West Virginia Divorce Laws: Grounds, Filing, and Support

West Virginia divorce laws allow both no-fault and fault-based filings, require that at least one spouse meet the state’s residency rule, presume that marital property is split equally, calculate child support from both parents’ combined income, and decide custody on the child’s best interests. The path is faster and cheaper when spouses agree; contested cases move through financial disclosures, possible mediation, and hearings before a family court judge.

Who Can File and Where

Residency comes first. If you were married in West Virginia, either spouse can file here as long as one of you currently lives in the state. If the marriage happened somewhere else, at least one spouse must have lived in West Virginia for a minimum of one year before filing.

Residency is about real ties, not just a mailing address. Courts look at voter registration, a West Virginia driver’s license, local employment, and where the children go to school. Moving to the state only to file for divorce, without genuine roots, risks having the court refuse jurisdiction.

Venue depends on where your spouse is. If your spouse lives in West Virginia, you file in the county where you last lived together or where your spouse currently lives. If your spouse lives out of state, you file in the county where you last lived together or where you now live.

Grounds for Divorce

No-fault is the simpler route. You can file on irreconcilable differences, meaning the marriage has broken down and reconciliation is unlikely, or on the basis that you and your spouse have lived separately for at least one year without resuming the relationship. Irreconcilable differences is generally the fastest ground because it needs no extra testimony beyond both parties acknowledging the breakdown.

Fault-based grounds require corroborating proof, which adds time and cost. West Virginia recognizes these grounds:

  • Adultery, shown through witness testimony, financial records, or communications.
  • Cruel or inhuman treatment, including physical abuse, severe emotional harm, or persistent neglect.
  • Habitual addiction to alcohol or drugs that caused real harm to the family.
  • Desertion for at least six months with no intention of returning.
  • Felony conviction with a penitentiary sentence.
  • Permanent and incurable insanity, with the spouse confined to a mental health institution for at least three consecutive years and medical documentation to support it.
  • Abuse or neglect of a child of the marriage or a stepchild.

Proving fault can sometimes influence how a court handles property division or spousal support, so there are strategic reasons to pursue it. Most filers choose no-fault.

If you are not ready to end the marriage but need court-ordered financial arrangements, West Virginia also offers separate maintenance, which can award the same financial relief as a divorce while leaving the marriage legally intact.1West Virginia Legislature. How the Filing Process Works

One spouse (the petitioner) files a divorce petition with the circuit court, along with a civil case information statement, a vital statistics form, and a financial statement. If you plan to request spousal support, you also file a form through the Bureau for Child Support Enforcement. A filing fee applies and varies by county. If you cannot afford it, a fee waiver form based on household income and assets can cover the filing fee, sheriff’s service costs, and most other court costs.

After filing, you must formally deliver the papers to your spouse (the respondent). West Virginia allows service by the sheriff for a $30 fee, by any private process server over 18 who is not a party to the case, by certified mail arranged through the clerk for a $20 fee with the respondent personally signing the return receipt, by the respondent voluntarily signing an acceptance of service before a notary, or by publication in a local newspaper when the respondent’s location is unknown or an out-of-state respondent refuses certified mail.2West Virginia Courts. The respondent has 20 days from delivery to file an answer, or 30 days from the first publication when service is by publication. Missing the deadline can lead to a default judgment.

Both spouses typically file financial disclosures listing assets, debts, income, and expenses. If you cannot agree on the major issues, the court may order mediation. Temporary hearings can address urgent matters such as support or custody while the case is pending. West Virginia has no mandatory waiting period before a final decree, though grounds like voluntary separation carry their own built-in time requirements.

Parent Education When Children Are Involved

If minor children are part of the case, both parents must complete a parent education program. It has to be finished before mediation or any other dispute resolution begins, and if no mediation is required, before the final hearing.3West Virginia Judiciary. Family Courts – Parent Education A judge can waive it only for good cause, stated on the record. Skipping it can pause the whole case.

How Property Gets Divided

West Virginia starts from a presumption of equal division. The statute directs courts to divide marital property equally between spouses.4West Virginia Legislature. West Virginia Code 48-7-101 – Equal Division of Marital Property That differs from the “equitable distribution” approach used in many other states, where equal is only a starting suggestion. Here, equal is the default and the court needs a reason to depart from it.

Marital property is anything acquired during the marriage regardless of whose name is on the title: real estate, bank accounts, retirement funds, vehicles, business interests, and the debts that go with them. Separate property, meaning what you owned before the marriage or received by inheritance or gift, stays with the original owner unless it got mixed with marital assets. Once you deposit an inheritance into a joint account or use it to renovate a marital home, tracing what belongs to whom gets complicated, and the court may treat some or all of it as marital.

When spouses reach a separation agreement, the court generally follows it. A court will reject the agreement only if it was obtained through fraud or duress, if its terms are too vague to enforce, or if it is so lopsided against each spouse’s actual contributions to the marriage that it defeats the point of fair division.5West Virginia Legislature. West Virginia Code 48-7-102 – Division of Marital Property in Accordance With a Separation Agreement Without an agreement, the court looks at each spouse’s financial and non-financial contributions, the length of the marriage, and each person’s economic circumstances going forward. A spouse who stayed home while the other built a career is not penalized for smaller direct financial contributions. Misconduct that depleted marital assets, like gambling or hiding money, can also weigh in.

Spousal Support

Spousal support is decided case by case. Unlike child support, there is no formula. The court weighs the financial gap between the spouses, how long the marriage lasted, each person’s earning capacity, and whether one spouse made career sacrifices for the other. West Virginia recognizes four types:

  • Rehabilitative support, the most common type, helps a lower-earning spouse get education or job training to become financially independent. It can be modified or extended if circumstances change substantially, or replaced with permanent support if self-sufficiency turns out to be unrealistic.6West Virginia Legislature.   • Permanent support, which is rare and typically limited to long-term marriages where a spouse cannot realistically become self-supporting due to age, disability, or health.
  • Temporary support, which provides stability while the divorce is pending and ends when the final decree is entered.
  • Lump-sum support, a single payment used when there are enough liquid assets to settle the obligation at once instead of spreading it over years.

Support can be modified later if circumstances change significantly, such as job loss, a substantial income increase, or remarriage. For any divorce decree entered after December 31, 2018, alimony payments are not tax-deductible for the payer and not counted as taxable income for the recipient under federal law.7Internal Revenue Service. Child Support

West Virginia uses an income shares model. Both parents’ gross monthly incomes are combined, a state table sets the base support obligation from that combined income and the number of children, and the obligation is split between the parents in proportion to what each earns.8West Virginia Legislature. Health insurance affects the calculation. The children’s health insurance premium is added to the base obligation and split proportionally. If the parent paying support is also carrying the policy, that premium is credited back to them after the total is calculated.9West Virginia Legislature. The West Virginia Bureau for Child Support Enforcement (BCSE) helps establish and enforce child support orders and can also help collect spousal support.10WV.gov. Bureau for Child Support Enforcement Enforcement tools for non-payment can include wage withholding, interception of tax refunds, and license suspension, depending on the circumstances.

Child Custody

Custody decisions come down to the child’s best interests. Courts look at each parent’s ability to provide a stable home, the child’s existing relationship with each parent, any history of domestic violence or substance abuse, and the child’s own preferences when the child is old enough to express them meaningfully.

The law separates two types of custody. Legal custody is decision-making authority over education, healthcare, and religious upbringing. Physical custody is where the child lives day to day.11West Virginia Legislature. West Virginia Code 48-20-102 – Definitions Courts generally favor joint arrangements that keep both parents involved, with schedules built around work and the child’s routine. Sole custody is reserved for situations where a parent is unfit due to abuse, neglect, addiction, or similar concerns, and the other parent usually still gets visitation unless safety risks make that inappropriate.

When parents cannot agree, the court may appoint a guardian ad litem, an attorney who independently investigates and represents the child’s interests. Custody orders are not permanent. Either parent can request a modification if circumstances change substantially, such as a relocation, a change in the child’s needs, or a shift in parental fitness.

Moving With a Child After a Custody Order

Relocation takes advance planning and court approval. A parent who wants to move must file a petition to modify the parenting plan at least 90 days before the planned move and serve the other parent at least 60 days in advance.12West Virginia Legislature. West Virginia Code 48-9-403 – Relocation of a Parent The court holds a hearing at least 30 days before the proposed move date.

The relocating parent must prove three things: the move is for a legitimate, good-faith reason; allowing the child to relocate serves the child’s best interests; and no less disruptive alternative exists. Legitimate reasons can include a significant job or educational opportunity, moving closer to immediate family, protecting safety, or joining a long-term partner who lives elsewhere. Ignoring the notice requirements can count against the relocating parent and lead to a reallocation of primary custody and an order to pay the other parent’s attorney’s fees.

Protective Orders During a Divorce

Protective orders and divorce cases often overlap, and West Virginia has specific procedures for handling that intersection. A protective order issued as part of a divorce uses the same standardized form as any other domestic violence protective order and gets entered into both the national domestic violence registry and the statewide database immediately.13West Virginia Judiciary. If a protective order is already in place when you file for divorce, notify the circuit clerk. The clerk issues an automatic extension notice so the protective order stays in effect while the divorce is pending, and that notice is filed in both cases. When the same parties are in both a protective order proceeding and a divorce, the courts consolidate them before a single family court judge to avoid conflicting orders.

Tax and Insurance Changes to Plan For

Your marital status on December 31 controls your federal filing status for the whole year. If the divorce is not final by then, the IRS still treats you as married, and your options are Married Filing Jointly or Married Filing Separately. There is one exception: you can file as Head of Household if you lived apart from your spouse for the last six months of the year, paid more than half the cost of maintaining your home, and had your child living with you for more than half the year.7Internal Revenue Service. Publication 504 – Divorced or Separated Individuals Head of Household comes with a larger standard deduction and more favorable brackets than Married Filing Separately, so it is worth checking whether you qualify.

Health insurance is the other pressing concern. If you are covered under your spouse’s employer plan, that coverage typically ends when the divorce is finalized. Under federal COBRA law, divorce is a qualifying event that lets a former spouse continue coverage for up to 36 months, but you pay the full premium yourself, without the employer subsidy. A marketplace plan during the Special Enrollment Period triggered by the divorce is often more affordable, and worth pricing before defaulting to continuation coverage.
