Outside New York City, the guns that are legal in New York without a permit are a short list: standard manually operated rifles and shotguns, and antique muzzle-loading handguns. Everything else — handguns, semi-automatic rifles, short-barreled long guns — requires a state license. Inside the five boroughs, nothing is permit-free; the NYPD requires a permit for every firearm, including the bolt-action rifles and pump shotguns that need no paperwork elsewhere in the state.
Bolt-Action, Pump, and Lever Rifles and Shotguns
If you are at least 16 and live outside New York City, you can possess a standard bolt-action, pump-action, or lever-action rifle or shotgun without a license. The rifle barrel must be at least 16 inches and the shotgun barrel at least 18 inches. Anything shorter is reclassified as a “firearm” under state law and needs a license like a handgun.1New York State Senate. New York Penal Law PEN 265.00 – Definitions
The 16-year-old floor applies to possession of any rifle or shotgun. Children between 12 and 15 can handle firearms at a supervised shooting range but cannot possess one on their own, and nobody under 16 may possess ammunition. These restrictions do not apply to holders of valid hunting licenses using the gun under state hunting rules.2Giffords Law Center to Prevent Gun Violence. Antique and Black Powder Handguns
Handguns almost always require a pistol license in New York, with one carve-out that catches people by surprise. The Penal Law’s definition of “antique firearm” covers unloaded muzzle-loading pistols or revolvers that use a matchlock, flintlock, percussion cap, or similar ignition system, as well as pistols or revolvers that use fixed cartridges no longer commercially available.1New York State Senate. New York Penal Law PEN 265.00 – Definitions Antique handguns are carved out of the definition of “firearm” entirely, so a black powder cap-and-ball revolver does not need a pistol license. A modern-manufactured replica that uses the same ignition system is treated the same way. The firing mechanism controls the exemption, not the date the gun was made.
Muzzle-loading rifles and shotguns are already included in the ordinary definitions of “rifle” and “shotgun,” so they follow the long-gun rules: no permit outside New York City, minimum age 16. The antique exemption does not help anyone otherwise barred from possessing firearms, such as a convicted felon.
What Is Not Permit-Free
Several categories people often assume fall outside the licensing system actually do not.
Every modern handgun must be individually listed on a New York Pistol License, whether you carry it, keep it at home, or only shoot it at the range. You must be at least 21 to apply, with an exception for honorably discharged military veterans.3New York State Senate. Semi-automatic rifles joined the licensed list on September 4, 2022. Since that date, buying or taking ownership of any semi-automatic rifle requires a state-issued Semi-Automatic Rifle License, and the minimum age is 21.3New York State Senate. New York Penal Law PEN 400.00 – Licensing and Other Provisions Relating to Firearms You apply through the same county or local licensing officer who handles pistol permits. If you lawfully owned a semi-automatic rifle before September 4, 2022, you can keep it without a license even if you were under 21 at the time; the requirement attaches only to transfers of ownership on or after that date.5New York State Police. Assault Weapon and Magazine Limits Still Apply
No license, old or new, makes an assault weapon legal to acquire today. New York uses a one-feature test for semi-automatic rifles: if the rifle can accept a detachable magazine and has even one of the following features, it is an illegal assault weapon.
- Folding or telescoping stock
- Pistol grip that protrudes conspicuously beneath the action, or a thumbhole stock
- Second handgrip or protruding grip for the non-trigger hand
- Bayonet mount
- Threaded barrel designed to accept a flash suppressor, muzzle brake, or similar device
Semi-automatic shotguns face a parallel one-feature test covering folding or telescoping stocks, thumbhole stocks, second handgrips, fixed magazines over seven rounds, and the ability to accept a detachable magazine.1New York State Senate. New York Penal Law PEN 265.00 – Definitions Possession is a felony. The only exception is for guns legally owned and registered with the state before the SAFE Act’s registration deadline closed on April 15, 2014. There is no retroactive way to register.
Magazines are capped at ten rounds. Possessing a magazine that can hold more than ten is a criminal offense regardless of whether the firearm itself is permit-free, with narrow exceptions for certain law enforcement and military personnel.6Gun Safety in NYS. Changes to the SAFE Act
Storage and Transport Still Apply
Owning a rifle or shotgun without a permit does not free you from safe storage duties. If you live with anyone under 18, anyone subject to an extreme risk protection order, or anyone prohibited from possessing firearms because of a felony or serious offense, the gun must be locked in a safe storage container or secured with a gun lock whenever it is not in your immediate possession or control. The statute defines a safe storage depository as a locked container that is fire-, impact-, and tamper-resistant.7New York State Senate. New York Penal Law PEN 265.45 – Safe Storage of Rifles, Shotguns, and Firearms
A firearm left unattended in a vehicle must meet the same standard: unloaded, locked in a fire-, impact-, and tamper-resistant case, and hidden from view. A glove compartment does not qualify. If someone stays with the vehicle, the locked case is not required. New York City is stricter — all firearms must be unloaded, cased, and out of sight at all times during transport, even when you are present.8Gun Safety in NYS. Resources for Gun Owners
Nothing Is Permit-Free in New York City
The permit-free categories end at the city line. Within the five boroughs, a permit issued by the NYPD is required to possess any firearm, including the ordinary bolt-action rifles and pump-action shotguns that need no paperwork anywhere else in the state.9New York City Police Department. Firearms Licensing Someone who lawfully owns an unregistered long gun upstate becomes a criminal the moment they bring it into the city without completing the NYPD process. If you move into the city or bring a long gun in for storage, you have 72 hours to apply for the permit and register the firearm.10New York City Police Department. People Who Cannot Possess Any Firearm
Permit-free does not mean person-free. Federal law bars the following categories from possessing firearms or ammunition at all:
- Anyone convicted of a crime punishable by more than one year in prison
- Anyone convicted of a misdemeanor crime of domestic violence or subject to a qualifying domestic violence restraining order
- Anyone found mentally defective by a court or committed to a mental institution
- Anyone with an active warrant or fleeing prosecution
- Anyone who is an unlawful user of or addicted to controlled substances
- Anyone discharged from the military under dishonorable conditions
- Anyone who has renounced U.S. citizenship
- Most non-immigrant visa holders and anyone unlawfully in the United States
New York adds its own prohibitions on top of the federal list, including for people convicted of certain serious offenses that may not rise to felony level. If you fall into any prohibited category, no gun is legal for you in New York, and the penalties are significantly harsher than those for simple permit violations.
