To hunt legally in West Virginia, you need a valid license and any species-specific stamps, you must follow the season dates, weapon rules, blaze orange requirement, and tagging deadlines set by the West Virginia Division of Natural Resources (WVDNR), and you need written permission to hunt private land. The West Virginia hunting regulations below walk through each of those pieces in the order a hunter actually runs into them, from buying a license to checking in a harvest.
Licenses and Stamps You Need Before You Hunt
Residents aged 15 through 64 need a Class A base hunting and trapping license, which costs $19 per year. Nonresidents pay $119 for a Class E statewide license. Residents 65 and older qualify for the Class XS Senior Hunting, Trapping, and Fishing License at $10 per year.1WVDNR. License Guide
The base license alone usually isn’t enough. Species stamps stack on top of it:
- Bear hunters need a $10 Bear Damage Stamp (Class DS).
- Nonresidents hunting or trapping on national forest land need a $2 National Forest Stamp (Class D).
- Antlerless deer hunters need a Class N stamp.
- Class RG or RRG stamps allow an additional antlered deer during buck firearms season.
- Archery and crossbow hunters can buy up to two Class RB/RRB stamps for additional deer tags.2WVDNR. White Tail Deer FAQs
A few groups don’t need to buy a license at all. Landowners hunting on their own property are exempt, as are active-duty military personnel on leave in the state. Youth under 15 can hunt without a license if a licensed adult accompanies them.1WVDNR. License Guide
Apprentice License
If you want to try hunting before completing hunter education, apprentice licenses (Class AH, AHJ, AAH, and AAHJ) defer that requirement. You can hunt all legal species, but you must be accompanied and directly supervised by a licensed adult at least 18 years old, meaning close visual and verbal contact with the ability to take control of the firearm. You cannot buy an apprentice license if you have ever held a standard base hunting license in West Virginia.3West Virginia Legislature. West Virginia Code 20-2-42y – Class AH, AHJ, AAH, AAHJ Apprentice Hunting and Trapping Licenses
Hunter Education
Anyone born on or after January 1, 1975, must complete a certified Hunter Education Course before buying a base hunting license.4WVDNR. Hunter Education Course The course covers firearm and archery safety, hunting laws, wildlife management, ethics, game identification, and basic survival skills.
The WVDNR runs free in-person classes year-round, taught by volunteer instructors and natural resources police officers, usually about 12 hours long. Approved online courses are available for a fee through third-party providers, but the online route is two steps: finish the online coursework and quizzes, then attend an in-person hands-on and written exam session administered by the WVDNR. Once both steps are done, your hunter education card is issued and valid for life. The certification meets International Hunter Education Association standards, so other states recognize it.4WVDNR. Seasons, Bag Limits, and Sunday Hunting
The WVDNR sets season dates and bag limits each year based on population surveys and conservation data. Dates vary by species, region, and weapon type. White-tailed deer season typically opens with archery in late September, followed by multiple firearms seasons including the buck firearms season in late November. Turkey, bear, and small game all have their own designated periods, some split between fall and spring.
The statewide annual bag limit for antlered deer is two across all seasons combined, with one exception: hunters within the CWD Containment Area or Class XS license holders may take three. In nine select counties, you must harvest an antlerless deer before taking a second buck. Antlerless deer limits vary by county, and bear hunting has annual harvest caps enforced through the check-in system.2WVDNR. White Tail Deer FAQs
Turkey limits are generally one bearded bird in the spring and one either-sex turkey in the fall, though county rules can differ. The Mountaineer Heritage Season (January 8–11, 2026) allows one either-sex deer, one either-sex turkey, and one bear statewide. The youth spring turkey season for 2026 runs April 18–19.2WVDNR. Sunday Hunting
Sunday hunting is legal on private land with the landowner’s written consent, on federal land where hunting is permitted, in state forests, and on state-owned or state-managed wildlife lands.5West Virginia Legislature. West Virginia Code 20-2-5 – Hunting, Trapping and Fishing Regulated The private-land piece is the one people miss: the consent has to be in writing.
Blaze Orange
During any deer firearms or muzzleloader season, hunters must wear at least 400 square inches of blaze orange as an outer garment. This applies in any county where a deer firearms or muzzleloader season is open, even if you’re hunting something else. A blaze orange vest or jacket clears the 400-square-inch bar easily.6WVDNR. Hunting and Trapping Regulations Summary July 2025 – June 2026
Waterfowl hunters and farmers hunting on their own land are exempt. Bowhunters in designated bowhunting-only areas are also exempt.7WVDNR. Archery and Crossbow Seasons Guide
Legal Weapons and Ammunition
Weapon rules shift with the season and the game you’re after. Getting the caliber wrong isn’t only a ticket risk; it affects whether you make a clean harvest.
Rifles and Handguns
Any center-fire rifle is legal for deer. Rimfire rifles must be at least .25 caliber for deer, so .22 rimfire is out for big game but fine for small game and furbearers.8West Virginia Secretary of State. West Virginia Administrative Regulations – Deer Hunting Regulations Handguns used for deer, bear, or wild boar must fire a straight-walled cartridge of at least .357 magnum or a bottle-necked cartridge of at least .24 caliber. Muzzle-loading pistols must be at least .38 caliber.9Cornell Law School. West Virginia Code of State Rules 58-14-2 – General Small Arms Hunting Rules
Muzzleloaders
During the dedicated muzzleloader season, only single-shot muzzleloaders (including in-lines) with iron sights and a minimum caliber of .38 are legal for deer. Telescopic sights and double-barreled muzzleloaders are prohibited during this season.6WVDNR. Hunting and Trapping Regulations Summary July 2025 – June 2026 Muzzleloaders used outside the muzzleloader-specific season during general firearms season must be .44 caliber or larger.8West Virginia Secretary of State. West Virginia Administrative Regulations – Deer Hunting Regulations
Shotguns
Shotguns used for deer must be loaded with solid ball ammunition (slugs). Buckshot is not legal for deer.10WVDNR. 5 Common Questions About Buck Firearms Season Answered Waterfowl shooters must use nontoxic shot such as steel or bismuth under federal law.
Archery and Crossbows
Crossbows must have a minimum draw weight of 125 pounds and fire bolts or arrows at least 16 inches long, measured from the leading end of the shaft to the trailing end. Broadheads must have at least two sharp cutting edges and measure at least three-quarters of an inch wide.11West Virginia Legislature. West Virginia Code 20-2-5g – Use of a Crossbow to Hunt
Other Restrictions
Fully automatic firearms are banned for hunting. Legally owned suppressors may be used with the appropriate federal permits. Night vision and thermal imaging are prohibited for hunting game animals, with an exception for certain furbearers like coyotes, which can be hunted at night with artificial lights. Full metal jacket bullets are also banned because they don’t expand on impact.
Tagging and Electronic Game Check
Immediately after killing a deer, bear, wild boar, or turkey, you must either attach a completed field tag to the animal or have a completed tag on your person before moving the carcass from where it fell. The tag must include your name, address, license number (if applicable), and the time, date, and county of the kill. Once you reach your vehicle, camp, or home, the tag must be physically attached to the carcass and stay there until the animal is electronically registered.12West Virginia Legislature. West Virginia Code 20-2-22 – Tagging, Removing, Transporting and Reporting Bear, Deer, Wild Boar and Wild Turkey
Electronic game check deadlines by species:
- White-tailed deer: within 72 hours of harvest or 24 hours after the season ends, whichever comes first.
- Wild turkey: within 72 hours of harvest or 24 hours after the season ends, whichever comes first.
- Black bear: within 24 hours of harvest.
- Wild boar: within 24 hours of harvest.13WVDNR. How to Electronically Check Your Big Game in West Virginia
Baiting and CWD Zones
On public land, baiting or feeding any wildlife is illegal at any time. Private land outside the CWD Containment Area has looser rules, and hunters should check the current regulations summary before putting out any feed.6WVDNR. Hunting and Trapping Regulations Summary July 2025 – June 2026
Chronic Wasting Disease has been detected in the eastern panhandle. The CWD Containment Area currently covers eight counties: Berkeley, Grant, Hampshire, Hardy, Jefferson, Mineral, Morgan, and Pendleton.14WVDNR. WVDNR Announces Changes to CWD Containment Area Inside the containment area, baiting and feeding deer or other wildlife is illegal, period. The regulations define bait as any feed, edible enticement, or nonfood facsimile placed to attract wildlife, and an area is considered baited for 10 days after bait is removed.6WVDNR. Hunting and Trapping Regulations Summary July 2025 – June 2026
Grant County has carcass transportation restrictions preventing hunters from moving high-risk deer parts out of the area. Pendleton County has specific baiting and feeding restrictions as a proactive measure. The WVDNR offers free CWD testing for deer harvested in the containment area during all deer seasons, and hunters in these counties may be allowed to take three antlered deer instead of two.14WVDNR. Private Land, Permission, and Trespassing
Hunting on private land requires explicit permission from the landowner, posted signs or not. Unauthorized entry while hunting is a misdemeanor, and first-time violators face fines ranging from $100 to $500. Repeat offenders can be fined more and face up to six months in jail. Property damage during a trespass also triggers restitution liability.15West Virginia Legislature. West Virginia Code 20-2-57B
Discharging a firearm within 500 feet of an occupied building without the owner’s consent is illegal.15West Virginia Legislature. West Virginia Code 20-2-57B Hunting from or across public roads is also prohibited.
Purple Paint and Posted Land
Landowners can post property with traditional “No Trespassing” signs or with purple paint markings. A valid purple paint mark must be a vertical line at least eight inches tall and two inches wide, placed between three and six feet above the ground on permanent objects no more than 100 feet apart. Signs must also be posted at all roads, driveways, or gates entering the property.16Justia. West Virginia Code 61-3B-1 – Definitions Ignorance of the boundary isn’t a defense.
Migratory Birds and Protected Species
Waterfowl hunters aged 16 and older must carry a signed Federal Migratory Bird Hunting and Conservation Stamp (the duck stamp) before hunting. The stamp costs $29 and is valid from purchase through June 30 of the following year, and you must sign it in ink across the face for it to be valid.17U.S. Fish and Wildlife Service. Buy a Duck Stamp or Electronic Duck Stamp (E-Stamp) Migratory bird hunters also need to register through the Harvest Information Program (HIP), a free federal survey that is typically completed when you buy your state hunting license.18U.S. Fish and Wildlife Service. Harvest Information Program (HIP) Registration Statistics All waterfowl must be taken with nontoxic shot.
West Virginia protects numerous species from hunting, trapping, or harm. The WVDNR maintains a list of endangered and threatened animals, and the U.S. Fish and Wildlife Service maintains the broader list of federally protected species believed to occur in the state.19West Virginia DNR. Federally Threatened and Endangered Species in West Virginia20U.S. Fish and Wildlife Service. Listed Species With Spatial Current Range Believed to or Known to Occur in West Virginia Raptors, migratory songbirds, and other protected birds are separately covered under the Migratory Bird Treaty Act. River otters and bobcats have regulated trapping seasons requiring special permits and mandatory reporting. Any accidental capture of a protected species must be reported to the WVDNR immediately.
Federal Endangered Species Act penalties are severe: a knowing violation can bring criminal fines up to $50,000, imprisonment up to one year, or both, with civil penalties for knowing violations reaching $25,000 per violation. Even an unintentional violation can carry a civil penalty up to $500.21U.S. Fish and Wildlife Service. Section 11 – Penalties and Enforcement
Penalties, Points, and License Revocation
Penalties scale with the seriousness of the offense, and the WVDNR tracks repeat violators through a point system.
Minor and Moderate Offenses
Lower-level infractions like failing to properly tag game or hunting without a required stamp carry fines between $20 and $300.22West Virginia Legislature. West Virginia Code 20-2-57A More serious violations such as exceeding bag limits or hunting out of season bring steeper fines and can lead to multi-year license suspensions. Negligently shooting livestock while hunting is a misdemeanor punishable by a fine up to $1,000, jail time up to 90 days, or both, plus mandatory restitution for the value of the animal.23West Virginia Legislature. West Virginia Code 20-2-57 – Negligent Shooting, Wounding or Killing of Livestock While Hunting
Felony-Level Offenses
Poaching, night hunting with artificial lights, and killing protected species carry the harshest penalties. Poaching can result in fines up to $5,000, confiscation of firearms and vehicles used in the offense, and jail sentences up to one year, along with restitution fees based on the species involved.22West Virginia Legislature. West Virginia Code 20-2-57A
Point System
The WVDNR assigns between three and ten points for each hunting or fishing violation based on severity. Ten or more points within any five-year period triggers a mandatory two-year license revocation from the date the threshold was reached. A conviction for negligently shooting a person or livestock carries ten points on its own and results in an automatic five-year revocation.24West Virginia Secretary of State. Point System for the Revocation of Hunting and Fishing Licenses
Interstate Consequences
West Virginia participates in the Interstate Wildlife Violator Compact, so a serious violation here can suspend your hunting privileges in every other member state. The compact requires member states to honor each other’s suspensions as if the violation had happened within their own borders. Ignoring a citation issued in another compact state will cause West Virginia to suspend your privileges here until you resolve the matter in the issuing state.25West Virginia Legislature.
