West Virginia Gambling Laws: Penalties, Taxes & Self-Exclusion

West Virginia gambling laws authorize seven forms of legal wagering — casino gaming, the state lottery, sports betting, online casino play, pari-mutuel wagering on horse and greyhound races, charitable bingo and raffles, and limited video lottery machines — all overseen by the West Virginia Lottery Commission. Anything outside those authorized channels is a misdemeanor, and every dollar you win, legal or not, is taxable at the state and federal level.

What’s Legal in West Virginia

Five licensed casinos operate in the state. Four are racetrack casinos (sometimes called racinos) running video lottery terminals under the West Virginia Racetrack Video Lottery Act, with table games authorized by the Racetrack Table Games Act.1West Virginia Lottery. Sports betting became legal in 2018 under the West Virginia Lottery Sports Wagering Act. Both retail sportsbooks inside the five casinos and licensed mobile apps are allowed, and every operator must be tied to a land-based casino.2West Virginia Legislature. Committee Substitute for Senate Bill 415

Online casino gaming followed in 2019 with the West Virginia Lottery Interactive Wagering Act at West Virginia Code Chapter 29, Article 22E. Players physically located in the state can play slots and table games through licensed websites and apps, each affiliated with one of the five casinos.3West Virginia Legislature. Pari-mutuel wagering on horse and greyhound racing is legal at the racetracks. West Virginia is the last state that still permits greyhound racing.

Age Requirements

The minimum age depends on the type of gambling.

Gambling underage or using a fake ID at a licensed facility can bring fines and a ban from the property.

Home Games and Social Gambling

The criminal gambling statutes are aimed at public gambling and commercial operations. West Virginia Code 61-10-4 penalizes gambling “at any hotel or tavern, or other public place, or place of public resort.”8West Virginia Legislature. West Virginia Code 61-10-4 That language has been read to leave room for casual private home games where nobody charges a fee or takes a cut of the pot. A poker night at your kitchen table, with everyone playing on equal terms, generally falls outside the criminal statutes. The moment someone rakes the pot or charges admission, it starts to look like an illegal gambling operation.

Penalties for Illegal Gambling

Penalties depend on whether you’re running the game or just playing in it.

Running an illegal operation is the most serious. West Virginia Code 61-10-1 punishes anyone who keeps or exhibits a gaming table, slot machine, or similar device with two to twelve months in jail and a fine of $100 to $1,000. Playing at an illegal table or betting in a public place carries a lighter sentence under Code 61-10-4: a $5 to $100 fine, with up to three months in jail if you fail to pay or post a good-behavior bond.8West Virginia Legislature. West Virginia Code 61-10-4

Simply betting money on a game of chance, even outside a formal gambling operation, is a misdemeanor under West Virginia Code 61-10-5 punishable by a fine of $5 to $300 and up to thirty days in jail.10West Virginia Legislature. West Virginia Code 61-10-5

Conspiring to commit any of these offenses adds another layer. Under West Virginia Code 61-10-31, a gambling conspiracy that would otherwise be a misdemeanor carries up to one year in jail and a fine of up to $1,000.11West Virginia Legislature. Beyond the criminal side, the Lottery Commission can revoke or suspend licenses, and courts can order forfeiture of gambling equipment and any proceeds from unlawful games.

Offshore and Unlicensed Online Sites

The state has licensed and regulated online sports betting and casino gaming, but offshore websites operating without a West Virginia license remain illegal. The federal Unlawful Internet Gambling Enforcement Act requires banks, card networks, and payment processors to have policies designed to identify and block transactions tied to unlawful internet gambling.12Federal Trade Commission. Taxes on Gambling Winnings

Every dollar you win gambling in West Virginia is taxable at both the state and federal level, whether the payer withholds on the spot or not.

State Withholding

West Virginia requires withholding on lottery prizes over $5,000 and backup withholding on other gambling winnings when federal backup withholding applies. After the income tax cuts enacted in 2023 and 2024, the state withholding rate on gambling winnings is 4.82% for 2026, down from 6.5%.14West Virginia Tax Division. Federal Withholding

Federally, winnings of $5,000 or more from lotteries, sports wagers, sweepstakes, and certain pari-mutuel pools trigger automatic 24% withholding, and the payer issues Form W-2G showing the amount won and any tax withheld.16Internal Revenue Service. Deducting Losses

Federal law allows a deduction for gambling losses, but only against gambling winnings and only if you itemize. Starting January 1, 2026, the One Big Beautiful Bill Act permanently caps the deduction at 90% of your losses. Win $10,000 and lose $10,000, and you still owe tax on $1,000 because only $9,000 of the losses are deductible. Professional gamblers are hit harder because business expenses like travel and tournament entry fees also count as gambling losses subject to the 90% cap.

Any deduction requires documentation. The IRS expects tickets, receipts, statements, and ideally a running diary of wins and losses.17Internal Revenue Service. Failing to report gambling income can bring penalties and interest from both the IRS and the West Virginia State Tax Department.

Self-Exclusion

The Lottery Commission operates a lifetime self-exclusion program. If gambling has become a problem, you can voluntarily place yourself on the state’s self-exclusion list, which bars you from gaming areas at licensed casinos and from interactive wagering. The exclusion is permanent. Licensees have to remove self-excluded individuals from their gaming areas, and the Commission can penalize any operator that knowingly lets a self-excluded person gamble.6West Virginia Legislature.
