Westchester County gun laws follow New York State’s licensing system, which is among the strictest in the country. Every handgun requires a license, semi-automatic rifles bought on or after September 4, 2022 need their own permit, concealed carry comes with a long list of off-limits places, and safe storage is a legal obligation with criminal penalties. The rules changed substantially after the Concealed Carry Improvement Act took effect in 2022, and the practical reality for residents is a multi-month application, several hundred dollars in fees, and ongoing duties that continue for as long as you own a firearm.
What Requires a License
New York Penal Law § 400.00 governs handgun licensing. The two categories that matter most to Westchester residents are the premises license, which lets you keep a handgun at home or at your business but nowhere else, and the concealed carry license, which lets you carry in public subject to heavy location restrictions.1New York State Senate. A third license applies to semi-automatic rifles. Any purchase or transfer of a semi-automatic rifle on or after September 4, 2022 requires this permit. Manually operated long guns, such as a bolt-action hunting rifle or a pump shotgun, do not require a license to own in Westchester. Safe storage rules and age requirements still apply. Who Qualifies
You must be at least 21 to hold a firearm license. Honorably discharged veterans of the U.S. military or the New York National Guard are exempt from the age requirement.1New York State Senate. You apply in the county where you live, work, or maintain a principal place of business.1New York State Senate. Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms Beyond that, the licensing officer decides whether you have the character, temperament, and judgment to be trusted with a firearm. That judgment draws on your criminal record, your mental health history, and statements from your character references. A felony conviction or serious offense is an automatic disqualification.
How to Apply
Applications start with Form PPB-3, the State of New York Pistol/Revolver License Application, available from the Westchester County Clerk or the State Police.4New York State Police. Firearms Concealed carry applicants have to submit more than the base form:

- A list of every social media account you have used in the past three years, which the licensing officer reviews.
- Household information: your spouse or domestic partner, other adults in the home, and whether any minors live there.
- A certificate showing you have completed the required concealed carry training.
- An in-person interview with the licensing officer.
You schedule an appointment with the County Clerk’s Office to submit everything, and the Department of Public Safety takes your fingerprints for state and federal background checks at that visit.
Fees
The Westchester County Clerk charges $175 to process a new application, payable by check, money order, cash, or credit card.5Westchester County Clerk. How Long It Takes
After the appointment, Westchester County Police investigate your background and contact your references. The file then goes to a licensing officer, usually a county judge, for a final decision. The full process routinely runs several months. If you need the license by a specific date, start well in advance.
Training for Concealed Carry
Concealed carry applicants must finish a state-approved firearms safety course before applying. The course requires a minimum of 16 hours of in-person classroom instruction covering firearm safety, de-escalation, use of deadly force, and New York gun law, plus at least two hours of live-fire range training.1New York State Senate. Where You Cannot Carry
A concealed carry license does not authorize carry everywhere. The Concealed Carry Improvement Act created two separate restrictions, each with its own statute, and confusing them is an easy path to a felony charge.
Sensitive Locations

- Government buildings and courts
- Schools and educational institutions
- Libraries, public parks, playgrounds, and zoos
- Public transit vehicles and facilities
- Polling places
- Places of worship
- Entertainment and sporting venues
- Public gatherings and permitted events, including protests and demonstrations

Private Property
Penal Law § 265.01-d sets the default for private property: you cannot bring a firearm onto someone else’s property unless the owner or lessee has affirmatively allowed it, either through clearly posted signage welcoming firearms or through express consent.9New York State Senate. This inverts what many gun owners expect. In most states, carry on private property is allowed unless the owner posts a no-guns sign. New York works the other way. A store or restaurant with no signage at all is a place where your gun is not welcome as a matter of law. Violating this rule is also a class E felony.9New York State Senate. Safe Storage
Under Penal Law § 265.45, if you live with anyone under 18 or anyone you know is legally barred from possessing firearms, your guns must be locked in a safe storage container or secured with a gun locking device whenever they are not in your immediate possession or control. Violation is a class A misdemeanor, up to 364 days in jail.10New York State Senate. A firearm left in an unattended vehicle must be unloaded, locked in a storage container, and kept out of sight from outside the vehicle. The criminal charge is not the only exposure. If a minor or prohibited person gains access to an unsecured firearm and hurts someone, that storage failure becomes strong evidence of negligence in a civil suit. A wrongful death case can be financially far worse than the misdemeanor.
Renewal Deadlines

Miss the deadline and your license is automatically revoked. There is no grace period and no late-fee fix. Revocation means surrendering your firearms and starting the whole application over, including new fees and, for concealed carry, new training. Penalties You Need to Know
Possessing a handgun in New York without a license is a class E felony under Penal Law § 265.01-b, up to four years in prison. It applies even if you legally own the gun in another state or did not know New York required a license. The prosecution only has to prove you knowingly possessed the weapon without the required permit here.

Any firearm conviction also triggers license revocation and can disqualify you from ever holding a New York firearm license again.
If Your Application Is Denied
A denied application can be challenged through an Article 78 petition, filed in state court. The judge reviews whether the licensing officer’s decision was arbitrary, lacked a factual basis, or applied the wrong legal standard. Courts give some deference to the licensing officer but will overturn a denial that has no rational basis.
The deadline is four months from the date you receive the denial. Miss it and you lose the right to challenge the decision at all. Consulting an attorney soon after a denial is usually worth it if you have reason to believe the decision was wrong. Denials tied to a felony conviction or similar disqualifier rarely succeed on appeal without first addressing the underlying issue.
A Note for People Moving to Westchester
New York does not recognize concealed carry permits from other states. If you are relocating from a state with more permissive laws, possessing a handgun in Westchester without a New York license is a felony from day one, even temporarily.
