A yellow curb in California means you can stop only to load or unload passengers or freight, and only for the short window your city allows. The rule comes from California Vehicle Code Section 21458, which reserves yellow curbs for active loading rather than parking.1California Legislative Information. California Vehicle Code VEH 21458 Pull up, move your people or your freight, and leave. Walking away from the car is where drivers get into trouble.
What Yellow Actually Permits
Section 21458(a)(2) allows stopping at a yellow curb “only for the purpose of loading or unloading passengers or freight for the time as may be specified by local ordinance.”1California Legislative Information. California Vehicle Code VEH 21458 Two things follow from that language. First, loading has to be active — you cannot park and run an errand. Second, both passengers and freight count, which is the main thing that separates a yellow curb from a white one. White curbs are for passengers only.
The California Driver Handbook adds a rule most drivers never hear about: if you are in a noncommercial vehicle, you are generally required to stay with it the entire time you are in a yellow zone.2California DMV. Section 6 Navigating the Roads Continued A quick passenger drop-off is fine. Leaving the car idling at the curb while you dash inside is not.
How Long You Can Stay
The Vehicle Code sets no statewide time limit. It leaves that to each city.1California Legislative Information. California Vehicle Code VEH 21458 The result is a patchwork, and the limits that apply on your block are whatever your local ordinance says.
The common pattern in the Bay Area gives commercial vehicles up to 20 minutes for freight and noncommercial vehicles up to 3 minutes for passengers. Berkeley and Oakland both follow this standard.3City of Berkeley. City of Berkeley Parking Services Los Angeles is more generous: 30 minutes for commercial vehicles, 5 minutes for noncommercial.4Los Angeles Department of Transportation. Colored Curb Zones
Cities can also tighten the rules further on individual blocks — restricting a zone to commercial vehicles only, cutting the time limit, or extending the hours it is enforced. Those modifications show up on signs posted near the curb or stenciled on the curb itself. Read every sign within about 50 feet of your spot. If a sign and the paint seem to conflict, the sign controls.
When the Restriction Is in Force
Yellow curb rules do not run around the clock. Section 21458(b) leaves the enforcement days and hours to local ordinance.1California Legislative Information. California Vehicle Code VEH 21458 Outside those hours the loading restriction typically goes dormant and normal parking rules take over, so a yellow curb is often fair game on a Sunday evening or after 6:00 p.m. on a weekday. You still have to obey anything else posted for that block — street sweeping signs, overnight bans, and the like. Busy commercial districts sometimes extend enforcement, and a sign reading “No Parking 7AM–10PM” overrides the general schedule.
Fines and What Happens If You Ignore the Ticket
Parking in a yellow zone without actively loading, or overstaying the time limit, earns you a citation. Fines are set city by city and tend to run roughly $45 to $100 for a first offense, with late penalties that can double or triple the amount. A 2009 Los Angeles ordinance, for example, set the base loading-zone fine at $45, with late penalties climbing to $90 and then $100.5City of Los Angeles. Ordinance 180876 Current amounts in many cities are higher, so check your local fee schedule.
Letting a ticket sit creates bigger problems than the fine itself. Under Vehicle Code Section 40207, failing to pay or contest a parking citation can trigger a hold on your vehicle registration at the DMV, and you will not be able to renew until the delinquent violation is resolved.6Justia Law. Towing is also on the table. Under Vehicle Code Section 22651, a vehicle that has accumulated five or more unpaid parking citations can be towed and impounded.7California Legislative Information. California Vehicle Code VEH 22651 A vehicle parked where a local authority has prohibited parking and posted tow-away signs can be removed on the spot. Once the car is in an impound lot you are paying the tow fee, daily storage, and an administrative release fee on top of the original ticket.
How to Fight a Yellow Curb Ticket
California gives you a two-step process to contest any parking citation, set out in Vehicle Code Section 40215. It works the same regardless of which city wrote the ticket.
The first step is an initial review. You have 21 calendar days from the date the citation was issued to request one from the issuing agency. You can do it by phone, in writing, or in person, and there is no fee. If the agency agrees the violation didn’t occur, that you weren’t responsible, or that the circumstances justify dismissal, it will cancel the ticket.8California Legislative Information. If that review goes against you, the second step is an administrative hearing. You have another 21 calendar days after the agency mails its decision to request one. You must deposit the full fine amount before the hearing, though you can ask for a waiver based on inability to pay. The hearing can be held by mail, in person, or by phone if the agency offers that option, and it must take place within 90 calendar days of your request.8California Legislative Information. Defenses That Actually Work
A few situations give you real grounds to contest a yellow curb citation:
- Faded or missing paint. If the yellow was so worn that a reasonable driver couldn’t identify the curb color, that is a recognized basis for contesting. Photograph the curb immediately; your phone’s timestamp is the best evidence you’ll get.
- No posted sign where one was required. If your city’s ordinance requires signage in addition to paint for a particular restriction, and the sign was missing or obstructed, the citation may not hold up.
- You were actively loading within the time limit. If an officer cited you while loading was still underway and you hadn’t exceeded the local limit, pull together receipts, delivery records, or witness statements showing you were in compliance.
Whatever the defense, document the scene early. Photos of the curb, the surrounding signs, your vehicle’s position, and anything obstructing the paint or signage are all admissible at the administrative hearing. The 21-day clock for the initial review runs from the citation date, not from when you spotted the ticket on your windshield, so move quickly.8California Legislative Information.
