Sex offender probation conditions in Colorado are among the most restrictive the state imposes on anyone living in the community. If a court grants probation instead of prison for a felony sex offense, you serve an indeterminate term with a minimum of 10 years for a class 4 felony or 20 years for a class 2 or 3 felony, and a maximum that can run for the rest of your life.1Justia. Colorado Code 18-1.3-1004 – Indeterminate Sentence Throughout that time you must complete SOMB-approved treatment, submit to regular polygraph exams, register with law enforcement, follow housing and contact restrictions, report frequently to a probation officer, and get permission before you travel. Violating any condition gives the court authority to revoke probation and resentence you under the same indeterminate framework, up to life.
How Long Probation Actually Lasts
Most criminal probation in Colorado has a fixed end date. Sex offense probation does not. The judge sets a minimum term of at least 10 years for a class 4 felony or at least 20 years for a class 2 or 3 felony, and the maximum is your natural life.1Justia. Colorado Code 18-1.3-1004 – Indeterminate Sentence Every condition below can therefore be part of your life for decades.
Not every sex offense qualifies for probation. If the offense was classified as a crime of violence, or the person qualifies as a habitual sex offender against children, the court must sentence to prison rather than probation.1Justia. Colorado Code 18-1.3-1004 – Indeterminate Sentence For those who do receive probation, the court places them in an intensive supervision program that includes severely restricted activities, frequent contact with a probation officer, monitored curfews, home and employment visits, drug and alcohol screening, and treatment.2FindLaw. Mandatory Sex Offense Treatment
Everyone sentenced for a sex offense in Colorado must undergo treatment as a condition of probation. Treatment must come from a provider approved by the Sex Offender Management Board (SOMB), and you pay for it to the extent you are financially able.3FindLaw. Colorado Code 16-11.7-105 – Sex Offender Treatment The legislature has stated explicitly that it “does not intend to imply that all offenders can or will positively respond to treatment,” framing Colorado’s approach as long-term management rather than a promised cure.
Treatment usually starts with a comprehensive evaluation that looks at offense details, psychological history, and reoffense risk. The resulting plan commonly includes cognitive-behavioral therapy, relapse prevention, and victim-impact education, often in a group setting where participants discuss their behavior openly. Colorado law waives the usual confidentiality protections for sex offense treatment, so what you say in sessions can be shared with your supervision team.
The Community Supervision Team
Supervision is coordinated through a Community Supervision Team (CST) made up of your treatment provider, probation officer, and polygraph examiner. Under the SOMB’s current TEAMS framework (Treatment, Engagement, Assessment, Management, and Supervision), these professionals communicate frequently about anything affecting community safety or your risk level.4Colorado Division of Criminal Justice. SOMB Adult Standards January 2026 This is where sex offense probation feels different from ordinary probation: your therapist, your probation officer, and your polygraph examiner are all talking to each other, and none of it is confidential.
What Treatment Costs
Monthly treatment fees, evaluation costs that can exceed a thousand dollars, and periodic polygraph exams all fall on the person on probation. Over the first year, combined costs can exceed $10,000. That expense continues for as long as probation lasts.
Polygraph Examinations
Regular polygraph testing is a core piece of Colorado’s supervision approach. SOMB standards set a specific schedule: an initial offense-specific exam within the first three months, a sexual history exam within the first 12 months of treatment, and maintenance exams every six months on an ongoing basis. Each exam must last at least 90 minutes, and the examiner cannot also be your therapist or probation officer.4Colorado Division of Criminal Justice. SOMB Adult Standards January 2026
Polygraph results are not admissible in court, but they carry real consequences in the supervision system. The CST works with the examiner on what type of exam to administer and what areas to explore.4Colorado Division of Criminal Justice. SOMB Adult Standards January 2026 A deceptive result does not automatically trigger penalties, but it typically leads to increased scrutiny, additional treatment requirements, or tighter supervision. Refusing the exam is treated as a failure to comply with probation.
You pay for each test, generally $150 to $350 per session. If the CST determines you are unsuitable for polygraph testing due to a medical or psychological condition, other forms of behavioral monitoring may be substituted.4Colorado Division of Criminal Justice. SOMB Adult Standards January 2026
Sex Offender Registration
Colorado’s Sex Offender Registration Act runs alongside probation. Initial registration with local law enforcement must happen within five business days after release from incarceration, or within five business days of receiving notice of the duty to register if you were not incarcerated.5Justia. Colorado Code 16-22-108 – Registration Procedure Frequency Place Change of Address Fee You register in person, complete a standardized form, and pay a fee.
After that, most registrants re-register annually within five business days of their birthday. Sexually violent predators and people convicted of certain specified offenses re-register every three months for life. Establishing an additional residence anywhere in Colorado requires registering with the local law enforcement agency in that jurisdiction within five business days.5Justia. Colorado Code 16-22-108 – Registration Procedure Frequency Place Change of Address Fee
Registration includes your name and former names, date of birth, current address, a current photograph, and fingerprints. Anyone convicted of a child sex crime must also register email addresses, instant-messaging identities, and chat room identities before using them.5Justia. Colorado Code 16-22-108 – Registration Procedure Frequency Place Change of Address Fee Failing to comply is a separate crime: a class 6 felony if the underlying conviction involved felony-level sexual behavior, or a class 1 misdemeanor for misdemeanor-level offenses.6Justia. Colorado Code 18-3-412.5 – Failure to Register as a Sex Offender
Community Notification
People classified as sexually violent predators trigger community notification. When they are sentenced to probation or released, the supervising officer notifies the local law enforcement agency, which implements notification protocols, and the information goes into the Colorado Bureau of Investigation’s central registry. A move activates the same process in the new jurisdiction.7Justia. Colorado Code 16-13-903 – Determination
Where You Can Live
Colorado has no statewide law banning sex offenders from living near schools, parks, or playgrounds. Probation conditions routinely add residency restrictions, and individual municipalities have passed their own buffer-zone ordinances.
Englewood’s ordinance was among the most restrictive, prohibiting registered sex offenders from living within 2,000 feet of any school, park, or playground, or within 1,000 feet of a daycare, recreation center, or swimming pool, and estimates showed those restrictions made roughly 99% of the city off-limits.8FindLaw. Ryals v City of Englewood A federal court struck it down, ruling it left “essentially no place for offenders to live” and conflicted with the state’s interest in uniform treatment and reintegration. The SOMB itself has urged communities not to adopt blanket residency restrictions because they push people off the registration system.
Regardless of local ordinances, your probation officer must approve your housing. The officer weighs proximity to past victims, presence of minors in the household, and proximity to other high-risk individuals. Surprise home visits are standard. Losing your approved residence without promptly securing a new one your officer approves counts as a violation.
Federal Public Housing Bar
Federal law bars anyone subject to a lifetime sex offender registration requirement from being admitted to federally assisted housing. The ban covers public housing and the Housing Choice Voucher program.9Office of the Law Revision Counsel. 42 USC 13663 – Ineligibility of Dangerous Sex Offenders for Admission to Public Housing Housing authorities must check state registries, and applicants subject to lifetime registration must be denied.10U.S. Department of Housing and Urban Development. State Registered Lifetime Sex Offenders in the Housing Choice Voucher and Public Housing Programs FAQ In Colorado, sexually violent predators and people convicted of certain specified offenses carry a lifetime duty, which triggers this federal ban.
Contact Restrictions
Courts routinely issue no-contact orders as a condition of sex offense probation, prohibiting all communication with past victims and, when the offense involved a minor, with minors generally. These orders cover direct contact, phone calls, letters, email, social media messages, and communication through a third party. Even an accidental encounter in a public place typically requires you to leave the area immediately.
Contact with other registered sex offenders is also restricted unless your probation officer approves it. Exceptions are sometimes made for group treatment, but those interactions stay monitored by the CST.
Internet and Devices
Colorado’s approach to internet restrictions has changed. In 2018, the Colorado Judicial Department eliminated blanket prohibitions on internet use, social media, and sexually explicit material for people convicted of sex offenses. Current policy recognizes there is no empirical support for blanket internet bans, though targeted restrictions remain appropriate when past offenses involved online activity.11Colorado Division of Criminal Justice. Evaluating Risk Factors for Internet Access and Electronic Monitoring
The shift followed the U.S. Supreme Court’s 2017 decision in Packingham v. North Carolina, which struck down a blanket ban on sex offenders accessing social media as an unconstitutional restriction on free speech. The Court held that such sites are a principal source for news, employment, and participation in public life, and that states must use narrower, more targeted laws.12Supreme Court of the United States. Packingham v North Carolina
Internet conditions are now individualized. They must be reasonably related to the offense. Depending on your risk level and history, a probation officer may require an inventory of all internet-capable devices, a computer use agreement, or monitoring software on your devices. Higher-risk individuals may face continuous third-party electronic monitoring of all online activity.11Colorado Division of Criminal Justice. Evaluating Risk Factors for Internet Access and Electronic Monitoring Treatment contracts can add device restrictions based on clinical need even when the court order does not specifically require them.
Reporting, Home Visits, and GPS
How often you meet with your probation officer depends on your risk level and compliance history. Early on, expect weekly or even daily contact. The intensive supervision program for sex offenders is designed as the highest level of supervision the state provides, including monitored curfews, home visits, and employment-site visits.2FindLaw. Colorado Code 18-1.3-1007 – Intensive Supervision Probation Program As you show compliance and progress in treatment, frequency may decrease, but it rarely drops below monthly.
At each meeting, the officer reviews every condition: treatment attendance, residency, registration status, contact restrictions, and employment. Even minor infractions that seem technical, like a missed check-in or arriving late, can lead to tightened supervision.
Higher-risk individuals may be required to wear a GPS monitoring device. Colorado’s intensive supervision statute authorizes “physiological monitoring” as part of the program.2FindLaw. Colorado Code 18-1.3-1007 – Intensive Supervision Probation Program GPS enforces compliance with residency rules, curfews, and exclusion zones around prohibited locations. Tampering with the device or failing to keep it charged is treated as a serious violation and can produce an arrest warrant or revocation.
You typically pay for electronic monitoring, generally several dollars per day plus setup fees. Combined with treatment, polygraph, and registration costs, the total financial burden runs well into the thousands of dollars per year for as long as probation lasts.
Travel
Domestic travel beyond your designated area requires advance approval from your probation officer. Even routine trips to another county for work or family may need explicit permission. The level of restriction depends on your risk level and compliance history, but the default is that you do not leave your approved area without asking first.
Out-of-state travel follows a more formal process through the Interstate Compact for Adult Offender Supervision (ICAOS). Travel permits are coordinated between the sending and receiving states, and the receiving state must be notified before a permit is issued. Limited exceptions exist for employment, treatment, or medical appointments in another state, provided the travel is limited to what is necessary and you return immediately after.13Interstate Commission for Adult Offender Supervision. Rule 3.110 – Travel Permits
International Trips
International travel carries federal obligations on top of what Colorado imposes. Under the International Megan’s Law, registered sex offenders must provide advance notice of any planned international travel, including departure and return dates, destination country, address abroad, and flight information. Knowingly failing to provide this information and then traveling carries a penalty of up to 10 years in federal prison.14GovInfo. International Megans Law to Prevent Child Exploitation
The law also requires the State Department to include a unique identifier in the passport of any covered sex offender, and passports previously issued without the identifier can be revoked.14GovInfo. International Megans Law to Prevent Child Exploitation The Angel Watch Center within the Department of Homeland Security identifies registered sex offenders who have booked international travel and notifies destination countries of their arrival.15U.S. Immigration and Customs Enforcement. Angel Watch Center Some countries deny entry entirely based on those notifications.
What a Violation Costs
Because sex offense probation is a sentence “not involving confinement” that “retains authority in the sentencing court to modify the conditions or to resentence the offender,” a violation can send you to prison under the same indeterminate framework, with a maximum term of life. That is the backdrop for every condition above, and it is why a missed appointment, an unapproved move, or a failed polygraph carries weight that ordinary probation violations do not.
