A Westchester County pistol permit is issued under New York Penal Law 400.00 after the County Department of Public Safety investigates your background and a County Court judge signs off on your application. Plan on roughly six months from the day you submit your paperwork to the day you hear a decision, and plan on being thorough: incomplete applications and inconsistencies are the fastest way to add months to that timeline.1Westchester County Department of Public Safety. Choose Your License Type First
Two license types cover most Westchester applicants, and the one you pick shapes the training, fees, and recertification cycle that follow.
- Premises permit. Lets you keep a handgun at your home or place of business. You cannot carry it on your person in public, though you can transport it under narrow conditions.
- Concealed carry permit. Lets you carry a concealed handgun in public, subject to a long list of restricted locations under state and federal law. Requires additional training and recertifies on a shorter cycle than a premises license.
The statute also carves out specialized categories tied to specific jobs, such as bank messengers, certain judges, and corrections employees, but those don’t apply to the general public.2New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms
Who Qualifies
You must be at least 21 and a permanent resident of Westchester County. Veterans honorably discharged from any branch of the U.S. military or the New York National Guard are exempt from the age requirement.2New York State Senate. You also have to show “good moral character,” which New York defines as the temperament and judgment to be trusted with a weapon and to use it without endangering yourself or others. The licensing judge has broad discretion on this point, and the background investigation is built to inform that call.2New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms
State law automatically disqualifies you if any of the following apply:
- A felony conviction anywhere, or a conviction for a “serious offense” as defined by New York statutes.
- An outstanding felony or serious offense warrant.
- A court order prohibiting you from possessing a firearm.
- A history of involuntary commitment to a mental health facility.
The licensing judge cannot waive any of these at the county level.2New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms
Federal Disqualifiers That Catch People Off Guard
Clearing every state-level check isn’t the end of the inquiry. Federal law under 18 U.S.C. § 922(g) independently bars certain people from possessing firearms, and two of those bars trip up Westchester applicants more than any others.
A misdemeanor domestic violence conviction is a permanent federal firearms bar even though it is not a felony. The same goes for being subject to a restraining order that prohibits contact with an intimate partner or their child.3Bureau of Alcohol, Tobacco, Firearms and Explosives. Identify Prohibited Persons
Marijuana use is the one people most often overlook. Cannabis remains a controlled substance under federal law, and anyone who uses it is federally prohibited from possessing a firearm regardless of state legalization. ATF Form 4473 asks about drug use directly when you buy a handgun, and answering dishonestly is a felony punishable by up to five years in prison. Holding a medical marijuana card while applying for a Westchester pistol permit puts you in direct conflict with federal law.4Office of the Law Revision Counsel. 18 USC 922 – Unlawful Acts
Federal law also prohibits firearm possession by anyone formally adjudicated as mentally incompetent or involuntarily committed to a mental health facility. Voluntary admission or observation alone does not trigger this bar.5Bureau of Alcohol, Tobacco, Firearms and Explosives. Federal Firearms Prohibition Under 18 USC 922(g)(4)
What You’ll Need to Apply
The application itself is the State of New York Pistol/Revolver License Application, Form PPB-3. It asks for your complete residential history, employment history, and any past contact with law enforcement or the courts. Any gap between what you write and what the investigation turns up is the single biggest cause of delays and denials, so take the time to work through it carefully.6Gun Safety. Forms
You need four character references, and Westchester sets specific rules for them. Each one must be at least 21, must have known you for at least a year, cannot be related to you by blood or marriage, and must live in Westchester County. The Department of Public Safety will contact every one of them.1Westchester County Department of Public Safety. Westchester County Pistol License Application Instructions
You’ll also need identification documents such as a birth certificate, social security card, or valid passport, plus proof of Westchester residency. Fill in every field the Clerk’s instructions call for. An incomplete submission comes back, and months disappear.
Training for Concealed Carry
If you’re applying for a concealed carry license, the New York Concealed Carry Improvement Act requires you to finish a training course before the application moves forward. The course runs 16 hours of classroom instruction plus two hours of live-fire training at a range. You have to pass the course and submit a certificate from a state-approved instructor with your application.7Gun Safety in New York State. Frequently Asked Questions – New Concealed Carry Law
Premises-only applicants are not required to complete this training. If you later want to upgrade a premises permit to concealed carry, you’ll complete the training then and file a restriction change amendment.
Filing and What Happens Next
Once your package is ready, call the Westchester County Department of Public Safety Pistol License Unit at (914) 995-2709 to schedule an intake appointment. Applications are accepted by appointment only.8Westchester County Department of Public Safety. Pistol License Unit
At intake, staff review your application for completeness and fingerprint you. Your prints go to the New York State Division of Criminal Justice Services and the FBI for a criminal history check.1Westchester County Department of Public Safety. After intake, the Department of Public Safety runs a full background investigation. That means verifying what you wrote, interviewing your references, and reviewing your criminal and mental health records. The investigation routinely takes six months or longer. When it wraps up, your file goes to a Westchester County Court judge serving as the licensing officer, who makes the final decision.1Westchester County Department of Public Safety. What It Costs
The processing fee for a new Westchester County pistol permit is $175.00, payable to the Westchester County Clerk. Retired police officers, uniformed court officers in the Unified Court System, and retired correction officers are among those exempt from the fee under Penal Law 400.00(14).9Westchester County Clerk. Fingerprinting is a separate charge. Concealed carry training courses typically run between $50 and $350 depending on the instructor. Adding it up, budget somewhere between $300 and $600 for the application fee, fingerprinting, and training combined.
What a Permit Does and Doesn’t Let You Do
A concealed carry permit is not blanket authorization to carry everywhere. New York Penal Law 265.01-e makes it a crime to carry a firearm in a long list of sensitive locations even with a valid license. Covered places include government buildings and courthouses, all schools and colleges, hospitals and behavioral health facilities, places of worship, libraries, parks, playgrounds and zoos, public transit, bars and cannabis lounges, theaters and stadiums, and polling places. The statute reaches further than this summary, and the categories above are not exhaustive.10New York State Senate. New York Penal Code 265.01-e – Criminal Possession of a Firearm, Rifle or Shotgun in a Sensitive Location Federal property adds its own prohibition under 18 U.S.C. § 930, which covers post offices, federal courthouses, and other federal buildings, with penalties of up to a year in prison, or up to five years if the weapon was intended for use in a crime.11United States Postal Service. Possession of Firearms and Other Dangerous Weapons on Postal Service Property
If you hold a premises-only license, your handgun generally stays at your home or business. The law lets you transport it directly to another dwelling or business where you are authorized to possess it, an authorized shooting range, or a lawful shooting competition. During transport the handgun must be unloaded and stored in a locked container, with ammunition carried separately. A glove compartment or center console doesn’t count as a locked container, and a Westchester premises permit doesn’t authorize you to transport a handgun into New York City without written permission from the NYPD commissioner.2New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms
Storage rules under Penal Law 265.45 apply to every firearm owner. If you live with anyone under 18, anyone subject to an extreme risk protection order, or anyone prohibited from possessing firearms due to a felony or serious offense conviction, your handgun must be secured in a locked safe storage depository or rendered incapable of firing with a gun locking device whenever it is not in your immediate possession or control. The same statute controls storage in vehicles.12New York State Senate. New York Penal Code 265.45 – Safe Storage of Rifles, Shotguns, and Firearms
Recertification
Westchester permits don’t last forever, and the cycle depends on which license you hold. Premises permits and other non-concealed-carry licenses in Westchester expire no more than five years after issuance and must be recertified every five years. Concealed carry licenses recertify every three years.2New York State Senate. New York Penal Code 400.00 – Licensing and Other Provisions Relating to Firearms
Full carry holders also have to complete the mandatory 18-hour firearms training course again as part of renewal. Westchester runs its own recertification forms and process through the Department of Public Safety. Westchester permit holders do not recertify through the New York State Police online portal that most other counties use.13Gun Safety. Miss a recertification deadline and your license expires, which means you are no longer authorized to possess the handguns on it. Treat those deadlines seriously.
If Your Application Is Denied
If the licensing judge denies your application, the Westchester County Court will notify you. The most common reasons are disqualifying criminal history, insufficient evidence of good moral character, and incomplete applications that were never corrected.15Westchester County Clerk. Pistol Licenses
New York law lets you file an Article 78 proceeding in state court to challenge a denial on the ground that the licensing officer’s decision was arbitrary or unsupported by the record. It’s a formal legal proceeding, and most applicants who go that route use an attorney. If the denial traces back to incorrect records in the federal background check system, you can challenge that separately through the FBI’s NICS appeal process, which accepts challenges electronically or by mail.16Federal Bureau of Investigation.
