West Virginia Gas Tax: Rates, EV Fees, and Refunds

The West Virginia gas tax is a two-part state charge that comes to at least $0.357 per gallon: a fixed excise of $0.205 plus a variable component equal to 5% of the average wholesale price of fuel, recalculated each January by the state Tax Commissioner. A federal excise of $0.184 per gallon on gasoline sits on top of that, so you pay at least $0.54 per gallon in combined taxes before any local charges. Diesel carries a higher federal rate of $0.244.

How West Virginia Builds Its Per-Gallon Rate

The state tax has two moving parts added together into one rate. The flat piece is $0.205 on every gallon, written into the statute and unchanged from year to year.1West Virginia Legislature. West Virginia Code 11-14C-5 – Taxes Levied; Rate

The variable piece is 5% of the “average wholesale price” of motor fuel. The Tax Commissioner reviews market data, publishes a single wholesale price figure, and that number holds for the whole calendar year. Five percent of it becomes the variable portion.1West Virginia Legislature. West Virginia Code 11-14C-5 – Taxes Levied; Rate

Two guardrails keep the variable piece from swinging too hard. The wholesale price used in the calculation cannot be set below $3.04 per gallon, no matter how cheap fuel gets on the open market, which puts a floor of $0.152 on the variable portion (5% of $3.04). It also cannot move more than 10% in either direction from one year to the next.1West Virginia Legislature. West Virginia Code 11-14C-5 – Taxes Levied; Rate

Add the $0.205 flat rate to the $0.152 floor and the combined state tax cannot drop below roughly $0.357 per gallon. The actual rate for the current year depends on the Commissioner’s wholesale price determination. The West Virginia Tax Division publishes the exact combined figure every January in its annual Motor Fuel Rates document on the agency’s website.2West Virginia Tax Division. Fuel Tax

You never see the two parts broken out on a gas station receipt. The split matters mainly for fuel distributors filing returns and for understanding why the rate shifts from year to year. When wholesale prices climb, the state collects more per gallon. When they fall, the $3.04 floor keeps revenue from collapsing.

The Federal Tax Added at the Pump

Every gallon sold in West Virginia also carries a federal excise tax that applies nationwide. For gasoline the federal rate is $0.184 per gallon, which includes a small fraction funding the Leaking Underground Storage Tank Trust Fund. For diesel the federal rate is $0.244 per gallon.3Congress.gov. Suspension of the Federal Gas Tax: In Brief

Stack that on the state’s minimum $0.357 and a gasoline buyer pays at least $0.54 per gallon in combined taxes. Diesel buyers pay about six cents more because of the higher federal diesel rate. Federal fuel taxes flow into the Highway Trust Fund, which pays for interstate highway and bridge projects and is separate from West Virginia’s own road fund.

Diesel and Alternative Fuels

Diesel sold for highway use is taxed under the same two-part state formula as gasoline. The difference drivers notice is on the federal side, where the diesel rate runs higher.

Compressed natural gas, liquefied natural gas, and propane follow the same flat-plus-variable structure, but the tax is measured per “gallon equivalent” to account for the different energy content of each fuel. The $0.205 flat rate applies per gallon equivalent, and a separate variable component is calculated from the average wholesale price of each alternative fuel.1West Virginia Legislature. West Virginia Code 11-14C-5 – Taxes Levied; Rate

One difference matters for alternative fuels: the $3.04 wholesale floor and the 10% annual cap apply only to conventional motor fuel, so the variable component on alternative fuels tracks actual market prices more closely. Propane sold for purposes other than powering a motor vehicle is exempt from the flat rate entirely.1West Virginia Legislature. West Virginia Code 11-14C-5 – Taxes Levied; Rate

Electric Vehicle Fees Instead of Fuel Tax

Drivers of all-electric vehicles buy no gasoline and therefore pay nothing through the fuel tax. West Virginia closes that gap with supplemental registration fees. An all-electric vehicle owes an extra $200 per year on top of standard registration. A plug-in hybrid pays an extra $100 per year.4West Virginia Legislature. West Virginia Code 17A-10-3C

Whether the amount feels fair depends on mileage. A driver covering 12,000 miles a year in a 30-mpg gasoline car would pay roughly $140 to $175 in state fuel tax, so the $200 EV fee runs high for moderate drivers and low for high-mileage ones.

When You Can Get the Fuel Tax Back

Not every gallon burns on a public road, and West Virginia provides refunds or outright exemptions for several non-highway uses. Some apply automatically at the point of sale; others require you to buy at the full taxed price and claim a refund afterward.5West Virginia Tax Division. Motor Fuel Tax Refund

Exempt at the Point of Sale

Aviation fuel, dyed diesel (used in off-road equipment), and propane sold for non-motor-vehicle purposes are exempt from the flat-rate component when you buy them. Fuel exported to another state where the supplier remits that state’s tax is exempt from both the flat and variable components.6West Virginia Legislature. Refund by Application

A longer list of users pays the full tax and then applies for a refund:

  • Government entities, including federal agencies, counties, municipalities, county boards of education, and civil defense programs.
  • Fuel burned in stationary turbine engines, boilers, or building heating systems.
  • Fuel for agricultural and industrial internal combustion engines not operated on public highways, including farm tractors and harvesting equipment, when purchased in quantities of 25 gallons or more.
  • Fuel for commercial watercraft and diesel locomotives.
  • Fuel used by power take-off units mounted on a truck, such as a cement mixer or hydraulic lift, when purchased in quantities of 25 gallons or more.
  • Fuel used as a dry cleaning solvent, industrial solvent, or ingredient in a manufactured product.

Government entities file on form MFR-14G; everyone else uses the standard refund application. Keep purchase receipts, equipment logs, and records showing how the fuel was used. Missing paperwork is the most common reason claims get denied on audit.5West Virginia Tax Division. Motor Fuel Tax Refund

Where Your Money Goes

West Virginia fuel tax revenue flows into the State Road Fund, a dedicated account used for highway construction, maintenance, and snow removal. The state’s “Good Roads Amendment,” adopted in 1928, set the constitutional foundation for dedicating road-related revenue to transportation. State law routes fuel tax collections to this fund rather than the general budget, keeping a direct line from the pump to the pavement.

The West Virginia Division of Highways manages spending from the fund, covering paving, bridge repairs, drainage work, and emergency road projects. The fund also supports secondary roads in rural counties that would otherwise struggle to maintain their infrastructure. How much is available in any year rises and falls with fuel consumption and the per-gallon rate the Tax Commissioner sets each January.
