West Virginia Kayak Laws: Registration, Motors, and Reporting

West Virginia kayak laws are lighter than the rules for powerboats, but they are not nothing. If you paddle a non-motorized kayak, you need a Coast Guard-approved life jacket for every person aboard, a white light kept ready, and something that makes an efficient sound signal. You do not have to register or title the boat, and you do not need a boater education card. Every one of those answers flips the moment you clamp on a motor.

Life Jackets

Federal law requires at least one wearable, Coast Guard-approved personal flotation device aboard for each person on a recreational vessel, kayaks included.1eCFR. 33 CFR 175.15 Each PFD has to be in good condition and sized for the person who would wear it. An adult jacket stashed aboard for a child does not meet the rule.

West Virginia goes further for young paddlers. Any child 12 or under must actually wear a Coast Guard-approved PFD while the kayak is underway, not just have one within reach.2Cornell Law Institute. West Virginia Code R. 58-25-3 – Required Equipment Adults may keep the jacket accessible instead of wearing it, though wearing one on moving water is always the safer choice.

A separate rule applies on the Shenandoah River within West Virginia between November 15 and May 15. During that window, everyone aboard a boat, raft, or tube on the Shenandoah must wear a PFD at all times while underway, regardless of age. Cold water is the reason.

Light and Sound Signal

A manually propelled vessel in West Virginia must carry a lantern or flashlight producing a white light, kept ready at hand whenever the kayak is on the water.3West Virginia Legislature. West Virginia Code 20-7-13 – Motorboat Classification, Lights and Signals It does not need to stay on continuously. You show it in time to prevent a collision when another vessel approaches. That matters most between sunset and sunrise or in fog and rain, but the duty to have the light aboard applies at all hours.

Federal navigation rules also require vessels under 12 meters to carry some means of making an efficient sound signal.4eCFR. 33 CFR 83.33 – Equipment for Sound Signals (Rule 33) A waterproof whistle clipped to your PFD handles this. West Virginia incorporates federal Coast Guard equipment standards by reference, so the federal rule carries the force of state law on state waters.2Cornell Law Institute. Do You Need To Register a Kayak

A paddle-only kayak does not have to be titled or registered in West Virginia.5West Virginia Division of Natural Resources. West Virginia Boating Rules and Laws No paperwork, no decal, no fee. You can buy one and put it on the water the same day.

Attach any motor and that changes. State law defines a motorboat as any vessel propelled by an electric, gas, diesel, or other fuel-driven motor, whether or not the motor is the primary source of propulsion.6West Virginia Legislature. West Virginia Code 20-7-11 – Motorboats and Other Terms Defined Bolting a small trolling motor onto your kayak reclassifies it as a motorboat. You then have to apply for a certificate of number through the Division of Motor Vehicles, display the assigned identification number on both sides of the bow, and keep the certificate aboard while operating.7West Virginia Legislature. Registration covers a three-year period. Most motorized kayaks fall into Class A (under 16 feet), which is $30 for the full three years. If your motor is under three horsepower or produces less than 70 pounds of thrust, there is no registration fee, but you still need the certificate of number.7West Virginia Legislature. What Changes When You Add a Motor

Registration is only the start. West Virginia’s boating-under-the-influence and reckless operation statutes apply specifically to operators of a “motorboat, jet ski, or other motorized vessel.”8West Virginia Legislature. West Virginia Code 20-7-18 – Care in Handling Watercraft Paddling a non-motorized kayak, you are outside those particular statutes. Other laws such as public intoxication can still reach you, but the boating-under-the-influence penalties in the state’s watercraft code are not triggered by a kayak without a motor.

Add a trolling motor and the full BUI framework applies. The threshold is a blood alcohol concentration of 0.08 percent, and operating a motorized vessel on state waters counts as implied consent to a breath or chemical test.9West Virginia Legislature. West Virginia Code 20-7-18c – Implied Consent to Test A first offense carries a mandatory minimum of 24 hours in jail (up to six months) and a fine between $100 and $500. A second offense escalates to a minimum of six months and fines up to $3,000. If impaired operation causes serious injury or death, the charge becomes a felony carrying one to ten years.10West Virginia Legislature. The reckless operation prohibition follows the same pattern. The statute targets motorized vessels and towed devices like water skis and surfboards, not human-powered kayaks.8West Virginia Legislature. West Virginia Code 20-7-18 – Care in Handling Watercraft

A boater education card comes into play at the same threshold. Anyone born on or after December 31, 1986, has to complete a boating safety course before operating a motorboat or personal watercraft on state waters.11West Virginia Division of Natural Resources. Accident Reporting

Any vessel operator involved in a collision or other incident on West Virginia waters must file an accident report with the Director of the Division of Natural Resources if the incident results in a death, an injury requiring medical treatment beyond first aid, or property damage exceeding $2,000.8West Virginia Legislature. West Virginia Code 20-7-18 – Care in Handling Watercraft Kayakers are included. The statute also imposes a duty to render aid after any collision or accident on the water.

Federal guidelines set the timelines. Reports involving death, disappearance, or injury requiring medical treatment beyond first aid must go in within 48 hours. Property-damage-only incidents get 10 days.12United States Coast Guard. Invasive Species

West Virginia does not currently have a mandatory clean-drain-dry law for watercraft. There is no state statute forcing you to remove plant material or drain water from your kayak before moving it between waters. The risk itself is real, though. Didymo and hydrilla can hitchhike on hulls, paddle blades, and gear.

The U.S. Fish and Wildlife Service recommends a three-step routine after every outing: clean visible plants, mud, and organisms off your gear before leaving the access point; drain water from compartments and scupper holes; and let everything dry completely for at least five days before launching on a different body of water.13U.S. Fish & Wildlife Service. Clean, Drain, Dry A hot-water rinse at 120°F or higher speeds things up if you cannot wait the full five days.
