In Georgia, a 16-year-old drives under a Class D provisional license, which comes with a midnight-to-5 a.m. curfew, limits on non-family passengers, and a driving record that has to stay clean under stricter rules than adults face. What You Have to Do Before You Can Apply
Georgia requires a full year on a Class CP instructional permit before you can move up to a Class D. That year has to stay clean. The statute bars anyone who has been convicted in the prior 12 consecutive months of DUI, hit and run, racing on public roads, fleeing from a police officer, reckless driving, reckless stunt driving, or any single offense worth four or more points.2Justia. On top of the permit year, Joshua’s Law sets the training requirements. You need 30 hours of classroom or online instruction plus 40 hours of supervised driving with a parent or guardian, and at least six of those 40 hours must be at night. Depending on which path you pick, you may also need six hours of behind-the-wheel training at a certified driving school; if your parent handles all the road practice, the school-based driving hours drop out but the 30 classroom hours and 40 parent-supervised hours stay.3Georgia Department of Driver Services. You also have to finish an Alcohol and Drug Awareness Program (ADAP) before the Class D is issued. It’s a separate requirement from driver education.4Georgia Department of Driver Services. The Application Visit
Bring the paperwork with you or the trip is wasted:

- A notarized Certificate of School Enrollment (form DDS-1) signed by a school official confirming that you’re enrolled or have graduated.5Georgia Department of Driver Services. School Enrollment Documents
- A signed, sworn affidavit from your parent or guardian verifying the 40 hours of supervised driving. If a certified driving school did all your behind-the-wheel work, this affidavit isn’t required.6Justia. - Joshua’s Law completion. Your provider should upload it electronically, but carry a paper copy in case the system doesn’t show it.
Road test slots have to be scheduled online through the DDS appointment system; other DDS services don’t take appointments.7Georgia Department of Driver Services. You leave with a temporary paper license, and the permanent card arrives by mail.
The Midnight-to-5 a.m. Curfew
Class D holders cannot drive between midnight and 5:00 a.m.2Justia. How Passenger Limits Work
Passenger restrictions phase in over your first year with the license. They apply only to passengers under 21 who are not immediate family. Family members can ride with you in any number, at any time.1Georgia.gov. Apply for a Georgia Provisional Drivers License Class D

Georgia defines immediate family broadly for this rule: parents and stepparents, grandparents, siblings and stepsiblings, children, and anyone else living in your household. An officer can’t pull you over solely because of a passenger violation. A citation for it only sticks when you’ve been stopped for something else.2Justia. Phones Stay Down
Georgia’s Hands-Free Act applies to every driver regardless of age. You cannot physically hold or support a phone or other electronic device while driving. Voice features are fine through an earpiece, headphones, or a wrist device, but the phone itself has to stay out of your hand.10Justia. Fines climb with repeat convictions inside a 24-month window: up to $50 for a first, up to $100 for a second, and up to $150 for a third or later violation. A first conviction also adds a point to your record.10Justia. Four Points and You’re Suspended
Any driver under 18 who accumulates four or more points in a 12-month period is suspended.11Justia. At the teen threshold, one significant ticket can do it on its own — a speeding conviction of 24 mph over the limit, for example, carries four points by itself.
A first suspension runs six months. A second or later suspension runs 12 months. Either way, you have to complete a defensive driving course and pay a reinstatement fee ($210 in person, $200 by mail for a first; $310 in person, $300 by mail for a second) before you get the license back.11Justia. The .02 BAC Rule
Georgia treats every driver under 21 under a near-zero-tolerance DUI standard. A blood alcohol concentration of .02 or higher creates a DUI, even though the adult limit is .08.12Georgia Department of Driver Services. Chapter 1 Continued A single drink can put a teen at .02 depending on weight and metabolism, and any alcohol before driving is already illegal at 16.
A BAC at or above .02 but under .08 brings a minimum six-month license suspension with no limited driving permit available. A BAC of .08 or higher, or a refused breath test, carries a minimum 12-month suspension, again with no limited permit.12Georgia Department of Driver Services. When the Rules Change
Curfew, passenger limits, and the rest of the graduated licensing conditions stay in place until you turn 18. At 18 you can apply for a full, unrestricted Class C license.1Georgia.gov.
