Washington Divorce Laws: Property, Parenting, and Maintenance

Washington divorce laws let either spouse end a marriage without proving fault, treat most property acquired during the marriage as jointly owned, and require a 90-day waiting period before a judge can sign the final order. The court calls the case a “dissolution of marriage,” but it works the way most people mean when they say divorce. At least one spouse must live in Washington (or be a service member stationed here) when the case is filed, and the only ground you need to state is that the marriage is irretrievably broken.

Who Can File in Washington

You can file in Washington if you or your spouse lives in the state at the time the petition is filed.1Washington State Legislature. RCW 26.09.030 – Petition for Dissolution of Marriage or Domestic Partnership Members of the armed forces stationed in Washington qualify, as do their civilian spouses. There is no minimum residency period. You just have to be a resident on the day you file.

The only legal basis for divorce is that the marriage is “irretrievably broken.” You state that under oath; you don’t have to allege adultery, abandonment, or cruelty.2Washington State Administrative Office of the Courts. DV Manual for Judges – Chapter 12 Dissolution of Marriage A spouse who disagrees cannot block the divorce. If one spouse contests, the court looks at the circumstances and prospects for reconciliation, but it can still enter the decree if it concludes the marriage is beyond repair.1Washington State Legislature. Filing, Serving, and the 90-Day Clock

You start the case by filing a Petition for Divorce with the Superior Court clerk. The filing fee is $364.3King County. Superior Court Clerk’s Office Fee and Payment Information If paying the fee would be a hardship, you can ask the court to waive it under General Rule 34. Along with the petition, each spouse files a Financial Declaration, a sworn summary of income, monthly expenses, assets, and debts.4Washington Courts. Financial Declaration It’s signed under penalty of perjury, so estimates should be clearly identified as such.

After filing, you have to formally deliver the petition and summons to your spouse. You cannot hand the papers over yourself. A process server, sheriff, or any adult who isn’t a party to the case can do it. The deadline to respond depends on how service happens:

  • 20 days if served in person inside Washington
  • 60 days if served in person outside Washington or by publication
  • 90 days if served by mail

Then the waiting period runs. Washington imposes a mandatory 90-day cooling-off window, measured from the later of the filing date and the date your spouse was served.1Washington State Legislature. RCW 26.09.030 – Petition for Dissolution of Marriage or Domestic Partnership No judge can sign final orders before those 90 days are up. If the two of you agree on everything, the case can close shortly after the window expires. Contested cases often take six months to a year or longer.

How Property and Debts Are Divided

Washington is a community property state. Property and debts acquired by either spouse during the marriage belong to both equally.5Washington State Legislature. Washington Code 26.16.030 – Community Property Defined – Management and Control Separate property, meaning what you owned before the marriage or received as a personal gift or inheritance during it, stays yours.6Washington State Legislature. RCW 26.16.010 – Separate Property of Spouse

The court divides the estate in a way that is “just and equitable,” which does not have to mean 50/50. The judge weighs four factors: the nature and extent of community property, the nature and extent of separate property, the length of the marriage, and each spouse’s economic circumstances when the division takes effect, including whether the parent with primary custody should keep the family home.7Washington State Legislature. RCW 26.09.080 – Disposition of Property and Liabilities The division is made “without regard to misconduct,” so an affair or other bad behavior does not shift the property split.

When Separate Property Gets Mixed In

Separate property can lose its protected character through commingling. If you deposit an inheritance into a joint checking account and spend from it alongside marital funds, or use separate savings to renovate the family home, tracing those dollars back to their source gets hard. When the court can’t reliably separate the strands, it may treat the whole asset as community property. Keeping separate funds in a dedicated account with clear records is the most reliable way to preserve them.

Retirement Accounts

Retirement benefits earned during the marriage are community property. Splitting an employer-sponsored plan governed by federal law, such as a 401(k) or pension, requires a Qualified Domestic Relations Order (QDRO). The QDRO identifies both spouses, names the plan, and states the dollar amount or percentage to be transferred to the non-employee spouse.8U.S. Department of Labor. QDROs – An Overview FAQs Without one, the plan administrator has no legal obligation to split the account, and skipping the step can mean forfeiting a significant asset. A QDRO can be built into the divorce decree or filed as a separate order.

Spousal Maintenance

Spousal maintenance, sometimes called alimony, is not automatic in Washington. The court has discretion over whether to award it, how much, and for how long, again without regard to marital misconduct. The statute lists six factors the judge must weigh: the requesting spouse’s financial resources and ability to meet their own needs, the time needed for that spouse to get education or training to become employable at a reasonable level, the standard of living during the marriage, the length of the marriage, the age and physical and emotional condition of the requesting spouse, and whether the paying spouse can meet their own needs while also paying.9Washington State Legislature. RCW 26.09.090 – Maintenance Orders for Either Spouse – Factors

Washington has no formula for maintenance the way it has for child support. Short-marriage awards tend to last just long enough for the lower-earning spouse to get on their feet. In long marriages where one spouse stepped back from a career for the family, awards can run for years or be indefinite.

Children: Parenting Plans and Support

Every divorce involving minor children ends with a court-approved parenting plan.10Washington State Legislature. RCW 26.09.181 – Procedure for Determining Permanent Parenting Plan The plan sets a residential schedule, assigns decision-making authority over education, healthcare, and religious upbringing, and establishes a process for resolving future disagreements without going back to court.

When parents can’t agree on terms, the court builds the plan from several factors, with the strongest weight placed on the quality and stability of each parent’s existing relationship with the child.11Washington State Legislature. RCW 26.09.187 – Criteria for Establishing Permanent Parenting Plan Other considerations include each parent’s history of daily caregiving, the child’s developmental and emotional needs, ties to siblings and school, and each parent’s work schedule. A history of domestic violence, substance abuse, or neglect forces the court to impose restrictions on that parent’s residential time and may rule out unsupervised contact.

Courts can send contested parenting disputes to mediation before scheduling a hearing.12Washington State Legislature. RCW 26.09.015 – Mediation Proceedings Mediation is waived when there’s domestic violence or when a parent can’t afford the cost. Counties are directed to offer reduced-fee or free mediation within the first year after filing.

Child support is calculated using the Washington State Child Support Schedule, which starts from both parents’ combined monthly net income.13Washington State Legislature. RCW 26.19 – Child Support Schedule The schedule produces a total support amount, and each parent’s share is proportional to their income. The obligation covers housing, food, clothing, and healthcare.

Unlike most states, Washington courts can also order a parent to contribute to a child’s college or vocational training costs. The judge weighs the parents’ own education, what they likely would have provided had the family stayed together, and the child’s academic ability and goals.14Washington State Legislature. RCW 26.19.090 – Standards for Postsecondary Educational Support Awards The child must be enrolled in an accredited program, keep up academic standing, and share records with the paying parent. Post-secondary support cannot extend past the child’s 23rd birthday except in cases of disability.

Temporary and Protective Orders While the Case Is Pending

The gap between filing and final orders can leave both spouses in financial limbo. Either party can file a Motion for Temporary Family Law Order asking the court to set short-term rules for child support, spousal maintenance, exclusive use of the family home, and payment of specific bills.15Washington State Courts. Court Forms – Temporary Family Law Order – Child Support

If safety is at stake, a separate emergency process exists. A spouse can request an ex parte restraining order, meaning the court can act the same day without notice to the other party, when necessary to protect someone’s safety.16Washington State Courts. Court Forms – Immediate Restraining Order A longer-lasting temporary restraining order, entered after a hearing with notice, can stay in place throughout the case and be extended in the final decree. The court can also order a spouse to surrender firearms to law enforcement.

If Your Spouse Won’t Respond or Can’t Be Found

If your spouse ignores the petition and the response deadline passes, you can file a Motion for Default and ask the court to proceed without them.17Washington State Courts. Court Forms – Default Once the default order is signed and the 90-day waiting period has run, the judge can enter final orders based on your petition alone. In practice, that means you generally get what you asked for, because the other side never appeared to argue otherwise. If more than a year has passed since service without a response, most courts require you to set a hearing and give your spouse fresh notice before entering default.

When you genuinely cannot find your spouse, the court may allow service by publication. You file an affidavit showing you used due diligence to locate them, including checking the last known address, workplace, and other likely leads, and came up empty.18Washington State Legislature. RCW 4.28.100 – Service of Summons by Publication – When Authorized If the judge is satisfied, notice runs in a newspaper in the county where the case was filed, and your spouse has 60 days from publication to respond.

Legal Separation Instead of Divorce

Legal separation is an alternative for people who aren’t ready, or willing on personal or religious grounds, to end the marriage. A separation divides property, sets support, and establishes a parenting plan the same way a dissolution does, but the marriage stays legally intact and neither spouse can remarry. If one spouse filed for dissolution but the court finds the marriage is not irretrievably broken and both parties agree, the court can enter a separation decree instead.1Washington State Legislature. RCW 26.09.030 – Petition for Dissolution of Marriage or Domestic Partnership Either spouse can later convert the separation into a full dissolution after six months.19Washington State Legislature. RCW 26.09.150 – Decree Finality – Conversion of Decree of Legal Separation

After the Decree

Once a judge signs the Findings and Conclusions along with the Final Divorce Order, the marriage is terminated and the obligations on property, support, and custody become binding.20Washington State Courts. Final Divorce Order – FL Divorce 241 The decree is enforceable immediately, though either party can appeal. Child support and spousal maintenance can be modified later if circumstances change substantially; the property division is generally permanent. Keep certified copies. You’ll need them to update titles, financial accounts, insurance policies, and government records.

If you changed your name when you married, you can ask the court to restore your prior name as part of the final order, and the court must grant that request.19Washington State Legislature. RCW 26.09.150 – Decree Finality – Conversion of Decree of Legal Separation The statute also lets the judge order a change to a different name, though that one is discretionary. Including the name request in your paperwork avoids a separate name-change case later.

Two federal pieces often need attention right after a Washington divorce. If your marriage lasted at least 10 years, you may qualify for Social Security benefits based on your ex-spouse’s work record once you’re 62 and currently unmarried, assuming you aren’t entitled to a higher benefit on your own record.21Social Security Administration. What Are the Marriage Requirements to Receive Social Security Benefits The benefit can be worth up to half of your ex-spouse’s full retirement amount, their own benefit isn’t reduced, and remarriage on their side doesn’t matter. On health insurance, a spouse covered under the other’s employer plan loses that coverage at the final decree. Federal COBRA rules let you continue coverage for up to 36 months, but you pay the full premium plus a 2% administrative fee with no employer subsidy, and you must notify the plan administrator within 60 days of the divorce or lose the right to COBRA entirely.22U.S. Department of Labor.
