Virginia Vape Laws: Age, Taxes, and Retailer Rules

Virginia vape laws set 21 as the minimum age to buy or possess any vapor product, tax liquid nicotine at $0.11 per milliliter, and require every retailer to hold a dedicated state license. As of December 31, 2025, a manufacturer’s product must also appear on a state-maintained directory before a Virginia store can legally sell it. Federal FDA rules apply on top of all of this.

You Must Be 21 to Buy or Possess

Under Virginia Code 18.2-371.2, no one may sell or distribute a retail tobacco product to anyone under 21, and no one may buy one for a minor.1Virginia Code Commission. Virginia Code 18.2-371.2 – Prohibiting Purchase or Possession of Retail Tobacco Products and Hemp Products Intended for Smoking by a Person Under 21 Years of Age The statute’s definition of a retail tobacco product is broad: electronic smoking devices, any substance that can be aerosolized or vaporized (with or without nicotine), and components like batteries, cartridges, and coils are all covered.

Retailers have to check a government-issued photo ID showing the buyer’s picture and date of birth before completing a sale. A driver’s license or equivalent is specifically required by statute.1Virginia Code Commission. Virginia Code 18.2-371.2 – Prohibiting Purchase or Possession of Retail Tobacco Products and Hemp Products Intended for Smoking by a Person Under 21 Years of Age The state age matches the federal Tobacco 21 law, which the FDA enforces with no carve-outs for active-duty military or veterans between 18 and 20.2FDA. Penalties Fall Hardest on Sellers

A retailer or clerk who sells to someone under 21 faces a $500 civil penalty on the first violation at a location. A second or later violation within three years jumps to $2,500, and the Department of Taxation may suspend or revoke the store’s license to sell nicotine products.1Virginia Code Commission. Virginia Code 18.2-371.2 – Prohibiting Purchase or Possession of Retail Tobacco Products and Hemp Products Intended for Smoking by a Person Under 21 Years of Age Losing the license can end a small shop’s business.

For a person under 21 caught with a vape, the law is narrower than most expect. An officer may seize the product as contraband, and that seizure is the only penalty the statute provides. No fine, no community service, no criminal charge for possession alone.3Virginia Code Commission. Where You Can and Can’t Vape

This surprises people. The Virginia Indoor Clean Air Act bans smoking in places like schools, daycare centers, elevators, public transit, restaurants, and government buildings, but it defines “smoking” as carrying or lighting a pipe, cigar, or cigarette. That definition does not cover electronic cigarettes or vapor products.4Virginia Code Commission. Virginia Code 15.2-2820 – Definitions Unlike many states, Virginia has not amended its clean air law to include vaping.

That gap doesn’t mean vaping indoors is open season. Individual businesses, employers, and local governments set their own rules, and most restaurants, offices, and public buildings post no-vaping policies you’re bound to follow as a condition of being there. Violations of the actual smoking restrictions under the Clean Air Act carry a civil penalty of no more than $25, and only after someone continues smoking after being asked to stop.5Virginia Code Commission. Flights Are a Firm No

Federal law prohibits vaping on any commercial flight. Under 49 U.S.C. 41706, using an electronic cigarette is treated the same as smoking on passenger aircraft in both domestic and international air transportation, and the statute defines electronic cigarette to include any device delivering nicotine in vapor form.6Office of the Law Revision Counsel. 49 USC 41706 – Prohibitions Against Smoking on Passenger Flights FAA civil penalties can reach tens of thousands of dollars.

The Tax on Liquid Nicotine

Virginia taxes liquid nicotine at $0.11 per milliliter. The rate took effect July 1, 2024, and applies to both pre-filled pods and bottled vape juice.7Virginia Department of Taxation. Tobacco Products Tax The tax is collected from distributors at wholesale, but retailers build it into shelf prices, so consumers pay it in the end.

The underlying code splits closed-system products (like pre-filled cartridges) at $0.066 per milliliter and open-system liquid nicotine at 10 percent of the wholesale price.8Virginia Code Commission. Virginia Code 58.1-1021.02 – Tax on Tobacco Products and Liquid Nicotine Budget legislation overrode that structure and set a single rate of $0.11 per milliliter starting July 1, 2024.9Legislative Information System. Retailer Licensing

Any business selling liquid nicotine or nicotine vapor products in Virginia needs a Liquid Nicotine and Nicotine Vapor Products License from the Department of Taxation. The application fee is $400. Every officer, director, sole proprietor, partner, or anyone owning 10 percent or more of the business must pass a criminal background check, and follow-up background checks cost $100 each.10Virginia Department of Taxation. Liquid Nicotine and Nicotine Vapor Products License

Operating without the license can trigger a penalty of up to $400 for each unlicensed location, and the license has to be displayed prominently at each store.10Virginia Department of Taxation. Liquid Nicotine and Nicotine Vapor Products License The underage-sale penalties described above sit on top of this, and repeat violations can cost a shop its license.

The New Vapor Products Directory

Starting December 31, 2025, manufacturers of liquid nicotine and nicotine vapor products have to register with the Virginia Attorney General’s office. Any product not listed on the state-maintained directory cannot legally be sold at retail in Virginia, including through online orders shipped into the state.10Virginia Department of Taxation. Liquid Nicotine and Nicotine Vapor Products License

A manufacturer that fails to register faces civil penalties of $1,000 per day until it does, and retailers who sell unlisted products also risk per-product daily penalties.10Virginia Department of Taxation. Liquid Nicotine and Nicotine Vapor Products License For consumers, the practical effect is that some brands and flavors may disappear from Virginia shelves if their manufacturers don’t register.

Online Orders and Delivery Sales

Virginia allows online sales, with guardrails. A retailer cannot ship a delivery sale without holding the state license. Before shipping, the retailer has to make a good-faith effort to verify the buyer’s age using independent age verification software that cross-checks public records against what the buyer entered at checkout.11Virginia Code Commission. Virginia Code 58.1-1021.06 – Delivery Sales of Liquid Nicotine and Nicotine Vapor Products

Payment has to come from an account in the buyer’s own name, whether by check, credit card, or debit card, and the retailer must be paid in full before shipping.11Virginia Code Commission. Virginia Code 58.1-1021.06 – Delivery Sales of Liquid Nicotine and Nicotine Vapor Products The rules are designed to keep minors from using someone else’s payment method to sidestep in-store ID checks.

Packaging and Warning Labels

Virginia’s state-level child-resistant packaging requirement for retail sale of liquid nicotine, under Virginia Code 59.1-293.11, expired on July 1, 2024, by its own terms once federal packaging rules took effect.12Virginia Code Commission. Virginia Code Chapter 23.2 – Retail Tobacco Products and Nicotine Vapor Products Federal requirements remain in force: the FDA mandates a warning stating “This product contains nicotine. Nicotine is an addictive chemical,” and child-resistant packaging for liquid nicotine still applies under the Child Nicotine Poisoning Prevention Act.

FDA Authorization Is Still Required

Every vapor product sold in the United States, Virginia included, needs a marketing order from the FDA. Without written authorization, a product is considered adulterated and misbranded under federal law and can be seized or removed from the market.13Food and Drug Administration. Premarket Tobacco Product Marketing Granted Orders This includes products with synthetic nicotine, after Congress clarified the FDA’s authority in April 2022.14Food and Drug Administration. Regulation and Enforcement of Non-Tobacco Nicotine (NTN) Products

The state’s new directory adds a second layer. A product can be federally authorized and still illegal to sell in Virginia if its manufacturer hasn’t registered with the Attorney General’s office.
