What Age Can You Get a Tattoo in Mississippi: 18+, No Exceptions

In Mississippi, you have to be 18 to get a tattoo, and there is no parental consent option that changes that. The age floor is the same whether the design is large or small, and it applies to every part of the body. If you are under 18, no licensed artist in the state can legally tattoo you.1Justia Law. No Exception for Parental Consent

This is where Mississippi differs from many other states. Some states let a parent or legal guardian sign a form and sit in on the appointment so a minor can be tattooed. Mississippi offers no such path. The statute simply prohibits tattooing anyone under 18.1Justia Law. Mississippi Code 73-61-1 – Tattooing

A parent calling ahead, signing a waiver, and standing in the room does not change the legal picture. An artist who tattoos the minor is still committing a misdemeanor. The law puts responsibility on the person holding the needle, not on the parent and not on the teenager. It also does not matter if the minor is 17 and weeks from turning 18, or whether the artist is a licensed professional or someone working out of their home.

What a Studio Will Check Before Tattooing You

Because artists face penalties for tattooing someone underage, Mississippi Department of Health rules build ID verification into every appointment. Before the needle comes out, the artist has to walk you through the risks of the procedure and the aftercare instructions. You then sign a consent form confirming you understood both.2Mississippi State Department of Health. A photocopy of your government-issued ID showing your date of birth gets attached to that form. The studio has to keep the form and the ID copy on file for at least two years and hand them over if the Department of Health asks. The form itself lists your name, home address, date of birth, where on the body the tattoo will go, and a statement that you are not under the influence of drugs or alcohol.3Legal Information Institute. 15 Mississippi Code R 19-60-11.5.10 – Consent Forms

Show up without a valid government photo ID and a reputable studio will turn you away. No serious artist in Mississippi skips this step, because the consequences of skipping it fall on them.

What Happens to an Artist Who Tattoos a Minor

Tattooing someone under 18 is a misdemeanor in Mississippi. A conviction carries a fine of $100 to $500. The fine is only part of it. The Department of Health can suspend or revoke the artist’s Certificate of Registration, which shuts down their ability to work legally in the state.1Justia Law. Mississippi Code 73-61-1 – Tattooing

The same penalties apply to anyone tattooing for money without a registration at all, or continuing to tattoo after registration has been suspended or revoked. The law treats an unlicensed tattoo and a tattoo on a minor as equally serious.

Body Piercings Follow the Same Age Rule

Body piercing works almost the same way. You must be 18, and parental consent does not change that. The one carve-out is the earlobe. Mississippi’s legal definition of “body piercing” specifically excludes the outer perimeter and lobe of the ear, so earlobe piercings fall outside the statute.4FindLaw. Anything else, whether cartilage, nostril, navel, or elsewhere on the body, requires the same age verification, the same consent paperwork, and carries the same penalties for a piercer who ignores the rules.
