia Unemployment Tax Withholding: Federal and State Rates

Virginia unemployment tax withholding is voluntary at both the federal and state levels: the IRS allows a flat 10 percent of each payment to be withheld for federal income tax, and the Virginia Employment Commission lets you elect separate state withholding through its online portal.1Office of the Law Revision Counsel. 26 U.S.C. 3402 – Income Tax Collected at Source Nothing is withheld unless you ask for it. Skip the election and the tax doesn’t disappear; it waits for you at filing time, sometimes with penalties attached.

Why Withholding Matters for Unemployment Benefits

Unemployment compensation is gross income under federal law, which means every dollar you receive is added to your taxable income for the year, the same as wages.2Office of the Law Revision Counsel. 26 U.S.C. 85 – Unemployment Compensation There is no exemption and no threshold below which benefits become tax-free.

Virginia taxes those same dollars because the state return starts from your federal adjusted gross income. Benefits are already inside that federal number, and Virginia’s list of subtractions does not include unemployment compensation, so the amount flows straight through to your state taxable income.3Virginia Tax. Additions You owe tax at both levels on every check.

Unlike an employer paycheck, nothing is deducted up front. If you want to spread the tax bill across the year the way payroll withholding does, you have to tell the VEC to do it.

Federal Withholding: Flat 10 Percent

The federal rate for voluntary withholding from unemployment compensation is fixed by statute at 10 percent of each payment.1Office of the Law Revision Counsel. 26 U.S.C. 3402 – Income Tax Collected at Source You cannot ask for 12 percent, or 8 percent, or any custom figure. It is 10 or nothing.

That number matches the lowest federal bracket, so if other income pushes your marginal rate higher, 10 percent withholding alone will not cover your full federal liability. You can close the gap by increasing withholding at a wage job, by making estimated quarterly payments, or by setting money aside yourself.

Virginia State Withholding

Virginia withholding is a separate election from the federal one, handled by the VEC. Virginia’s individual income tax is graduated, running from 2 percent on the first $3,000 of taxable income up to 5.75 percent on income above $17,000. What you actually owe at year-end depends on your total income from every source, not just benefits, so withholding is an estimate rather than a precise match.

How to Set Up or Change Withholding

The quickest route is the VEC’s Claimant Self-Service portal. Log in, open your benefit profile, and update the federal and state withholding elections directly. Changes usually take effect within one or two payment cycles. The same screen lets you turn withholding off if you later decide to handle the tax a different way.

If you prefer not to use the portal, the VEC also accepts withholding requests by fax or mail. Whichever method you choose, pull up your payment history after a cycle or two and confirm the correct amounts are coming out before assuming it worked.

If You Skip Withholding

Opting out is a legitimate choice, but you need a plan. Estimated quarterly payments are the standard alternative, and the thresholds that trigger them are low.

Federally, the IRS generally expects estimated payments when you will owe $1,000 or more after subtracting withholding and refundable credits.5Internal Revenue Service. Underpayment of Estimated Tax by Individuals Penalty Virginia’s threshold is far lower: you need estimated payments or additional withholding if your state tax liability after credits and withholding will exceed $150.6Virginia Tax. Individual Estimated Tax Payments

Missing those payments carries real cost. The federal underpayment penalty is calculated like interest, applying the rate from IRC Section 6621 to the amount you should have paid for the period you were late.7Office of the Law Revision Counsel. 26 U.S.C. 6654 – Failure by Individual to Pay Estimated Income Tax If a balance is still unpaid when you file, the separate failure-to-pay penalty accrues at 0.5 percent per month on the unpaid balance, up to a maximum of 25 percent.8Internal Revenue Service. Failure to Pay Penalty Virginia adds its own addition to tax if you do not pay at least 90 percent of your state liability through withholding or estimated installments during the year.6Virginia Tax. There are safe harbors. You can avoid the federal penalty by paying at least 90 percent of this year’s tax or 100 percent of last year’s tax, whichever is smaller. Virginia’s safe harbor works similarly: basing each installment on last year’s full liability satisfies the requirement, provided the prior return covered a full 12-month year.6Virginia Tax. What Shows Up at Tax Time

The VEC issues Form 1099-G by the end of January each year to every person who received unemployment benefits during the prior calendar year. The form reports total benefits paid along with any federal and state taxes withheld. You can download it from the VEC portal or wait for a mailed copy.9Internal Revenue Service. About Form 1099-G, Certain Government Payments

On your federal return, the benefit amount goes on line 7 of Schedule 1 (Form 1040), which feeds into total income.4Internal Revenue Service. Topic No. 418, Unemployment Compensation On your Virginia return the amount is already inside your federal adjusted gross income, so no separate add-back is needed. Any tax you had withheld shows up as a credit on the respective returns, reducing or eliminating a balance due. Before filing, reconcile the 1099-G against your own payment history in the portal; if the numbers do not match after you check them, contact the VEC for a corrected form.
