West Virginia sex offender laws put every registrant on one of two tracks: a 10-year registration period or lifetime registration. Which track applies depends on the offense, the victim’s age, and whether there is a prior qualifying conviction. The track then drives almost everything else: how often you report to the State Police, what restrictions apply while you are on supervised release, and how severely a missed update is punished.
Who Has to Register
The Sex Offender Registration Act covers anyone convicted of, or found not guilty by reason of mental illness for, a qualifying sexual offense. The list runs across several chapters of the Code and includes first- and second-degree sexual assault, all three degrees of sexual abuse, use of minors in sexually explicit filming, distribution and possession of child pornography, incest, kidnapping, soliciting a minor online, and human trafficking for sexual servitude.1West Virginia Legislature. West Virginia Code 15-12-2 – Registration; Fees and Use Thereof A sentencing judge can also order registration for any offense where the court makes a written finding that the crime was sexually motivated.
The duty follows the person, not the courthouse. A conviction under another state’s law, the federal code, or the Uniform Code of Military Justice triggers registration in West Virginia if you live, work, or attend school here.2West Virginia Secretary of State. 10-Year Registration or Lifetime
West Virginia does not use the federal three-tier model. Every registrant is either on the 10-year track or the lifetime track.3Office of Justice Programs. SORNA Substantial Implementation Review State of West Virginia
The default is 10 years, measured from release from prison, jail, or a mental health facility, or from the date you were placed on probation or supervised release. Early release from probation or parole does not shorten the clock.4West Virginia Legislature. West Virginia Code 15-12-4 – Duration
Lifetime registration applies if any of the following is true:4West Virginia Legislature. West Virginia Code 15-12-4 – Duration
- You had a prior conviction for a qualifying sex offense before the current one.
- The prosecuting attorney moved for and the court found by clear and convincing evidence that the offense involved multiple victims or multiple violations.
- The conviction was for a sexually violent offense, defined by statute as first-degree sexual assault, second-degree sexual assault, or first-degree sexual abuse, or an equivalent from another jurisdiction.1West Virginia Legislature. West Virginia Code 15-12-2 – Registration; Fees and Use Thereof
- You have been designated a sexually violent predator in a separate proceeding.
- The offense involved a victim who was a minor, or someone you believed to be a minor.
Because of that last trigger alone, the 10-year track is effectively limited to first-time offenders convicted of lower-level qualifying offenses against adults. Everyone else lands on lifetime.
The Sexually Violent Predator Designation
Inside the lifetime category is a narrower and harsher status. A sexually violent predator is someone convicted of a sexually violent offense who also has a mental abnormality or personality disorder making future predatory sexually violent offenses likely.1West Virginia Legislature. West Virginia Code 15-12-2 – Registration; Fees and Use Thereof The statute defines a predatory act as one directed at a stranger or at someone with whom a relationship was established primarily to victimize them.
People with this designation verify their information quarterly rather than annually, receive lifetime supervised release with proximity conditions, and are subject to enhanced public notification that includes physical characteristics, offense history, and treatment records. Removing the designation requires petitioning the original sentencing court, and the only ground that works is that the underlying qualifying conviction has been reversed or vacated.5West Virginia Legislature. West Virginia Code 15-12-3a – Petition for Removal of Sexually Violent Predator Designation Completing treatment is not enough on its own.
How Registration Works
You register in person at the West Virginia State Police detachment serving the county where you live. Registration happens at the time of conviction unless you are incarcerated, in which case you register within three business days before release. Anyone already on the registry who serves any prison term must re-register within three business days before getting out.1West Virginia Legislature. West Virginia Code 15-12-2 – Registration; Fees and Use Thereof
At registration you provide your name, date of birth, Social Security number, home and work addresses, vehicle information, a recent photograph, fingerprints, and a DNA sample. The state also collects internet-related information: email addresses, social media accounts, and screen names.6West Virginia Division of Corrections and Rehabilitation. Policy Directive 457.04 – Registration of Offenders
Everyone appears annually at their detachment to confirm the information on file. Sexually violent predators appear quarterly.3Office of Justice Programs. SORNA Substantial Implementation Review State of West Virginia The State Police also conduct unannounced address checks. The registry is publicly accessible online, with some fields restricted to law enforcement.
Reporting Changes: The 10-Business-Day Rule
Any change to registration information must be reported within 10 business days. That covers a new physical or mailing address, a new job, a new vehicle, a new phone number, a new email, and a new screen name. Each unreported item can be charged as its own offense, so a single unreported move can generate several counts.6West Virginia Division of Corrections and Rehabilitation. Policy Directive 457.04 – Registration of Offenders
Moving to a different West Virginia county requires notifying your current detachment 10 business days before the move and registering with the new detachment within 10 business days of arrival. Moving out of state requires notifying the detachment 10 business days ahead and then complying with the destination state’s registration laws.
Where You Can Live and Go
West Virginia’s residency and proximity limits are tied to supervised release, not to registry status by itself. A felony sex offense, incest involving a minor, or a related conviction can carry a supervised release term of up to 50 years on top of any other sentence. First-degree sexual assault and first-degree sexual abuse carry a mandatory minimum of 10 years of supervised release. Sexually violent predators receive lifetime supervised release.7West Virginia Legislature. West Virginia Code 62-12-26 – Extended Supervision for Certain Sex Offenders
While on supervised release, you cannot live or work within 1,000 feet of a school, a child care facility, or the victim’s residence, and you cannot loiter within 1,000 feet of any of those locations. The statute defines loitering as entering or remaining on property with no legitimate purpose, or staying beyond the time needed to fulfill one.7West Virginia Legislature. West Virginia Code 62-12-26 – Extended Supervision for Certain Sex Offenders
A registrant who has finished supervised release is not subject to those 1,000-foot rules under state law. Local ordinances or probation conditions can still impose their own limits, so the practical answer varies by county and by the terms of your case.
Penalties for Failing to Register
The penalty depends on your track, and each unreported change can be charged separately.8West Virginia Legislature. West Virginia Code 15-12-8 – Failure to Register or Provide Notice of Registration Changes; Penalty; Penalty for Aiding and Abetting
For a 10-year registrant, a first violation is a misdemeanor punishable by a $250 to $10,000 fine, up to a year in jail, or both. A second violation becomes a felony carrying one to five years. A third or later violation carries five to 25 years.
For a lifetime registrant, the first violation is already a felony carrying one to five years. A second or later violation carries 10 to 25 years.
For a sexually violent predator, a first violation carries two to 10 years. A second or later violation carries 15 to 35 years.
Anyone who helps a registrant evade these requirements can also be prosecuted.
Federal Consequences That Stack on Top
State penalties are not the only exposure. Under 18 U.S.C. 2250, a registrant who crosses state lines or enters or leaves Indian country and knowingly fails to register or update a registration faces up to 10 years in federal prison, a fine, or both, on top of any state charge. The same penalty applies to failing to report planned international travel and then leaving the country.9Office of the Law Revision Counsel. 18 U.S. Code 2250 – Failure to Register
Federal law also requires registrants to notify registry officials at least 21 days before any international travel, including passport number, dates, destinations, purpose, and itinerary. That information goes to the U.S. Marshals Service’s National Sex Offender Targeting Center, which alerts INTERPOL and destination authorities.10Office of Justice Programs. SORNA – Information Required for Notice of International Travel Under the International Megan’s Law, the State Department places a visible identifier on the passport of any covered sex offender, and a passport can only be reissued without that identifier if the Angel Watch Center confirms the person no longer has to register. Moving abroad does not lift the requirement.11Office of the Law Revision Counsel. 22 USC 212b – Unique Passport Identifiers for Covered Sex Offenders
Housing is affected too. Anyone subject to lifetime registration is permanently barred from federally assisted housing, including public housing and Section 8. Owners and public housing agencies must check the registry before admitting an applicant, and any household containing a lifetime registrant must be denied. Before a denial, the agency must give the applicant a copy of the registration information and a chance to dispute it.12Office of the Law Revision Counsel. 42 U.S. Code 13663 – Ineligibility of Dangerous Sex Offenders for Admission to Public Housing
Getting Off the Registry
There is no general early-removal petition in West Virginia based on rehabilitation, treatment, or years of clean compliance. If your conviction is overturned, you can petition the court to remove your name.4West Virginia Legislature. West Virginia Code 15-12-4 – Duration The sexually violent predator designation can only be removed through the same route: the underlying conviction must be reversed or vacated.5West Virginia Legislature. West Virginia Code 15-12-3a – Petition for Removal of Sexually Violent Predator Designation For everyone else on the 10-year track, the registration period ends when the 10-year clock, running from release or the start of supervision, runs out.
